A copy of the letter of denial is included herewith. On behalf of my client, I wish to appeal the deuial to the Hearing Examiner. The Uasis of the appeal is that the ordinance section , relied upon for the denial — npplicant currently serving a sentence of criminal activity undex• . RMC 5-12-7(D) — applies only to the hoIder of Adult Entertainment Business license and daes apply to the holder of an Adult Entertainment Manager License issued pursuant to RMC 5-12- 10. In addition, denial of the license based upon past criminal activity violates my client's right to freedom of speech as guaranteed by the First Amendment to the United States Constitution and Article 1, Section 5 of the Washington Canstitution. See, Seattle v. Bittner, 81 Wash. 2d 747, 505 P. 2d 126 {1973). I understand that i�1y client l�as ah�eady paid the $250.00 filing fee. A copy of the i-eceipt for the fee is also included herewith.
