Project Summary: The applicant is requesting a garbage enclosure modification associated with the
Kiddie Research daycare center site plan approval LUA19-000129 dated October 1,
2019. The land use decision required the applicant to obtain a modification to the
garbage enclosure standards as the proposed design and location of the enclosure
did not meet the applicable standards set forth in RMC 4-4-090C.4 regarding
obstructions to pedestrians and vehicle traffic.

D. FINDINGS OF FACT (FOF):
1. The Planning Division of the City of Renton accepted the above master application for review and
determined the application complete on January 14, 2020. The project complies with the 120-day review
period.
2. The applicant’s submittal materials comply with the requirements necessary to process the modification
request (Exhibits 2-6)
3. The project site is located 3123 Sunset Blvd NE., Renton, WA
4. The project site is currently vacant.
5. Access to the site would be provided via a driveway along NE 12th St. The existing driveway along Sunset
Blvd NE would be removed.
6. The property is located within the Commercial and Mixed Use (CMU) Comprehensive Plan land use
designation.
7. The site is located within the Center Village (CV) zoning classification.
8. There are no critical areas map on the site.
9. The applicant is proposing to begin construction in autumn of 2020 and end in in the last quarter of
2021.
10. Representatives from various city departments have reviewed the application materials to identify and
address issues raised by the proposed development. These comments are contained in the official file,
and the essence of the comments has been incorporated into the appropriate sections of this report and
the Departmental Recommendation at the end of this report.
11. Modification Analysis: The applicant is requesting a modification from RMC 4-4-090C.4 in order to
temporarily obstruct pedestrian and vehicle traffic during refuse and recycling service. The proposed
refuse and recycling enclosure is located along the NE 12th St frontage within the open side of the parking
structure beneath the second floor of the building. Due to site constraints which includes only one (1)
driveway, the refuse hauler would be unable to drive within the site and maneuver as is typical for service
on a commercial site. Therefore, the applicant has proposed the hauler back in partially under the building
and load the receptacles onto the front hooks of the truck near the public sidewalk. This would result in
temporary obstructions along the public sidewalk along NE 12th St while maneuvering, the drive aisle into
the site, and one (1) parking space in front of the enclosure’s gate opening. The administrative site plan
approval indicated a modification may also be necessary for minimum gate openings and vertical
clearance however building permit submittal documents (Exhibits 3 and 5) have indicated the these two

criteria have been met with a 12-foot wide gate opening and 11-foot high vertical clearance. The proposal
is compliant with the following modification criteria, pursuant to RMC 4-9-250, if all conditions of approval
are met. Therefore, staff is recommending approval of the requested modification, subject to the
condition as noted below:

a. Substantially implements the policy direction of the policies and objectives of the
Comprehensive Plan Land Use Element and the Community Design Element and
the proposed modification is the minimum adjustment necessary to implement
these policies and objectives.
Staff Comment: The applicant contends the proposed modification achieves the City’s
Comprehensive Plan’s Land Use Element and compliments the site and building design.
Staff concurs the proposed modification implements the policies and objectives of the
Comprehensive Plan and is the minimum adjustment necessary. The parking area is
visible from the NE 12th St frontage however the location of the refuse and recycling
enclosure would assist in screening vehicles from the ROW as is shown on the site plan
and elevation (Exhibits 3 and 5). The enclosure would contain the same cladding
material as the ground floor exterior of the building inside of the parking area thereby
blending in with the architecture of the building. The obstruction to pedestrian and
onsite vehicle traffic would only occur during those limited service pick-ups.

protection and maintainability intended by the Code requirements, based upon
sound engineering judgment.
Staff Comment: The applicant contends the proposed modification would meet the
above-referenced objectives.
Staff concurs the proposed modification would meet the objectives of function and
maintainability intended by the code requirements if the condition of approval is met.
The location of the enclosure allows for rapid loading as it is near the entrance. The
design and appearance of the enclosure compliments the building’s architecture and
adds a green roof element to the structure as shown on the landscape plan (Exhibit 4),
which is unique and innovative for a refuse and recycling enclosure.
As the building is setback 15-feet from the property line and based on the
correspondence between the applicant and Republic Services (Exhibit 6), there would
be clearance to back the hauler into the driveway and have the truck partially under the
building while the refuse and recycle bins are loaded to the front of the truck. This
maneuvering would temporarily block the public sidewalk as the truck gets into position
and block the onsite parking aisle while loading is taking place. A parking space
identified as Compact Space 9 on the site plan (Exhibit 3) is located in front of the gate
opening of the enclosure and would obstruct the hauler’s access if a vehicle were parked
there. To ensure the hauler will have access into the enclosure on pick up days, staff
recommends as a condition of approval, the applicant install a sign on the parking space
abutting the refuse and recycling enclosure that indicates no parking is permitted in
that space on the service day. The sign shall be shown on the building permit site plan
sheet and accompanied by a detail sheet to be reviewed and approved by the Current
Planning Project Manager prior to permit issuance.
c. Will not be injurious to other property(ies) in the vicinity.

