PUBLIC HEARING
a) WSDOT Acquisition for I‐405 & Southport Interchange: This being the date set, and proper
notices having been posted and published in accordance with local and State laws, Mayor
Pavone opened the public hearing to consider the WSDOT Acquisition for the I‐405 Southport
Interchange Project.
Planning & Technical Services Manager Amanda Askren reported that the Washington State
Department of Transportation (WSDOT) is planning improvements to I‐405 and the Southport
Interchange. She displayed a map depicting the sites of the potential acquisitions for the
project, and explained how these acquisitions are part of the larger I‐405 Renton to Bellevue
Widening and Express Toll Lanes Project. Ms. Askren further reported that WSDOT is
requesting that the City execute two Temporary Construction Easements, a permanent Access
Easement, and a Quit Claim Deed with the City with compensation set at $18,100 in order to
accomplish the project. She also noted that the Temporary Construction Easements expire on
December 31, 2024. Ms. Askren recommended that Council authorize the Mayor and City
Clerk to execute the documents necessary for WSDOT to complete its project.

ADMINISTRATIVE REPORT
Chief Administrative Officer Robert Harrison reviewed a written administrative report
summarizing the City’s recent progress towards goals and work programs adopted as part of
its business plan for 2020 and beyond. Items noted were:
On March 5, a proclamation of local emergency was issued for the city due to the
public health impacts of COVID‐19. During uncertain times such as these, the city may
require supplemental assistance if the severity of the event goes beyond the
capabilities of local resources. The emergency declaration enables the city to call in
those additional resources. Also, the city’s Emergency Operations Center (EOC) is
activated virtually between 8 am to 5 pm.
Large events and meetings over 250 people have been canceled per governor’s
emergency order. The Public Health Officer also prohibits ALL gatherings under 250
unless they comply specifically with Public Health guidance to reduce infection. We
have closed and cancelled all programming, events, meetings, and rentals through
March 31 at Renton Community Center, Renton History Museum, Renton Senior

Activity Center, North Highlands Neighborhood Center, and Highlands Neighborhood
Center. The Senior Lunch Program is still operating with sack lunches available for
pick‐up by drive through only, Monday through Friday from 11:30 a.m.‐12:30 p.m.
City staff will be out front to hand out sack lunches. We’ve also established a COVID‐
19 page on our website and are working diligently to share information from public
health officials via our Twitter, Facebook, and Nextdoor accounts. We have been
working closely with members of my Inclusion Task Force to keep them informed of
the situation and be available to them and their communities during these times. The
containment of COVID‐19 is an ever‐evolving situation with all events happening in
real time. Because of this, your best source for the most up‐to‐date information is
Public Health ‐ Seattle and King County and the Centers for Disease Control and
Prevention.
Invitations to partake in the 2020 Federal Census will begin showing up in mailboxes
this week! A completed form ensures everyone in your household is counted which is
important as the census determines allocation of federal funding to support housing,
education, transportation, health care, and other programs and infrastructure in
Renton. Please don’t delay and take your census online now.
Preventative street maintenance will continue to impact traffic and result in
occasional street closures.

Items listed on the Consent Agenda were adopted with one motion, following the listing.
a) Approval of Council Meeting minutes of March 2, 2020. Council Concur.
b) AB ‐ 2605 City Clerk reported the bid results for the January 30, 2020 bid opening for the
Williams Ave S and Wells Ave S Conversion project, CAG‐20‐001, and submitted the staff
recommendation to award the contract to the lowest responsible and responsive bidder,
Cascade Civil Construction, LLC, in the amount of $7,733.422.80. Council Concur.
c) AB ‐ 2604 Administrative Services Department recommended approval of an 60‐month lease
agreement with Xerox/QBSI Sales/Service, in the amount of $55,000 per year, for Print Shop
copier/printer use and services. Council Concur.
d) AB ‐ 2608 Administrative Services Department requested authorization to hire a Senior
Finance Analyst at Step D of salary grade m25, effective April 1, 2020. Council Concur.
e) AB ‐ 2609 Administrative Services Department requested authorization to hire a Senior
Finance Analyst at Step D of salary grade m25, effective April 1, 2020. Council Concur.
f) AB ‐ 2598 Community & Economic Development Department recommended executing the
professional services agreement with Berk Consulting, Inc., in the amount of $80,000, to
complete a City‐wide Housing Action Plan. Council Concur.
g) AB ‐ 2593 Community Services Department submitted the bid results for the Cedar River
Trestle Bridge Repairs project, CAG‐20‐006, and recommended the lowest responsive and
responsible bidder, EmTech, LLC, be awarded the contract in the amount of $367,400; and
recommended the budget be adjusted to cover contingencies. Council Concur.

