By letter dated February 8, 2017, the Applicant requested reconsideration on the basis that "We request a 5-year maximum approval period, rather than the standard 2 years, renewable for 2 more years." RMC 4-9-030 (F)(9) provides that building permits and other land use permits that implement a conditional use permit must be filed within two years of conditional use permit approval, subject to a two-year extension granted for good cause by the Administrator. The hearing examiner has no authority to modify this code requirement absent a request for a variance request filed pursuant to RMC 4-9-250. The request for reconsideration is denied. The date of issuance of the Final Decision for the above-captioned matter shall be considered the date of issuance of this Order for purposes of appeal. City of Renton Hearing Examiner Appeal Right and Valuation Notices RMC 4-8-080(0) classifies the application(s) subject to this decision as Type III applications subject to closed record appeal to the City of Renton City Council. Appeals of the hearing examiner's decision must be filed within fourteen (14) calendar days from the date of the decision.
