PROJECT DESCRIPTION: The Renton School District is requesting a Letter of
Exemption pursuant to Renton Municipal Code (RMC) 4-3-050C.2 to remove single-family
residential homes and associated structures on Lots 2-14 as shown on the submitted ALTA
Survey (Exhibit 1). Removal of the structures is in preparation for the district’s future
elementary school that will be located on the subject properties. As shown in the Wetland
Delineation Report dated September 30, 2019 prepared by The Watershed Company
(Exhibit 2), two wetlands are located on the subject properties. Wetland B is a Category IV
wetland with a 50-foot buffer on the eastern portion of the subject properties and
Wetland C is a Category III wetland with a 100-foot buffer located on the western portion
of the subject properties. Removal of the structures will require temporary encroachments
into the buffers of both wetlands as shown in the Demolition and Si te Preparation Plans
(Exhibit 3), however no encroachments into the wetlands are proposed or shown on the
plans. Wetlands B and C would be surrounded by high viability silt fencing along with
signage indicating a “No Entry to Wetland Exclusion Zone.” Following demolition of the
structures, the previous building footprints would be hydroseeded for soil stabilization.
Vegetation to be removed is limited to groundcovers and Himilayan Blackberry. No trees
are proposed to be removed with the propopsed scope of work. Trees near structures to
be demolished would have tree protection fencing as shown per the aforementioned
plans. The Renton School District prepared an Environmental Checklist and issued a
Determination of Nonsignificance on February 26, 2020 (Exhibit 4) for the proposed
demolition. The comment deadline ended March 12, 2020 and no appeals were filed with
the district.

CRITICAL AREA: Wetland Buffer
EXEMPTION JUSTIFICATION: RMC 4-3-050 Critical Areas Regulations Subsection C.g.i
Remodeling, Replacing, Removing Existing Structures (Emphasis added), Facilities, and
Improvements.
FINDINGS: The proposed development is consistent with the following findings pursuant to
RMC section 4-3-050C.2.d:
i. The activity is not prohibited by this or any other provision of the Renton Municipal
Code or State or Federal law or regulation;
ii. The activity will be conducted using best management practices as specified by
industry standards or applicable Federal agencies or scientific principles;
iii. Impacts are minimized and, where applicable, disturbed areas are immediately
restored;
iv. Where water body or buffer disturbance has occurred in accordance with an
exemption during construction or other activities, revegetation with native vegetation
shall be required;
v. If a hazardous material, activity, and/or facility that is exempt pursuant to this
Section has a significant or substantial potential to degrade groundwater quality, then
the Administrator may require compliance with the Wellhead Protection Area
requirements of this Section otherwise relevant to that hazardous material, activity,
and/or facility. Such determinations will be based upon site and/or chemical-specific
data.
DECISION: An exemption from the critical areas regulations is Approved.

The administrative land use decision will become final if the decision is not appealed within 14
days of the decision date.
APPEALS: This administrative land use decision will become final if not appealed in writing to
the Hearing Examiner on or before 5:00 PM on May 5, 2020. An appeal of the decision must be
filed within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Due to Governor
Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely.

For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov.
The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals
to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal
process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
RECONSIDERATION: Within 14 days of the decision date, any part y may request that the
decision be reopened by the approval body. The approval body may modify his decision if
material evidence not readily discoverable prior to the original decision is found or if he finds
there was misrepresentation of fact. After review of the reconsideration request, if the
approval body finds sufficient evidence to amend the original decision, there will be no further
extension of the appeal period. Any person wishing to take further action must file a formal
appeal within the 14-day appeal time frame.
EXPIRATION: Five (5) years from the date of decision (date signed).

Dear Calvin:
In September and October 2018, and July and September 2019, ecologists from The
Watershed Company visited the Chelan Avenue NE study area in Renton, Washington,
to delineate jurisdictional wetlands within a defined study area. This study is in support
of the planning of new educational facilities for the Renton School District. This letter
summarizes the findings of the study and details applicable federal, state, and local
regulations. The following documents are enclosed:
• Wetland Delineation Sketches (September 2018, July 2019, September 2019)
• Wetland Determination Data Forms
• Ecology Rating Forms and Figures
Study Area
In September and October 2018, King County parcels 102305-9173, -9249, -9138, -9124, -
9076, -9202, -9332, -9133, and -9139 were screened and delineated. Parcels -9096 and -
9275 were screened and delineated on July 16, 2019. Parcel -9107 was screened and
delineated on September 27, 2019.