h) AB ‐ 2595 Community Services Department recommended approving an agreement with the
Washington State Department of Health to accept up to $7,500 in grant funds for the
reimbursement of Supplemental Nutrition Assistance Program (SNAP) funds used at the 2020
Renton Farmers Market. Council Concur.

UNFINISHED BUSINESS
b) Finance Committee Chair Prince noted that the Finance Committee had been canceled. In
regards to the Interagency Agreement with the Washington State Department of Commerce for
the E2SHB 1923 Grant to Adopt a Housing Action Plan, it was
MOVED BY PRINCE, SECONDED BY VǍN, COUNCIL APPROVE THE READING OF THE
RESOLUTION ENTERING INTO THE AGREEMENT FOR THE GRANT AND AUTHORIZE
THE MAYOR AND CITY CLERK TO EXECUTE THE AGREEMENT. CARRIED.
a) Finance Committee Chair Prince also noted that in regards to Accounts Payable Vouchers, it was

FOUR WIRE TRANSFERS, AND FOR PAYROLL VOUCHERS A TOTAL PAYMENT OF
$1,533,359.51 WHICH INCLUDES 671 DIRECT DEPOSITS AND FIVE CHECKS FOR THE
PAY PERIOD 2/1/2020 THROUGH 2/15/2020 BE APPROVED. CARRIED.
c) Utilities Committee Chair O'Halloran noted that the Utilities Committee had been canceled. In
regards to the Agreement with King County Flood Control Zone District for Lower Cedar River
Flood Risk Reduction Feasibility Study, it was

ACCEPTANCE OF THE GRANT AGREEMENT IN THE AMOUNT OF $499,658.

Councilmember McIrvin noted that the Public Hearing regarding the WSDOT acquisitions was
being held open to receive additional comments due to precautions implemented in regards to
the COVID‐19 issue. He remarked that the resolution approving the WSDOT documents would be
presented for adoption at the next Council meeting.
Councilmember Vǎn remarked that the COVID‐19 issue has been especially detrimental to people
with low‐incomes and/or unstable housing, and also to small businesses. Therefore, it was

the Lake Youngs Court SE Storm and Water Improvements Project

FISCAL IMPACT SUMMARY:
The original contract amount was $501,986.60 and the final project cost was $440,842.06. The 12% savings
was primarily due to coordination between the Utility Systems Division and the Transportation Maintenance
Department to schedule concurrent projects so that duplicate repairs were not required. The project was
funded through the approved 2019 Surface Water Utility Capital Improvement Program budget for Small
Drainage Projects (427.475015) and the Water Utility Capital Improvement Program budget for Steel Water
Main Replacement Program (425.455170).
SUMMARY OF ACTION:
The Lake Youngs Court SE Storm and Water Improvements Project was awarded to Oceanside Construction,
Inc. on July 8, 2019. Physical completion of all required work items was granted March 3, 2020. The project
consisted of installation of a new stormwater conveyance system and replaced the existing water main, water
meters and provided a new fire hydrant. Other works included sidewalk replacement, driveway replacement,
temporary traffic control and final site restorations.

