The proposal is to replace the existing framing within the same location footprint with ACZA treated fir beams. Replacement stringers would be 4 inches by 8 inches, and joists/pile caps would be 6 inches by 8 inches. Framing is shown as section detail in Exhibit 1. The wood decking would be replaced with ThruFlow grated panels. Existing piles would be sleeved with HDPE tubes, no piles are proposed to be added, removed, or replaced. There is no grade/fill work proposed, and no trees proposed for removal. All materials would be brought to the site via barge. The proposal would be exempt from SEPA in accordance with WAC 197-11 -800(3) Repair, remodeling, maintenance activities. PROJECT ANALYSIS: Maintenance and Repair of Docks: Existing docks or piers that do not comply with these regulations may be repaired in accordance with the criteria below. i. When the repair and/or replacement of the surface area exceeds thirty percent (30%) of the surface area of the dock/pier, light penetrating materials must be used for all replacement decking. For floating docks, light penetrating materials shall be used where feasible, and as long as the structural integrity of the dock is maintained. Staff Comment: The proposed repair to the existing dock includes the replacement of the surface area and would exceed the 30% threshold. The applicant is proposing to utilize ThruFlow decking, which is a light penetrating surface. ii. When the repair involves replacement of the surfacing materials only, there is no requirement to bring the dock/pier into conformance with dimensional standards of this Section. Staff Comment: The proposed repair work involves the replacement of surfacing materials only; therefore it is not required to bring the dock into conformance with the dimensional standards. iii. When the repair/replacement involves the replacement of more than fifty percent (50%) of the pilings, or more, the entire structure shall be replaced in compliance with these regulations. Staff Comment: No pilings are proposed for replacement, therefore this section is not applicable. iv. When the existing dock/pier is moved or expanded or the shape reconfigured, the entire structure shall be replaced in compliance with these regulations. Staff Comment: Not applicable, the dock is not proposed to be moved, expanded or reconfigured. SEC-TWN-R: NE29 - 24 - 5 LEGAL DESCRIPTION: (King County Assessor) HILLMANS LK WN GARDEN OF EDEN # 3 30 LESS N 17.5 FT & ALL OF 31 & SH LDS ADJ WATER BODY/REACH: Lake Washington Reach B EXEMPTION JUSTIFICATION: An exemption from a Shoreline Management Substantial Development Permit is hereby Approved with Conditions* on the proposed project in accordance with RMC 4.9.190C 'Exemption from Permit System' and for the following reasons: The repair work proposed would be considered normal maintenance and repair of an existing structure per WAC 173.27.040(2)(b). The proposed development is: Consistent with the policies of the Shoreline Management Act. Not Applicable to the guidelines of the Department of Ecology where no Master Program has been finally approved or adopted by the Department. Consistent with the City of Renton Shoreline Master Program. CONDITIONS: Light penetrating materials shall be used for all replacement decking. The approval body may modify his decision if material evidence not readily discoverable prior to the origi nal decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14 day appeal time frame. APPEALS: The administrative land use decision will become final if not appealed in writing together with the required fee to: Hearing Examiner, City of Renton, 1055 South Grady Way, Renton, WA 98057 on or before 5:00 pm, on March 13, 2020 (RCW 43.21.C075(3); WAC 197-11 -680). RMC 4-8-110 governs appeals to the Hearing Examiner and additional information regarding the appeal process may be obtained from the Renton City Clerk's offic e, Renton City Hall, 7th Floor, (425) 430-6510.
