presents, grant, bargain, seli, convey, and warrants unto the said Grantee, its successors and
assigns, an easement far puk�licwater ��t�
necessary appurtenanc�s over, under, through, across and upon the property in King County,
Washington,described on page 1.
�c�r the purpose of constructing, r�cor�structing, installing, repairing, replacing, enlarging„ operating and
rrraintainin water mains fire h drants water meters all necessa connections and related appurkenances
together with the right af ingress and egress thereto withaut prior institutian of any suit ar prac�edin�s of law
and without incurring any legal obligatiarr or liabilixy therefar�. Folicawing the initial constructlon of its
facilities, Grantee may fram time ta time construct such additianal facititi�s as it may require ar
desire. 7his easement is gran�ed subject tcr the fallawing terms and conditions:
1. '1"he Grantee shall, upon completion of any work within the property covered by the easement,
restore the surface of the easement,and any private improvements disturbed ar destroyed during
executian af the work, as nearly as practicable ta the conditic�n they were in immediately before
commencernent af the work nr entry by the Gra ntee.
2. Grantor shall retain the right ta use the surface af tFre easement as long as such use daes not
interfere with the easernent rights granted to the Grantee. Grantor shall not, however, have the right to:
a. Erect nr maintain any buildings or structures within the eas�ment;or
b. Plant trees, shrubs or vegetation having deep root patterns which may caus� damage to ar
interfere with the utilities to be pfaced within the easement by the Grantee;or
c. CYevelop, landscape, or beautify the easement area in any way which wouid unreasonably
increase the casts to the Grantee of restaring the easement area and any private
improvementstherein;or
d. Dig, tunnel or perform other forms of construction activities on the property which would disturb
the compaction or unearth Grantee's facilities an the right-af-way, or endanger the lateral
support facilities;or
e. Blast within fifteen(15)feet of the easement;or
f. Erect fences in such a way as ta prevent access by the Grantee's vehicles to the Grantee's
faeilities. Any fence construction must pravide for an apening (gated, remavable sections, barriers,
etc.)af at least ten(10)feet in width;ar
g. Erect any objects within fifteen (15)abave the ground surFace within the easement.
This easern�nt shall run with the land described herein, and shall be hinding upan the parties, their heirs,
successors in interest and assigns. Granta�r couenants that it is the lawfu! owner qf the abave
property(ies)and that it has a gaod and lawful right to�x�cute this�greement.
Grarrtor shall protect, save and hold harmless,and defend,with counsel of its sole reasanabie choice,Grantee,
its t�nant(s),and their successars, assigr�s,custiamers and invitees,fram all claims,actians,filed or threatened,
casts,damages,ar expens�s af any nature v✓hatsaeuer arising aut of or in connection with any acts or omissians
af Grantor in connection with this easement. The obligation to protect, save and hald harmCess, and defend
shall not include such claims,actions,costs,damages, or expenses which may t�e causeci by the sole negligence
af Grantee or its tenant(s),or their successars or assigns; Provided that iE the claims actians,costs, damages,or
expenses are caused by or result frcam cancurrent negligence c�f(a) �rantee ar its tenant(s),or their successors
or a5signs and {b} Grantar, its agents„ c�ntractors ar assigns, ancf involues thase actions covered by RCW
4.24.115,this Endemnifiy provision shall be valid and enforceable only eo the extent af the ne�ligence af Grantor,
its agents,eontractors ar assigns. �rantar shall prnmptly natify Grantee and its tenant(s) of any loss, damage,
injury or death arisin� out af ar in cannectian with any acts or omissions of Grantnr in connectian with this
easement.
By this conveyance,Grantor will warrant and defend the conveyance hereby made unto the Grantee against all
and every person or persons, whomsoever, lawfully, claiming or ta claim the same.This conveyance shall bind
the heirs,executors,administrators and assigns forever.