FISCAL IMPACT SUMMARY:
The total Rainier Avenue South Phase 4 project budget is $30,000,000. The grant revenue secured to date is
$10,300,000, which includes design, right-of-way and construction of Phase 4. The budget for right-of-way is
$3,000,000. The expenditure required for Supplemental Agreement No. 6 to CAG-15-089 is $219,072. With
this agreement the maximum amount payable including d esign and right-of-way is $3,173,539.
SUMMARY OF ACTION:
Rainier Avenue South – Phase 4 [South 3rd Street to NW 3rd Place, (TIP #21)] continues the design of
infrastructure improvements to the Rainier Avenue South corridor. The approximate project area limits of
Phase 4 are between South 3rd Street and NE 3rd Place. Similar to Phase 3 this new phase includes
infrastructure improvements for enhanced transit mobility and traffic and pedestrian safety.
Pursuant to the Local Agency Guidelines Manual and Policy 250-02, KPG, P.S. was selected for engineering
services on this project. Supplemental Agreement No. 6 provides for KPG’s right-of-way sub-consultant Epic
Land Solutions to provide right-of-way efforts that include title report updates, examination, clearance and
pre-closing, property rights acquisition and/or negotiations, eminent domain and/or condemnation support
and WSDOT right-of-way certification consultation.

OF A PORTION OF CITY‐OWNED PROPERTY, GRANT OF TWO TEMPORARY
EASEMENTS OVER PORTIONS OF CITY‐OWNED PROPERTY, AND GRANT OF AN
ACCESS EASEMENT OVER A PORTION OF CITY‐OWNED PROPERTY, TO THE STATE
OF WASHINGTON DEPARTMENT OF TRANSPORTATION (“WSDOT”), IN
RELATION TO WSDOT’S I‐405 RENTON TO BELLEVUE WIDENING AND EXPRESS
TOLL LANES PROJECT, AND AUTHORIZING THE MAYOR TO SIGN THE NECESSARY
DOCUMENTS AND TAKE THE NECESSARY ACTIONS TO TRANSFER TITLE AND
GRANT THE EASEMENTS.
WHEREAS, as a part of the overall I‐405 Renton to Bellevue Widening and Express Toll
Lanes Project (the “Project”), the State of Washington Department of Transportation (“WSDOT”)
needs to acquire 20,978 square feet of certain property located between Houser Way N and the
existing I‐405 owned by the City for WSDOT right‐of‐way, such property to be acquired being
legally described in Exhibit A attached hereto and incorporated by reference as if fully set forth
(the "Right‐of‐Way Property"); and
WHEREAS, as a part of the Project, WSDOT needs to acquire a 326 square feet temporary
easement, over, upon, and across a certain portion of property owned by the City for WSDOT's
use during construction of its Project, such portion of property being legally described in Exhibit
B, attached hereto and incorporated by reference as if fully set forth ("Temporary Easement 1");
and
WHEREAS, as a part of the Project, WSDOT needs to acquire a 5,040 square feet
temporary easement, over, upon, and across a certain portion of property owned by the City for
WSDOT's use during construction of its Project, such portion of property being legally described

in Exhibit C, attached hereto and incorporated by reference as if fully set forth ("Temporary
Easement 2"); and
WHEREAS, as a part of the Project, WSDOT needs to acquire a 729 square feet access
easement over, under, upon, and across a certain portion of property owned by the City, for
access by WSDOT to its stormwater detention area, such portion of property being legally
described in Exhibit D, attached hereto and incorporated by reference as if fully set forth (the
"Access Easement"); and
WHEREAS, WSDOT informed the City of its intent to acquire the Right‐of‐Way Property,
Temporary Easement 1, Temporary Easement 2, and the Access Easement under the imminent
threat of WSDOT’s exercise of eminent domain;
WHEREAS, the Right‐of‐Way Property was appraised and WSDOT offered the City a
purchase price of $6,300 commensurate with the appraisal value; and
WHEREAS, the Temporary Easement 1 rights were appraised and WSDOT offered the City
a price of $50 commensurate with the appraisal value; and
WHEREAS, the Temporary Easement 2 rights were appraised and WSDOT offered the City
a price of $850 commensurate with the appraisal value; and
WHEREAS, the Access Easement rights were appraised and WSDOT offered the City a
price of $10,900 commensurate with the appraisal value; and
WHEREAS, the City after a news release and publication of a public notice for public
hearing, did hold on the 16th day of March, 2020, a public hearing to consider authorizing the
sale of the Right‐of‐Way Property and the grant of Temporary Easement 1, Temporary Easement

