CONDITIONS
1. THE NATIVE GROWTH PROTECTION EASEMENT (NGPE) ON THIS SHORT
PLAT IDENTIFIES THE WETLAND AND BUFFER. THE CREATION OF THE
NATIVE GROWTH PROTECTION EASEMENT (NGPE) CONVEYS TO THE
PUBLIC A BENEFICIAL INTEREST IN THE LAND WITHIN THE EASEMENT
AREA. THE INTEREST SHALL BE FOR THE PURPOSE OF PRESERVING
NATIVE VEGETATION FOR THE CONTROL OF SURFACE WATER AND
EROSION, MAINTENANCE OF SLOPE STABILITY, VISUAL AND AURAL
BUFFERING, AND PROTECTION OF PLANT AND ANIMAL HABITAT. THE
NATIVE GROWTH PROTECTION EASEMENT IMPOSES UPON ALL PRESENT
AND FUTURE OWNERS AND OCCUPIERS OF THE EASEMENT AREA
ENFORCEABLE ON BEHALF OF THE PUBLIC BY THE CITY OF P.ENTON, TO
LEAVE UNDISTURBED ALL TREES AND OTHER VEGETATION WITHIN THE
EASEMENT AREA. THE VEGETATION WITHIN THE NGPE MAY NOT BE CUT,
PRUNED, COVERED BY FILL REMOVED OR DAMAGED WITHOUT EXPRESS
WRITTEN PERMISSION FROM THE CITY OF RENTON. THE RIGHT OF ENTRY
GRANTED HEREIN SHALL APPLY TO THE AGENTS, REPRESENTATIVE AND
EMPLOYEES OF THE OWNERS OR SUBSEQUENT OWNERS OF THE
UNDERLYING PROPERTY.
2. PLANT MAINTENANCE AGREEMENT: PROPERTY OWNERS AT THE LOTS
ADJACENT TO THE PLANTING STRIPS WILL WATER THESE DROUGHT
RESISTANT PLANTS TWICE A YEAR AND MAINTAIN THE AREA FOR A
PERIOD OF TWO YEARS FROM DATE OF PLANTING APPROXIMATELY
DECEMBER 12, 2007 THROUGH DECEMBER 13, 2009.
3. NO VEGETATION REMOVAL SHALL BE ALLOWED IN THE WETLAND OR
BUFFER WITH THE EXCEPTION OF DANGEROUS OR DISEASED TREES. ,"ALL
DANGEROUS AND/OR DISEASED TREES PROPOSED TO BE REMOVED
FROM THE SITE SHALL REQUIRE A LETTER FROM A QUALIFIED ARBORIST
AND WOULD BE SUBJECT TO INSPECTION AND MAY REQUIRE
REPLACEMENT AT A HIGHER RATIO.
