That said Grantor(s} (hereinafter, "Grantor°), far and in consideratian of mutual benefits, do by these
presents, gr�nt, bargain, sell, convey, and warrants unto the said 6rantee, its successars and
assigns, an easement for public starm drainage _with
neeessary appurtenanc�s ouer, under, through, acrass and upan the pr�operty in King County,
Washin�ton,described on page 1.
For the purpose af constructing, recanstrueting, inst�lling, repairing, replacing, enl�rgin�, operating and
maintaining storm draina e utilities and utilitY pipeEines ,
together with the right of ingress and egress theretc,without pricrr institutian of any suit ar praceedings af law
and withaut incurring any legal obligatian or liability therefar. Following the initial construction of its
facilities, Grantee may fram time ta tirne eonstruct such addition�l facilities as it may require or
desire. This easement is granted subj�ct ta the fallawing terms and conditians:
1. The Grantee shall, upan cornpletian of any work within the property ccavered by the easement,
restcrre the surFace of the easement,and any private improvements disturbed or d�stroyed during
execution af the wark, as neariy as practicable ta the condition they were in irnmediafiely before
eommencement of the work or entry by the Grantee.
2. Grantor shall retain the right ta use the surface of the easement as lang as such use does not
interfere with the easement rights granted to the 6rantee. Grantor shall not, however, have the right to:
a. Erect or maintain any buildings or structures within the easement;ar
b. Plant trees, shrubs ar vegetation naving deep root patterns which may cause damage to ar
interfere with the utilities to be placed within the easement by the Grantee;or
c. Develap, landscape, r�r beautEfy the easement area in any way which would unreasanably
increase ihe costs to the Grantee of restoring the easement area and any private
impravements therein;ar
d. Dig, tunnel ar perform other fonms of constructian activities an the property which would disturb
the compaction or unearth Grantee's f�cilities on the right-r�f-way, or endanger the lateral
support facilities;or
e. Blast within fifteen (SS)feet af the easement;or
f. Erect fences in such a way as to prevent access by the Grantee's uehicles to the Grantee's
facilities. Any fence construction must provid� far an opening (gated, remavak�le sections, k�arriers,
etc.)af at least ter� (10)feet in width;or
g. Erect any objects withirr fifteen (15)abave the ground surface within the easement.
This easement shali run with the larrd described herein, and shall be binding upan the parties, their heirs,
successors in interest and assigns. Grantor covenants that it is the lawful awner of the abave
property(ies)and that it has a gaod ar�d lavvful ri�ht t+�execute this agreement.
Grantor shafl protect, sav�and hald harmiess, and defend, with counsel af its sale reasanable choice,Grantee,
its tenant(s}, and thefr successors,assigns,customers and invite�sA fram all claims, actior7s,filed ar threatened,
casts, damages,nr expenses of any nature whatsoever arisirog out of or in connectian with any actx ar amissions
nf Grantar in cannection with this easement. The abligatinn ta protect, save and holci harmless, and defend
shall not include such claims,actions,casts, damages,or expenses which m�y be caused by the sale negiigence
of Grantee or its tenant(s),or their successars or assigns; Provided that if the claims actions, costs, damages,or
�xpenses are caused by or result frorn concurrent negiigence of(a) Grantee or its tenant(s), or their successors
or assigns end (b} Grantar, its agents, contrattors or assi�ns, and invnlves Chose actions cavered by RCW
4.24.11S,this indemnity provision shrall be vatlid and�nforceabfe only tn the extent af the negligence of Grantor,
its agents, contractors or assigns. Granfior shall prc�mptly notify Grantee and its tenant(s) of any loss, damage,
injury ar death arising out af or in cannection with any acts or amissians af Grantor in connection with this
easement.
By this cranveyance,Grantor will warrant and defend the conveyance hereby made unto the Grantee against all
and every persan or persons,whomsaever, lawfuily,ciaiming or ta clairn the same.This canveyance shall bind
the heirs,executors,administratars and assigns farever.