2, and the Access Easement, and those members of the public who wished to testify were duly
allowed to testify and the testimony was considered by the City Council; and
WHEREAS, the City Council has determined that the sale of the Right‐of‐Way Property
and grant of Temporary Easement 1, Temporary Easement 2, and the Access Easement are in the
public interest;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
RESOLVE AS FOLLOWS:
SECTION I. The Council authorizes the following:
A. Sale of the Right‐of‐Way Property to WSDOT in the amount of $6,300;
B. Grant of Temporary Easement 1 in the amount of $50;
C. Grant of Temporary Easement 2 in the amount of $850; and
C. Grant of the Access Easement in the amount of $10,900.
SECTION II. The Mayor is hereby authorized to sign the necessary documents and take
the necessary actions to transfer title of the Right‐of‐Way Property and grant Temporary
Easement 1, Temporary Easement 2, and the Access Easement to WSDOT.

SUPPORTING THE WASHINGTON STATE MORATORIUM ON RESIDENTIAL
EVICTIONS FOR NON‐PAYMENT OF RENT AND SUPPORTING MAYOR PAVONE’S

WHEREAS, on March 18, 2020, Washington State Governor Jay Inslee issued Proclamation
20‐19, the recitals of which are incorporated herein; and
WHEREAS, Governor Inslee’s Proclamation 20‐19 imposed a moratorium on certain
residential evictions in order to protect public health and safety and prevent such evictions from
further endangering those who have been impacted by the COVID‐19 emergency, which has been
classified as a global pandemic by the World Health Organization; and
WHEREAS, on March 5, 2020, Mayor Armondo Pavone declared an emergency related to
the spread of COVID‐19 (the “Proclamation of Emergency”); and
WHEREAS, the Proclamation of Emergency authorizes the City to exercise emergency
powers to take actions without regard to time consuming procedures or formalities that would
otherwise be required by law to the extent so required under the exigencies of the situation; and
WHEREAS, with state and local orders in place restricting employment opportunities and
discouraging social contacts, evicting people without the means or opportunity to find alternative
housing would create an undue burden on the City’s ability to provide emergency services and
put the evicted residents at significant risk; and
WHEREAS, on March 20, 2020, Mayor Armondo Pavone issued Emergency Order #2020‐
3 Supporting State Moratorium on Residential Evictions for Non‐Payment of Rent;

