HomeMy WebLinkAbout06-15-2020 - HEX email Re: City of Renton Solera Appeal - LUA-18-000490,I serve as the Renton Hearing Examiner and am in receipt of the Notice of Appeal for Solera, LUA-18-000490. I will be drafting a prehearing order that sets prehearing deadlines and outlines appeal hearing procedures. If there are any prehearing issues the parties would like addressed before I do so, please let me know by 5 pm, 6/18/20. As likely all attorneys already know, my jurisdiction to consider the validity of City ordinances is questionable. The jurisdictional issue raised in this case is distinguishable from what more frequently arises where the basis for alleged invalidity is constitutional invalidity. In this case it's OPMA validity. To minimize the expense incurred by all parties in litigating this appeal it would appear that a prehearing motion on the jurisdictional issue would be beneficial. If the parties would prefer, I can research the issue myself and make a sua sponte ruling on my subject matter jurisdiction. To prepare the prehearing motions I just need to know if the parties intend on filing any prehearing motions and if they have any problem with filing exhibit and witness lists prior to the appeal hearing. Please also let me know of your availability for the appeal hearing. Given that a final decision is due on August 20, 2020 unless the appeal deadline is waived by the Appellants, the ideal dates for holding the appeal hearing would be July 21, 2020 or July 28, 2020. Available hearing dates are the 2nd, 3rd and 4th Tuesdays of every month. I am also available for a telephonic prehearing conference if the parties find that necessary.
