5971CITYOFRENTON,WASHINGTONORDINANCENO.5971ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,DECLARINGANDESTABLISHINGAPUBLICEMERGENCY;IMPOSINGPENALTIESFORVIOLATIONOFORDERSISSUEDBYTHEMAYORINACIVILEMERGENCY;PROVIDINGFORSEVERABILITY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,pursuanttoRCW35A.12.100,theMayorisresponsibletoseethatlawandorderismaintainedintheCity,whichattimesincludesexercisingemergencypowersandenforcingCityandstatelaws;andWHEREAS,onMay31,2020,theMayorproclaimedacivilemergencyandimposedacurfewarisingoutofviolenceandlootingoccurringinandaroundtheCity;andWHEREAS,theCityCouncilsupportstheMayor’seffortstomaintainlawandorderanddesirestoestablishexpresslegislativeauthorityfortheMayortoestablishandenforcecurfews;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.ThisordinanceisdeclaredanddesignatedaPublicEmergencyOrdinance.SECTIONII.MayorPavone’sMay31,2020CivilEmergencyOrderImposingCurfewisratified.FutureordersissuedpursuanttoSectionIllofthisOrdinanceneednotberatifiedbytheCounciltobeeffective.SECTIONIII.MAYOR’SEMERGENCYPOWERSareadoptedasfollows.MAYOR’SEMERGENCYPOWERS1.Proclamationofcivilemergency—Emergencydefined.Wheneveracivilemergency,ortheimminentthreatthereof,occursinthecityandresultsinorthreatenstoresultinthedeathorinjuryofpersons,orthedestructionofordamage1 ORDINANCENO.5971topropertytosuchextentastorequire,inthejudgmentofthemayor,extraordinarymeasurestoprotectthepublicpeace,safetyandwelfare,themayorshallforthwithproclaiminwritingtheexistenceofacivilemergency.Intheabsenceofthemayor,suchacivilemergencymaybedeclaredbythemayor’sdesigneeortheChiefofPolice.Forthepurposesofthisordinanceacivilemergencyshallmean:A.Ariot,unlawfulassembly,insurrection,enemyattack,sabotage,orotherhostileaction;orB.Anaturalorhumancauseddisaster,includingfire,flood,storm,explosion,earthquake,volcanicdisturbanceorothernaturalcause.2.Actionwhichmaybetaken.Upontheproclamationofacivilemergencybythemayor,andduringtheexistenceofsuchemergencythemayormaymakeandproclaimanyorallofthefollowingorders:A.Anorderimposingageneralcurfewapplicabletothecityasawhole,ortosuchgeographicalareaorareasofthecityandduringsuchhoursashedeemsnecessary,andfromtimetotimetomodifythehourssuchcurfewwillbeineffectandtheareaorareastowhichitwillapply;B.Anorderrequiringanyorallbusinessestablishmentstocloseandremaincloseduntilfurtherorder;C.Anorderrequiringtheclosureofanyorallbars,taverns,liquorstoresandotherbusinessestablishmentswherealcoholicbeveragesaresoldorotherwisedispensed;provided,thatwithrespecttothosebusinessestablishmentswhichare2 ORDINANCENO.5971notprimarilydevotedtothesaleofalcoholicbeveragesandinwhichsuchalcoholicbeveragesmayberemovedormadesecurefrompossibleseizurebythepublic,theportionsthereofutilizedforthesaleofitemsotherthanalcoholicbeveragesmay,inthediscretionofthemayor,beallowedtoremainopen;D.Anorderrequiringthediscontinuanceofthesale,distributionorgivingawayoffirearmsand/orammunitionforfirearmsinanyorallpartsofthecity;E.Anorderrequiringthediscontinuanceofthesale,distributionorgivingawayofgasolineorotherliquidflammableorcombustibleproductsinanycontainerotherthanagasolinetankproperlyaffixedtoamotorvehicle;F.Anorderrequiringtheclosureofanyorallbusinessestablishmentswherefirearmsand/orammunitionforfirearmsaresoldorotherwisedispensed;provided,thatwithrespecttothosebusinessestablishmentswhicharenotprimarilydevotedtothesaleoffirearmsand/orammunitionandinwhichsuchfirearmsand/orammunitionmayberemovedormadesecurefrompossibleseizurebythepublic,theportionsthereofutilizedforsaleofitemsotherthanfirearmsandammunitionmay,inthediscretionofthemayor,beallowedtoremainopen;G.Anorderclosingtothepublicanyorallpublicplaces,includingstreets,alleys,publicways,schools,parks,beaches,amusementsareasandpublicbuildings;3 ORDINANCENO.5971H.Anorderprohibitingthecarryingorpossessionoffirearmsoranyinstrumentwhichiscapableofproducingbodilyharmandwhichiscarriedorpossessedwiththeintenttousethesametocausesuchharm;provided,thatanysuchordershallnotapplytopeaceofficersormilitarypersonnelengagedintheperformanceoftheirofficialduties;I.Suchotherordersasareimminentlynecessaryfortheprotectionoflifeandproperty.AnysuchproclamationbytheMayorshallbefiledimmediatelyafterissuanceoftheproclamation,orassoonaspractical,withtheCityClerkforpresentationtotheCityCouncilforinformationpurposesonly.3.Deliverytonewsmedia.Themayorshallcauseanyproclamationissuedbyhimpursuanttotheauthorityofthischaptertobedeliveredtoallnewsmediawithinthecityandshallutilizesuchotheravailablemeans,includingpublicaddresssystems,asshallbenecessary,inhisjudgment,togivenoticeofsuchproclamationstothepublic.4.Violation—Penalty.Itisunlawfulforanyonetofailorrefusetoobeyanysuchorderproclaimedbythemayor.Anyoneconvictedofaviolationofthischapterispunishablebyafineofnotmorethan$250.00,orbyimprisonmentfornotmorethan90days,orbothsuchfineandimprisonment.4 ORDINANCENO.5971SECTIONIV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONV.PursuanttoRCW35A.11.090thisordinanceisdesignatedasaPublicEmergencyOrdinancenecessaryfortheprotectionofpublichealth,publicsafetypublicpropertyand/orpublicpeaceandshallbeinfullforceandeffectimmediatelyandisadoptedbyunanimousvoteoftheCouncil.Thisordinanceshallsunset/expireonAugust31,2020withtheanticipationthatamorepermanentordinancecanbeadoptedinnon-emergencycircumstances.PASSEDBYTHECITYCOUNCILthis1stdayofJune,2020.________Ja%fA.sethyClerkAPPROVEDBYTHEMAYORthis1stdayofuneApprovedastoform:ShaneMoloney,CityAttorneyDateofPublication:_______________ORD#:5971Date:6/1/2020•2020.5