Evictions
WHEREAS, on February 29, 2020, I issued Proclamation 20-05, proclaiming a State of Emergency for all
counties throughout Washington State as a result of the coronavirus disease 2019 (COVID-19) outbreak in
the United States and confirmed person-to-person spread of COVID-19 in Washington State; and
WHEREAS, as a result of the continued worldwide spread of COVID-19, its significant progression in
Washington State, and the high risk it poses to our most vulnerable populations, I have subsequently issued
amendatory Proclamations 20-06, 20-07, 20-08, 20-09, 20-10, 20-11, 20-12, 20-13, 20-14, 20-15, 20-16,
20-17, and 20-18, exercising my emergency powers under RCW 43.06.220 by prohibiting certain activities
and waiving and suspending specified laws and regulations; and
WHEREAS, the COVID-19 disease, caused by a virus that spreads easily from person to person which
may result in serious illness or death and has been classified by the World Health Organization as a
worldwide pandemic, continues to broadly spread throughout Washington State; and
WHEREAS, the COVID-19 pandemic is expected to cause a sustained global economic slowdown, which
is anticipated to cause an economic downturn throughout Washington State with layoffs and reduced work
hours for a significant percentage of our workforce due to substantial reductions in business activity
impacting our commercial sectors that support our state’s economic vitality, including severe impacts to
the large number of small businesses that make Washington State’s economy thrive; and
WHEREAS, many in our workforce expect to be impacted by these layoffs and substantially reduced work
hours are anticipated to suffer economic hardship that will disproportionately affect low and moderate
income workers resulting in lost wages and potentially the inability to pay for basic household expenses,
including rent; and
WHEREAS, the inability to pay rent by these members of our workforce increases the likelihood of
eviction from their homes, increasing the life, health, and safety risks to a significant percentage of our
people from the COVID-19 pandemic; and
WHEREAS, under RCW 59.12 (Unlawful Detainer) and RCW 59.18 (Residential Landlord Tenant Act)
tenants seeking to avoid default judgment in eviction hearings need to appear in court in order to avoid
losing substantial rights to assert defenses or access legal and economic assistance; and
WHEREAS, the Washington State Legislature has established a housing assistance program in Chapter
43.185 RCW pursuant to its findings in RCW 43.185.010 “that it is in the public interest to establish a
continuously renewable resource known as the housing trust fund and housing assistance program to assist
low and very low-income citizens in meeting their basic housing needs”; and
AGENDA ITEM # 7. b)
WHEREAS, a temporary moratorium on evictions throughout Washington State at this time will help
reduce economic hardship and related life, health, and safety risks to those members of our workforce
impacted by layoffs and substantially reduced work hours or who are otherwise unable to pay rent as a
result of the COVID-19 pandemic; and
WHEREAS, the worldwide COVID-19 pandemic and its progression in Washington State continue to
threaten the life and health of our people as well as the economy of Washington State, and remain a public
disaster affecting life, health, property or the public peace; and
WHEREAS, the Washington State Department of Health (DOH) continues to maintain a Public Health
Incident Management Team in coordination with the State Emergency Operations Center and other
supporting state agencies to manage the public health aspects of the incident; and
WHEREAS, the Washington State Military Department Emergency Management Division, through the
State Emergency Operations Center, continues coordinating resources across state government to support
the DOH and local health officials in alleviating the impacts to people, property, and infrastructure, and
continues coordinating with the DOH in assessing the impacts and long-term effects of the incident on
Washington State and its people.
NOW, THEREFORE, I, Jay Inslee, Governor of the state of Washington, as a result of the above-noted
situation, and under Chapters 38.08, 38.52 and 43.06 RCW, do hereby proclaim that a state of emergency
continues to exist in all counties of Washington State, that Proclamations 20-05 and all amendments thereto
remain in effect, and that Proclamation 20-05 is amended to temporarily prohibit residential evictions
statewide until April 17, 2020, as provide herein.
I again direct that the plans and procedures of the Washington State Comprehensive Emergency
Management Plan be implemented throughout State government. State agencies and departments are
directed to continue utilizing state resources and doing everything reasonably possible to support
implementation of the Washington State Comprehensive Emergency Management Plan and to assist
affected political subdivisions in an effort to respond to and recover from the COVID-19 pandemic.
I continue to order into active state service the organized militia of Washington State to include the
National Guard and the State Guard, or such part thereof as may be necessary in the opinion of The
Adjutant General to address the circumstances described above, to perform such duties as directed by
competent authority of the Washington State Military Department in addressing the outbreak. Additionally,
I continue to direct the DOH, the Washington State Military Department Emergency Management
Division, and other agencies to identify and provide appropriate personnel for conducting necessary and
ongoing incident related assessments.
ACCORDINGLY, based on the above noted situation and under the provisions of RCW 43.06.220(1)(h),
and to help preserve and maintain life, health, property or the public peace, effective immediately and until
April 17, 2020, I hereby prohibit the following activities related to residential evictions by all residential
landlords operating residential rental property in Washington State:
1. Residential landlords are prohibited from serving a notice of unlawful detainer for default
payment of rent related to such property under RCW 59.12.030(3).
2. Residential landlords are prohibited from issuing a 20-day notice for unlawful detainer related to
such property under RCW 59.12.030(2), unless the landlord attaches an affidavit attesting that the
action is believed necessary to ensure the health and safety of the tenant or other individuals.

3. Residential landlords are prohibited from initiating judicial action seeking a writ of restitution
involving a dwelling unit if the alleged basis for the writ is the failure of the tenant or tenants to
timely pay rent. This prohibition includes, but is not limited to, an action under Chapters 59.12 or
RCW 59.18 RCW.
4. Local law enforcement is prohibited from serving or otherwise acting on eviction orders that are
issued solely for default payment of rent related to such property. Nothing in this Proclamation is
intended to prohibit local law enforcement from acting on orders of eviction issued for other
reasons, including but not limited to waste, nuisance or commission of a crime on the premises.
Terminology used in these prohibitions shall have the meaning attributed in Chapter 59.18 RCW.
Violators of this order may be subject to criminal penalties pursuant to RCW 43.06.220(5).

