Rohini Nair, Civil Engineer III Project Summary: The applicant is requesting a variance from RMC 8-7-2 (Noise Regulations, Maximum Environmental Noise Levels) in order to conduct construction work at night in areas with residential uses. Geotechnical exploration is needed to aid WSDOT's contractor to locate monitoring wells for the 1405 project. Two boring locations are proposed and all lie within the unpaved shoulder of the states' highway. Both borings will require night time work. The work is proposed to be completed in two nights between August 24, 2016 and October 1, 2016. The night time work shall be achieved between 9:00 PM and 5:00 AM. The equipment to be used will include a drill rig truck, impact attenuation trucks, and a support truck. The drilling operation generates approximately 84 dBA noise. The freeway has existing ambient noise levels in the range of 70 to 80 dBA, which may aid in masking the construction noise. APPLICABLE SECTIONS OF THE RENTON MUNICIPAL CODE. N 1. Chapter 7 Noise Level Regulations a. Section 8-7-8: Variances and Appeals 11 D. FINDINGS OF FACT (FOF): 11 1. The Planning Division of the City of Renton accepted the above master application for review on August 17, 2016 and determined the application complete on August 18, 2016. The Administrator of Community and Economic Development Department will waive the public comment period of 14 days for this specific variance request since there are no existing homes within 300 feet of the noise generation source. 2. The project site is located in the shoulder of 1-405 in the vicinity of Talbot Road South. 3. The project site is located in the unpaved shoulder of the freeway, within the WSDOT right of way. 4. Access to the site would be provided via road access and will require a lane closure. 5. The applicant is proposing to do the borings in two nights between August 24, 2016 and October 1, 2016. 6. Noise variance requirements are as per RMC 8-7-8. Since there are no existing residences within 300 feet of the noise generation source, the applicant has not provided notification to residences. Variance Analysis: The decision maker, in passing upon an application for a variance, shall consider all technical evaluations, all relevant factors and standards specified in other sections of this Chapter, and in addition thereto shall consider the following, none of which is mandatory for the granting of the variance: Compliance I Variance Criteria and Analysis a. That the applicant suffers practical difficulties and unnecessary hardship and the variance is necessary because of special circumstances applicable to the applicant's property or project, and that the strict application of this Chapter will deprive the subject property ,i owner or applicant of rights and privileges enjoyed by others. Staff Comment: Conducting the work at night will limit disruption to the transport of people goods and services. Permitted noise levels would be exceeded during construction, in the area where the work is occurring. b. That the granting of the variance will not be materially detrimental to the public health, ✓ welfare or safety, or unduly injurious to the property or improvements in the vicinity of the location for which this variance is sought. However, the noise would occur only on two nights, and there are no existing residences within 300 feet of the noise generation source. The existing ambient noise on the freeway will also aid in masking the construction noise. Therefore, staff believes that the noise impacts would be of a limited duration and intensity, and would not be materially detrimental to the public health, welfare, or safety. Property and/or improvements in the area would not be unduly damaged as the work would be limited to the shoulder area of the freeway, and the noise generated would not damage property or improvements. c. That the approval is a minimum variance that will accomplish the desired purpose. Staff Comment: Staff believes that the request is the minimum needed to accomplish the necessary geotechnical borings in the Talbot area of the 1-405/SR 167 Interchange Direct Connector project, as the night time work will be of a limited duration of only two nights. d. That the variance contains such conditions deemed to be necessary to limit the impact of the variance on the residence or property owners impacted by the variance. The variance approval may be subject to conditions including, but not limited to, the following: a. Implementation of a noise monitoring program; b. Maximum noise levels; c. Limitation on types of equipment and use of particular equipment; d. Limitation on back-up beepers for equipment; e. Required use of noise shields or barriers; f. Restrictions to specific times and days; g. Specific requirements for documentation of compliance with the noise variance 11, conditions; h. Specific requirements for notification to nearby residents; i. Required cash security to pay for inspection services to