JAYINSLEEGovernorSTATEOFWASHINGTONOFFICEOFTHEGOVERNORP.O.Box40002•Olympia,Washington98504-0002’(360)902-4777•wwwgovernor.wa.govPROCLAMATIONBYTHEGOVERNORAMENDINGPROCLAMATION20-0520-19EvictionsWHEREAS,onFebruary29,2020,1issuedProclamation20-05,proclaimingaStateofEmergencyforallcountiesthroughoutWashingtonStateasaresultofthecoronavirusdisease2019(COVID-19)outbreakintheUnitedStatesandconfirmedperson-to-personspreadofCOVID-19inWashingtonState;andWHEREAS,asaresultofthecontinuedworldwidespreadofCOVID-19,itssignificantprogressioninWashingtonState,andthehighriskitposestoourmostvulnerablepopulations,IhavesubsequentlyisstiedamendatoryProclamations20-06,20-07,20-08,20-09,20-10,20-11,20-12,20-13,20-14,20-15,20-16,20-17,and20-18,exercisingmyemergencypowersunderRCW43.06.220byprohibitingcertainactivitiesandwaivingandsuspendingspecifiedlawsandregulations;andWHEREAS,theCOVID-19disease,causedbyavirusthatspreadseasilyfrompersontopersonwhichmayresultinseriousillnessordeathandhasbeenclassifiedbytheWorldHealthOrganizationasaworldwidepandemic,continuestobroadlyspreadthroughoutWashingtonState:andWHEREAS,theCOVID-19pandemicisexpectedtocauseasustainedglobaleconomicslowdown,whichisanticipatedtocauseaneconomicdownturnthroughoutWashingtonStatewithlayoffsandreducedworkhoursforasignificantpercentageofourworkforceduetosubstantialreductionsinbusinessactivityimpactingourcommercialsectorsthatsupportourstate’seconomicvitality,includingsevereimpactstothelargenumberofsmallbusinessesthatmakeWashingtonState’seconomythrive;andWHEREAS,manyinourworkforceexpecttobeimpactedbytheselayoffsandsubstantiallyreducedworkhoursareanticipatedtosuffereconomichardshipthatwilldisproportionatelyaffectlowandmoderateincomeworkersresultinginlostwagesandpotentiallytheinabilitytopayforbasichouseholdexpenses,includingrent;andWHEREAS,theinabilitytopayrentbythesemembersofourworkforceincreasesthelikelihoodofevictionfromtheirhomes,increasingthelife,health,andsafetyriskstoasignificantpercentageofourpeoplefromtheCOVID-19pandemic;andWHEREAS,underRCW59.12(UnlawfulDetainer)andRCW59.1$(ResidentialLandlordTenantAct)tenantsseekingtoavoiddefaultjudgmentinevictionhearingsneedtoappearincourtinordertoavoidlosingsubstantialrightstoassertdefensesoraccesslegalandeconomicassistance;andWHEREAS,theWashingtonStateLegislaturehasestablishedahousingassistanceprograminChapter43.185RCWpursuanttoitsfindingsinRCW43.185.010“thatitisinthepublicinteresttoestablishacontinuouslyrenewableresourceknownasthehousingtrustfundandhousingassistanceprogramtoassistlowandverylow-incomecitizensinmeetingtheirbasichousingneeds”;and WHEREAS,atemporarymoratoriumonevictionsthroughoutWashingtonStateatthistimewilthelpreduceeconomichardshipandrelatedlife,health,andsafetyriskstothosemembersofourworkforceimpactedbylayoffsandsubstantiallyreducedworkhoursorwhoareotherwiseunabletopayrentasaresultoftheCOVID-19pandemic;andWHEREAS,theworldwideCOVID-19pandemicanditsprogressioninWashingtonStatecontinuetothreatenthelifeandhealthofourpeopleaswellastheeconomyofWashingtonState.andremainapublicdisasteraffectinglife,health,propertyorthepublicpeace;andWHEREAS,theWashingtonStateDepartmentofHealth(DOH)continuestomaintainaPtiblicHealthIncidentManagementTeamincoordinationwiththeStateEmergencyOperationsCenterandothersupportingstateagenciestomanagethepublichealthaspectsoftheincident;andWHEREAS,theWashingtonStateMilitaryDepartmentEmergencyManagementDivision,throughtheStateEmergencyOperationsCenter,continuescoordinatingresotircesacrossstategovernmenttosupporttheDOHandlocalhealthofficialsinalleviatingtheimpactstopeople,property,andinfrastructure,andcontinuescoordinatingwiththeDOHinassessingtheimpactsandlong-termeffectsoftheincidentonWashingtonStateanditspeople.NOW,THEREFORE,t,Jaytnslee,GovernorofthestateofWashington,asaresuttoftheabove-notedsituation,andunderChapters38.08,38.52and43.06RCW,doherebyproclaimthatastateofemergencycontinuestoexistinallcountiesofWashingtonState,thatProclamations20-05andallamendmentstheretoremainineffect,andthatProclamation20-05isamendedtotemporarilyprohibitresidentialevictionsstatewideuntilApril17,2020,asprovideherein.IagaindirectthattheplansandprocedtiresoftheWashingtonStateComprehensiveEmergencyManagementPlanbeimplementedthroughoutStategovernment.StateagenciesanddepartmentsaredirectedtocontinueutilizingstateresourcesanddoingeverythingreasonablypossibletosupportimplementationoftheWashingtonStateComprehensiveEmergencyManagementPlanandtoassistaffectedpoliticalsubdivisionsinanefforttorespondtoandrecoverfromtheCOVID-19pandemic.IcontinuetoorderintoactivestateservicetheorganizedmilitiaofWashingtonStatetoincludetheNationalGuardandtheStateGuard,orsuchpartthereofasmaybenecessaryintheopinionofTheAdjutantGeneraltoaddressthecircumstancesdescribedabove,toperformsuchdutiesasdirectedbycompetentauthorityoftheWashingtonStateMilitaryDepartmentinaddressingtheoutbreak.Additionally,IcontinuetodirecttheDOH,theWashingtonStateMilitaryDepartmentEmergencyManagementDivision,andotheragenciestoidentifvandprovideappropriatepersonnelforconductingnecessaryandongoingincidentrelatedassessments.ACCORDINGLY,basedontheabovenotedsituationandundertheprovisionsofRCW43.06.220(1)(h),andtohelppreserveandmaintainlife,health,propertyorthepublicpeace,effectiveimmediatelyanduntilApril17,2020,IherebyprohibitthefollowingactivitiesrelatedtoresidentialevictionsbyallresidentiallandlordsoperatingresidentialrentalpropertyinWashingtonState:I.ResidentiallandlordsareprohibitedfromservinganoticeofunlawfuldetainerfordefaciltpaymentofrentrelatedtoscichpropertyunderRCW59.12.030(3).2.Residentiallandlordsareprohibitedfromissuinga20-daynoticeforunlawfuldetainerrelatedtosuchproperty’underRCW59.12.030(2),unlessthelandlordattachesanaffidavitattestingthattheactionisbelievednecessarytoensurethehealthandsafetyofthetenantorotherindividuals. 3.Residentiallandlordsareprohibitedfrominitiatingjudicialactionseekingawritofrestitutioninvolvingadwellingunitiftheallegedbasisforthewritisthefailureofthetenantortenantstotimelypayrent.Thisprohibitionincludes,butisnotlimitedto,anactionunderChapters59.12orRCW59.18RCW.4.Locallawenforcementisprohibitedfromservingorotherwiseactingonevictionordersthatareissuedsolelyfordefaultpaymentofrentrelatedtosuchproperty.NothinginthisProclamationisintendedtoprohibitlocallawenforcementfromactingonordersofevictionissuedforotherreasons,includingbutnotlimitedtowaste,nuisanceorcommissionofacrimeonthepremises.TerminologyusedintheseprohibitionsshallhavethemeaningattributedinChapter59.18RCW.ViolatorsofthisordermaybesubjecttocriminalpenaltiespursuanttoRCW43.06.220(5).SignedandsealedwiththeofficialsealofthestateofWashingtononthis18thdayofMarch,A.D.,TwoThousandandTwentyatOlympia,Washington.By:Is!JayInstee,GovernorBYTHEGOVERNOR:SecretaryofState