Emergency Order #2020-3 Supporting State Moratorium
On Residential Evictions for Non-Payment of Rent
WHEREAS, on March 5, 2020, Mayor Armondo Pavone declared an emergency related to the
spread of COVID-19 (the Proclamation of Emergency);
WHEREAS, the Proclamation of Emergency authorizes the City to exercise emergency powers to
take actions without regard to time-consuming procedures or formalities that would otherwise be
required by law to the extent so required under the exigencies of the situation;
WHEREAS, on March 18, 2020, Washington State Governor Jay Inslee issued Proclamation 20-
19, the recitals of which are incorporated herein;
WHEREAS, Governor Inslee’s Proclamation 20-19 imposed a moratorium on certain residential
evictions in order to protect public health and safety and prevent such evictions from further
endangering those who have been impacte d by the COVID-19 emergency, which has been classified as a
global pandemic by the World Health Organization; and
WHEREAS, with state and local orders in place restricting employment opportunities and
discouraging social contacts, evicting people without the means or opportunity to find alternative
housing would create an undue burden on the City’s ability to provide emergency services and put the
evicted residents at significant risk.
NOW, THEREFORE, I, Armondo Pavone, Mayor of the City of Renton, ORDER under the emergency
powers granted to me under the Proclamation of Emergency that:
1. The above recitals are true and correct in all respects.
2. The City of Renton supports and reaffirms the state’s temporary emergency prohibition on
residential evictions by all residential landlords operating residential rental property in the
City of Renton.
3. Concurrent with the duration imposed in Governor Inslee’s Proclamation 20-19, City of
Renton police officers are prohibited from serving or otherwise acting on eviction orders
that are issued solely for default payment of rent related to such property. Nothing in this
Order is intended to prohibit City police from exercising independent authority granted by
state law to assist with evictions issues for other reasons, including but not limited to waste,
nuisance, or commission of a crime on the premises.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
ESTABLISHING THE LATECOMER ASSESSMENT FOR THE SUNSET LANE
NE IMPROVEMENT PROJECT, PROVIDING FOR SEVERABILITY, AND
ESTABLISHING AN EFFECTIVE DATE.
WHEREAS, the City of Renton (“City”) is divided into separate community
planning areas, including the Sunset sub‐area within the Renton Highlands (“Sunset
Area”); and
WHEREAS, the City established a Sunset Area community revitalization program
and adopted the Sunset Area Community Investment Strategy in order to prioritize
additional public investment in the Sunset Area and leverage public investment and
create opportunities for affordable housing, plus retail investment; and
WHEREAS, as a part of the Sunset Late NE Improvement Project (“Project”) the
City has installed certain utility systems and appurtenances thereto it elected to install
as a result of Ordinance No. 5783, adopted by the Renton City Council on February 1,
2016 (“Ordinance No. 5783"), at, near, or within the described property in the Sunset

Area and has connected same to the City’s utility system so that such improvements
now are an integral part thereof; and
WHEREAS, the owners of record of the Benefited Properties listed in Exhibit C
received a Notice of Potential Assessment, which was mailed on March 29, 2016, and
no appeal was filed within twenty (20) days of the date the notice was mailed; and
WHEREAS, the Renton City Council adopted Resolution No. 4289 on June 13,
2016 establishing the Sunset Area latecomer boundary area and latecomer assessment
methodology; and
WHEREAS, as a part of the Project, the City has installed certain street
improvements and appurtenances thereto it elected to install as a result of Ordinance
No. 5783, which required the improvements as a prerequisite to further development
and redevelopment in the Sunset Area, at, near, or within the described property; and
WHEREAS, no other property owners or users have shared in the cost and
expense of construction of such improvements, and pursuant to the provisions and
terms of Chapter 35.91 RCW (the Municipal Water and Sewer Facilities Act), specifically
RCW 35.91.020 (Contracts with owners of real estate for water or sewer facilities—
Requirements—Financing—Reimbursement of costs), and Chapter 35.72 RCW
(Contracts for Street, Road, and Highway Projects) and Renton Municipal Code (“RMC”)

