pre-d�velo�ed hydre�logy and minimize sfarmwater runaff on the Prr�perty.
2. City of R�ntan shall ha�e the right to in�ress.and egress a�er-thase por�i�ns of the Proper�y
nec�ssary to perform inspections of th� stormwater facilities and BMPs and conduct
rnaintenance acti�ities s�aecified in this Cteclz�ratinn of Cavenant and in accordance with the
Renton Municipal Cade. City af Renton shall provide at least thirty (30J days' written nntic�to
the Owners that e�itry Qn the Prop�r�y is planned for the inspection of drainag�facilities. After
tl�e thlr�y(30) days,the Uwners shall alfow the Ci#y of Renton to �nter far�he sa[e purpose of
inspecting drainage facilities. In lieu of inspection by the City, the Owners rrtay elect to ei�gage
a ]icensed civil engineer registered in the state a�F Washingtan wlio has exp�rtis� ir-�drainage to
inspect the drainage facilities and pro�ide a written repart describing their condition. [f tfte
engineer option is chosen,the Owners shal9 provide written notice to the City of Renton within
fif�een(15)days of recei�ing the City's natice of inspeetian.Within thirty(30)days of gi�ing�his
notice,the Owners,or engineer on faehal�af the C}wners,sha[i pro�ide the engineer'S repart ta
tl�e City of Renton. If the repart is not provided in a timely manner as specified above,�he City
of Renton may inspect the dra[nage facilEti�s without furiher notiee.
3. If City of Etentan d�t�rmines frorn its inspection, or from an engineer's report pro�ided in
accardance with Paragraph 2, that maintenance, repair, restarat[on, and/ar miCigation work is
required to be don�to any of the drainage facilities, City of Rentan sf�all notify the Owners of
the specific maintenance, repair, restaratian, and/or n�itigatian work ("Work"} required
pursuant ta the Ren�on Municipa! Code. The City shall also set a reasonai�le c{eactline for�he
Owners to co��npl�te the Work, or to pravide an engine�r's report that �erifies completEor� of
th� Work. AfCer the deadline f�as passed, th� Owners shall allow the City access to re-insp�ct
the drainage facilities u�less an en�irreer`s re�art has been pro�ided ��rifying cam�letion of
the Work. ff the Wor[c is n�t comple�ed within the time frame set by the City, the City may
initiate an enforcement actio� and/or p�r�arm the Work and hereby is �iven access to th�
Property far such purposes. Written notic� will be sent to �he Owners stating the City's
intention to perform such Wark.�his Work will no�cammence until at least seven(7)days after
such notice is mailed. lf, witi�in the snle discretion af the City, there exisfs an immin��lt �r
present danger, the seven (7) day notice period will be wai�ed and Work will begin
im med iately.
4. The Owners shall assui�ne all r�sponsibility fnr th�cost of any Worlc, or any measures taken by
the City to address conditions as described in Paragraph 3. 5uch responsibility shall include
reirnbursernent to the City within tttirty(3q)days of the receipt af the invoice for any such Work
performed. Overdue paym�nfis will require payment af interest at fihe rrraximum legal rate
allowed k�y RCW 19.52.020(currently twel�e percent (12%J). lf the City initiates legal artion to
enforce this agreement, th� prevailing pariy in sucf7 action is entitled to reeover reasonable
litigation casts and attorney's fees.
5. The Owners are required to obtain written appror�al from City of Renton prior to fillin�, piping,
c�J�ting, or removing�egetation {�xcept in rc�utine landscape maintenance) in open vegetated
starrrtwater faciliti�s {suc�f as swafes, channels, ditches, ponds, etc.), ar perfarming any
alteratians or modificatians to the drainage facilities referenced in this Qecfarati�n of Co�enant.