Staff Comment: The applicant contends the proposed modification would not affect
other properties in the vicinity.
Staff concurs the proposed modification would not be injurious to other properties in
the vicinity. The loading would occur on the subject site and maneuvering would only
temporarily impact the public sidewalk along NE 12th St. See also comments under
criterion ‘b’.
d. Conforms to the intent and purpose of the Code.
Staff Comment: The proposed location of the refuse and recycling enclosure provides
the required space and accessibility for the refuse and recycling hauler. See also
comments under criterion ‘b’.
e. Can be shown to be justified and required for the use and situation intended; and
Staff Comment: The location and design of the enclosure compliments the building’s
architecture and is needed to comply with the City’s refuse and recyclables standards.
See also comments under criterion ‘b’.
f. Will not create adverse impacts to other property(ies) in the vicinity.

E. DECISION:
The proposal satisfies six of the six criteria listed in RMC 4-9-250D for approval of modifications. Therefore, the
Kiddie Research Garbage Enclosure Modification, File No. LUA20-000009, MOD, is approved and is subject to
the following condition:
1. The applicant shall install a sign on the parking space abutting the refuse and recycling enclosure that
indicates no parking is permitted in that space on the service day. The sign shall be shown on the building
permit site plan sheet and accompanied by a detail sheet to be reviewed and approved by the Current
Planning Project Manager prior to permit issuance.

K. LAND USE ACTION APPEALS, REQUEST FOR RECONSIDERATION, & EXPIRATION:
The administrative land use decision will become final if the decision is not appealed within 14 days of the decision
date.
APPEAL: This administrative land use decision will become final if not appealed in writing to the Hearing
Examiner on or before 5:00 PM on March 6, 2020. An appeal of the decision must be filed within the 14-day
appeal period (RCW 43.21.C.075(3); WAC 197-11-680), together with the required fee to the Hearing Examiner,
City of Renton, 1055 South Grady Way, Renton, WA 98057. RMC 4-8-110.B governs appeals to the Hearing
Examiner and additional information regarding the appeal process may be obtained from the City Clerk’s Office,
(425) 430-6510.
EXPIRATION: The Modification decision will expire two (2) years from the date of decision. A single one (1) year
extension may be requested pursuant to RMC 4-9-250.
RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by
the approval body. The approval body may modify his decision if material evidence not readily discoverable prior
to the original decision is found or if he finds there was misrepresentation of fact. After review of the
reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will
be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal
within the 14-day appeal time frame.
THE APPEARANCE OF FAIRNESS DOCTRINE: provides that no ex parte (private one-on-one) communications may
occur concerning the land use decision. The Doctrine applies not only to the initial decision, but to Appeals to the
Hearing Examiner as well. All communications after the decision/approval date must be made in writing through
the Hearing Examiner. All communications are public record and this permits all interested parties to know the
contents of the communication and would allow them to openly rebut the evidence in writing. Any violation of
this doctrine could result in the invalidation of the appeal by the Court.

The Kiddie Research Daycare Center development is seeking a modification to the City standards for the
location of the refuse receptacle. This modification request asks for modification per the conditional land

The subject site is composed of one parcel (#0423059155) addressed 3123 NE Sunset Boulevard. The site
is bordered by NE Sunset Boulevard to the west and NE 12th Street to the south. Proposed development of
the property will include the construction of a building and parking which will accommodate and house a
daycare center. Access will be via NE 12th Street. The refuse enclosure will be located at the SE corner of
the property with direct access from the parking area. The refuse company has reviewed and approved of
this location and sent a ‘will serve’ letter enclosed for your review and approval.
MODIFICATION PROCEDURES PER RMC 4-9-250.D.2
Whenever there are practical difficulties involved in carrying out the provisions of this Title, the
Department Administrator may grant modifications for individual cases provided he/she shall first find that
a specific reason makes the strict letter of this Code impractical, that the intent and purpose of the
governing land use designation of the Comprehensive Plan is met and that the modification is in conformity
with the intent and purpose of this Code, and that such modification:
· Substantially implements the policy direction of the policies and objectives of the Comprehensive
Plan Land Use Element and the Community Design Element and the proposed modification is the
minimum adjustment necessary to implement these policies and objectives;
· Will meet the objectives and safety, function, appearance, environmental protection and
maintainability intended by the Code requirements, based upon sound engineering judgment;
· Will not be injurious to other property(ies) in the vicinity;

After speaking with you and looking at the plan dimensions further, I think you will have the
appropriate clearances to back into the driveway and have the truck partially under the building
while you load the bins on the front hooks near the sidewalk. If you agree with this setup then I
think we can leave the site plan as shown.