chapter 9‐5 (Utility and Street Latecomer’s Agreements), the City wishes to recapture a
portion of its investments in the installation of the improvements; and
WHEREAS, the City has paid all the costs and expenses for the installation of said
improvements; and
WHEREAS, the Renton City Council held first reading of this ordinance on
_________________ and directed staff to send Notice of Final Assessment to the
owners of record of the Benefited Properties listed in Exhibit C; and
WHEREAS, the owners of record of the Benefited Properties listed in Exhibit C
received a Notice of Final Assessment, which was mailed on _______________, and no
appeal was filed within twenty (20) days of the date the notice was mailed;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON,
DO ORDAIN AS FOLLOWS:
SECTION I. The Renton City Council hereby establishes the assessments
described herein, to recapture a portion of the City’s investments in the installation of
the Project improvements (“Latecomer Assessment”).
SECTION II. At the time of preliminary approval by the Renton City Council,
the City has not assigned any rights to collect the Latecomer Assessment described
herein to any other party.

SECTION III. The City has installed the following described improvements, to
wit:
A. Water: Approximately 2,324 feet of 12‐inch water main, and nine (9)
fire hydrants and related appurtenances, in Sunset Lane NE, NE 10th Street, Glennwood
Avenue NE, and in Harrington Avenue NE;
B. Sewer: approximately 1,713 feet of 12‐inch sewer main, and all
appurtenances, in Sunset Lane NE and NE 10th Street; and
C. Transportation (Street Improvements): Approximately 2,000 linear
feet of two‐lane roadway, 2,200 linear feet of sidewalk, 3,400 linear feet of curb/gutter,
together with a drainage system, street lights and relocating/undergrounding
power/natural gas/cable TV/telephone services in Sunset Lane NE, NE 10th Street and
Harrington Avenue NE;
and such installation made according to plans and specifications approved by the City of
Renton Community and Economic Development and Public Works Departments, made
in full compliance with the City’s obligations under this ordinance, and all applicable
codes and regulations of the City of Renton.
Said improvements are fit for the use for which they are intended.

SECTION IV. All expenses and claims in connection with the construction and
installation of the improvements, whether for labor or materials or both, have been paid
in full, all at the City’s expense.
SECTION V. The legal descriptions of the Benefited Properties which comprise
the latecomer boundary area (“Benefited Property”) are attached hereto as Exhibit A.
The maps showing the latecomer boundary for the water, sewer, and transportation
portions, respectively, are attached hereto as Exhibits B1, B2, and B3. The Combined
Final Assessment Roll detailing the Benefited Properties’ legal descriptions and the
amount of the assessment for each property is attached hereto as Exhibit C.
SECTION VI. Costs of Construction:
A. The total cost of the water portion of said utility systems construction as
herein above specified is $464,551.95; and
B. The total cost of the sewer portion of said utility systems construction as
herein above specified is $429,868.77; and
C. The total cost of the transportation/street improvements construction as
herein above specified is $5,293,871.25.
SECTION VII. Water Portion of Utility Systems Construction:
A. Cost and Pro Rata Reimbursement: The total amount of the cost of the water
portion of said utility systems construction shall be employed to determine the pro rata

reimbursement to the City by any owner of real estate who did not contribute to the
original cost of such improvement, and triggers the assessment as specified in
subsection VII.B, below, all subject to the laws and ordinances of the City of Renton and
the provisions of this ordinance:

B. Criteria for Triggering of Water portion of Latecomer Assessment: The
Latecomer Assessment established by this ordinance related to the water portion of the
utility systems construction will be triggered when a Benefited Property within the
latecomer boundary area that is receiving water service from the existing water mains
is developed and/or redeveloped, such that the development and/or redevelopment of
the property requires fire flow demand which exceeds 1,500 gallons per minute (which

was the water system capacity before the water main improvements). The Benefited
Properties may be sold or change hands without activating the assessment.
C. Payment is due:
1. Prior to the issuance of a building permit; or
2. Pursuant to a restrictive covenant or agreement with the City of Renton;
however, in all cases prior to the issuance of a certificate of occupancy (either temporary
or final).
SECTION VIII. Sewer Portion of Utility Systems Construction:
A. Cost and Pro Rata Reimbursement: The total amount of the cost of the sewer
portion of said utility systems construction shall be employed to determine the pro rata
reimbursement to the City by any owner of real estate who did not contribute to the
original cost of such improvement, and triggers the assessment as specified in
subsection VIII.B, below, all subject to the laws and ordinances of the City of Renton and
the provisions of this ordinance.