verify compliance; j. Required access to the project by the City to verify compliance with the noise variance conditions; k. Specific program to allow for temporary hotel vouchers to effected residents; I. Requirements for written verification that all workers understand the noise variance conditions for the project; and m. Provision allowing the City to immediately revoke the variance approval if the variance conditions are violated. Since there are no residences located within 300 feet of the noise generation location, the proposed night time work is not expected to have an impact on the surrounding properties. The applicant has provided a project hotline telephone number (425-456-8585) for reporting any problems. Staff recommends this as a condition of approval. Furthermore, WSDOT shall provide a summary of any complaints within the City of Renton to the City's project manager, Rohini Nair, rnair(@rentonwa.gov within 5 days of the complaint. e. The importance of the services provided by the facility creating the noise and the other impacts caused to the public safety, health and welfare balanced against the harm to be suffered by residents or property owners receiving the increased noise permitted under this variance. Staff Comment: Staff believes that the request is the minimum needed to accomplish the necessary geotechnical borings for the Talbot Hill area of the 1-4051SR167 Interchange Direct Connector project, as the night time work is for a limited duration of only two days. The ambient noise of the freeway traffic will also aid to mask the noise from the proposed night time work. There are no existing residences within 300 feet of the proposed noise generation work located in WSDOT right of way. f. The availability of practicable alternative locations or methods for the proposed use which will generate the noise. ,i Staff Comment: Staff believes that the request is the minimum needed to accomplish the necessary geotechnical borings for the Talbot Hill area of the I-4051SR167 Interchange Direct Connector Project. The borings should be accomplished in the specific area identified in the shoulder area of 1-405 located within the WSDOT right of way. g. The extent by which the prescribed noise limitations will be exceeded by the variance and the extent and duration of the variance. Staff Comment: Staff believes that the request for the two nights work is the minimum needed to accomplish the necessary geotechnical borings for the Talbot Hill area of the 1-405/SR 167 Interchange Direct Connector project. The noise generated within WSDOT right of way is expected to be up to 84 dBA. The maximum allowed night time Environment Designated Noise Abatement (EDNA) in a commercial receiving property is 47 dBA. The freeway has an existing ambient noise levels in the range of 70 to 80 dBA, which will aid in masking the construction noise. E. CONCLUSIONS 1. The subject sites are located on the north and south shoulder area of 1-405, adjacent to Talbot Road South. 2. The requested variance meets the seven criteria to be considered in making a decision on a variance request as specified in RMC 8-7-8 if all conditions of approval are met. The analysis of the proposal according to variance criteria is found in the body of the Staff Report. F. DECISION: The 1-405/ SR 167 Interchange Direct Connector — Talbot Borings Project Noise Variance, File No. LUA16- 000625, as depicted in Exhibit 1, is approved and is subject to the following conditions: 1. The work will allow WSDOT crews to perform soil investigation along the SR 167 and I-405 corridor. In order to perform soil investigation along the SR 167 and I-405 corridor, WSDOT anticipates drilling in two locations that may impact noise levels at nearby residences. That boring location is shown on the attached map. WSDOT anticipates performing this work the night of Wednesday August 24`h and Thursday August 25th. Work is anticipated to be complete by 5 a.m. on Friday, August 26th. Please authorize two nights of work to be completed between August 24 h and October Is'2016. Work will occur inside the I-405 right of way. Construction equipment used during this time will include, but is not limited to, generators, light plants, drilling rigs and trucks. Nearby residents can expect similar noise levels to the existing I-405 and SR 167 background traffic noise with some higher than normal peak noise levels while the drilling equipment is in use. All work will be within WSDOT roadway right of way on unpaved highway shoulder. Why work at night? Crews will work at night to finish the boring quickly and minimize daytime impacts to this key commute and freight route. Nighttime work is necessary to avoid daytime lane closures that could cause substantial traffic congestion. It will be necessary to temporarily close the right curb lane of northbound SR 515 from the I-405 northbound onramp to the southbound I-405 exit and the far left lane of the southbound I-405 exit at SR 515.
