HomeMy WebLinkAboutORD 5973CITYOFRENTON,WASHINGTONORDINANCENO.5973ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,DECLARINGAMORATORIUMONAPPLICATIONSFORWAIVEDFEES(RMC4-1-210)DUETOECONOMICCONSIDERATIONSRELATEDTOTHECOVID-19PANDEMIC;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,theCityCounciladoptedOrdinance5967onApril6,2020,whereintheCitydeclaredamoratoriumon,amongotherthings,applicationsfromLargeResidentialProjects(definedas150dwellingunitsormoreinaproject)forthewaivedfeesprovisionsofRentonMunicipalCode(RMC)4-1-210;andWHEREAS,Ordinance5967didnotaddresswaivedfeesapplicationsforanyprojectsotherthanLargeResidentialProjects,thusallowingallotherprojectstoapplyforwaivedfeesnotwithstandingthemoratorium;andWHEREAS,Ordinance5967’smoratoriumonapplicationsforwaivedfeesforLargeResidentialProjectsanticipatedallowingtheCitytimetoevaluateandrespondtothesignificantandpotentiallydetrimentaleffectsofwaivingfeesforLargeResidentialProjects;andWHEREAS,RCW82.02.060allowstheCitytowaiveupto80%ofthetransportation,parks,andfireimpactmitigationfeesforeligibleaffordablehousingprojects.ThecurrentwaivedfeesprovisionsofRMC4-1-210allow100%ofalleligiblefeestobewaived;thismeansthattheCitypaysthe20%differenceabovethe80%statutorylimitfortransportation,parks,andfireimpactmitigationfees;andWHEREAS,the20%paymentbytheCityforthecombinedtransportation,parks,andfireimpactmitigationfeescanbesubstantial.Forexample,forthemostrecentwaivedfees1 ORDINANCENO.5973approvedearlierthisyearfortheHabitatforHumanityofSeattle/KingCounty’sLaFortunaPhaseIfprojectwith12units,theCity’sprojected20%paymentfortransportation,parks,andfireimpactmitigationfeestotaled$18,494(ormorethan$1,500perhousingunit);andWHEREAS,sinceOrdinance5967wasadopted,theCity’sCommunityandEconomicDevelopmentDepartment(CED)hasbeenundertakingaworkprogramtoproposeamendmentstothewaivedfeesprovisions,includingamendmentsthatwouldcapfeewaiversforimpactmitigationfeesatthe80%statutorylimit.ThiscapwouldsavetheCityfromfutureinstancesofpayingthe20%differencefora100%feewaiverfortheimpactmitigationfees;andWHEREAS,CEDstaffhavebriefedthePlanningCommissionregardingtheseproposedamendmentstothewaivedfeesprovisions.OnJune3,2020,thePlanningCommissionopenedapublichearingregardingthematter.Asofthedateofthisordinance,thepublicheatingremainsopen,isnotanticipatedtocloseuntilJuly15,2020,andwillbefollowedbyaPlanningCommissionrecommendationtotheCityCouncil.Underthisschedule,reviewandactionbytheCityCouncilwilloccurnosoonerthanAugust2020;andWHEREAS,theCityisnowprojectingsubstantialrevenuelossesthisyearrelatedtotheCOVID-19pandemic;andWHEREAS,theCityurgentlyneedsanopportunitytofinishitsevaluationofandtoactonamendingthewaivedfeeprovisionsbeforeanynewwaivedfeesapplicationsarereceivedtoavoidfurtherrevenueimpacts,suchthattheexistingbaronwaivedfeesapplicationsforLargeResidentialProjectsshouldbeexpandedtoabaronwaivedfeesapplicationsforallprojects;andWHEREAS,accordingly,theCityCouncilhasdeterminedthatthereisaneedforamoratoriumonacceptinganyapplicationsforwaivedfees(RMC4-1-210);and2 ORDINANCENO.5973WHEREAS,theCityCouncilfindsthatthesubjectofthisordinancecomplieswiththeGovernor’sProclamation20-28,asamended,relatingtomeetingsduringtheCOVID-19crisis;andWHEREAS,theCityCouncilwillholdapublichearingwithinsixty(60)daysofthepassageofthisordinance;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportofthemoratoriumadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.TheCityCouncilherebydeclaresamoratoriumonthesubmission,acceptance,processingorapprovalofanyapplicationsforwaivedfees(RMC4-1-210).SECTIONIII.ThemoratoriumimposedhereinshallbeineffectuntilDecember22,2020,unlessendedearlierbysubsequentCityCouncilaction,orunlesssubsequentlyextendedbytheCityCouncilpursuanttostatelaw.SECTIONIV.Apublichearingwillbescheduledandheldwithinsixty(60)daysofthepassageofthisordinance.SECTIONV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.3 ORDINANCE NO. 5973 SECTION VI. The City Council declares an emergency for the protection of the public welfare and to enable the purpose and intent of this ordinance to be accomplished. This ordinance shall take effect immediately when passed by the City Council. The City Clerk shall cause to be published a summary of this ordinance in the City's official newspaper.