systems construction will be triggered when a property within the latecomer boundary
area that is not connected to a City sewer facility connects to the sewer system
associated with the latecomer boundary area, or that as part of development and/or
redevelopment would be required to install sewer facilities across its frontage, as
required RMC 4‐6‐010. The Benefited Properties may be sold or change hands without
activating the assessment.
C. Payment is due:
1. Prior to the issuance of a building permit; or
2. Pursuant to a restrictive covenant or agreement with the City of Renton;
however, in all cases prior to the issuance of a certificate of occupancy (either temporary
or final).

B. Criteria for Triggering of Street portion of Latecomer Assessment: The
assessment established by this ordinance related to the street improvement
construction will be triggered when a property within the latecomer boundary area is
developed and/or redeveloped, such that the development and/or redevelopment of
the property generates new weekday trips. The Benefited Properties may be sold or
change hands without activating the assessment.
C. Payment is due:
1. Prior to the issuance of a building permit; or
2. Pursuant to a restrictive covenant or agreement with the City of Renton;
however, in all cases prior to the issuance of a certificate of occupancy (either temporary
or final).
SECTION X. It is hereby found and determined that the construction and
installation of said utility systems and street improvements are in the public interest.
SECTION XI. The City reserves the right, without affecting the validity or terms
of this ordinance, to make or cause to be made extensions to or additions of the above
improvements and to allow service connections to be made to said extensions or
additions, without liability on the part of the City.
SECTION XII. The Latecomer Assessment established by this ordinance, as it
pertains to the water and sewer utility construction latecomer assessments, and the

assessments described herein, shall be valid for a period of twenty (20) years, unless the
City Council agrees to extend it or the assessments in accordance with RCW 35.91.020(4)
as it exists or is hereinafter amended.
SECTION XIII. The Latecomer Assessment established by this ordinance, as it
pertains to the street improvement construction latecomer assessments, and the
assessments described herein, will remain valid for a period of fifteen (15) years, unless
the City Council agrees to extend it or the assessments in accordance with RCW
35.72.020 (2) as it exists or is hereinafter amended.
SECTION XIV. The decision of the Administrator of the Public Works
Department or his/her authorized representative in determining or computing the
amount due from any benefited owner who triggers any latecomer assessment
hereunder shall be final and conclusive in all respects.
SECTION XV. This ordinance shall be placed for record with the King County
Recorder’s Office within thirty (30) days of passage, approval, and publication of this
ordinance, at the City’s sole cost.
SECTION XVI. The City may collect an administration and collection fee from its
utility enterprise funds at the time any Latecomer Assessment related to the water or
sewer portions of construction is collected. The amount of the fee may be a percentage
based upon the following:

A. If the portion of total cost that may be reimbursed is $20,000 or less, the City
will retain a fee equal to fifteen percent (15%) of each amount collected.
B. If the portion of total cost that may be reimbursed is more than $20,000 but
not more than $100,000, the City will retain a fee equal to ten percent (10%) of each
amount collected.
C. If the portion of total cost that may be reimbursed is more than $100,000,
the City will retain a fee equal to five percent (5%) of each amount collected.
SECTION XVII. This ordinance, when recorded with King County, will be a
matter of public record and will serve as a notice to the owners of the Benefited
Properties should any latecomer assessment be triggered. The assessment roll listing
the Benefited Properties and the pro rata potential latecomer assessment for each will
be on file with the City or Renton.
SECTION XVIII. If any section, subsection, sentence, clause, phrase or work of
this ordinance should be held to be invalid or unconstitutional by a court or competent
jurisdiction, such invalidity or unconstitutionality thereof shall not affect the
constitutionality of any other section, subsection, sentence, clause, phrase or word of
this ordinance.
SECTION XIX. This ordinance shall be in full force and effect five (5) days after
publication of a summary of this ordinance in the City’s official newspaper and recording

in the records of King County, Washington. The summary shall consist of this
ordinance’s title.
