The property is located at 1624 Jones Ave NE (parcel number 3343903484) and is approximately 9,310 square feet in size and located within the Residential-4 (R-4) zone. The subject property is currently occupied by an existing single family residence. The City's Code Compliance Officer, Kevin Louder, inspected the property on November 19, 2019 and noted the significant tree removed without a permit consisted of one Landmark Tree, measuring 39-inches in diameter. The applicant proposes to replace a total of 11.75 caliper inches of trees on-site, and mitigate for the remaining caliper inches removed via a fee-in-lieu to the City’s Urban Forestry Program fund. The proposed replanting includes one 2-caliper inch Parrotia Persica, one 2-caliper inch Gary Oak, one 1.75-caliper inch Chinese Kousa Dogwood, and two 3-caliper inch Vine Maples (Exhibit 1). However, the City's Urban Forestry team states that a larger stature, single-stem tree would be a more appropriate replacement for the three that was removed, rather than the Vine Maples proposed (Exhibit 3). In addition, the provided replanting plan (Exhibit 2), does not identify the location for each tree species. Therefore staff recommends a condition of approval that the applicant submit a revised tree replacement plan that includes tree species similar to the tree removed, for review and approval by the Current Planning Project Manager and Urban Forester, prior to tree installation. The tree replacement plan shall identify and label the location and size for each tree species. The installation of the approved replacement trees (totaling 11.75 caliper inches) following City Review of the revised replacement plan, as well as the payment of the fee-in-leui, resolves code case number CODE19-000705. After replanting, the property will exceed tree density requirements. YES The land clearing and tree removal shall be consistent with restrictions for critical areas, pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations, and RMC 4-3-050, Critical Areas Regulations. 2. Comments: No critical areas are mapped on the subject property. YES Removal of a landmark tree shall meet the review criteria for removal of a landmark tree, pursuant to RMC 4-4-130, Tree Retention and Land Clearing Regulations. 3. Comments: The landmark tree was removed illegally without permits. The RVMP provides for the mitigation of the removed tree. YES Street frontage and parking lot trees and landscaping shall be preserved, unless otherwise approved by the Administrator. 4. Comments: Not Applicable to this project. YES The land clearing and tree removal shall not remove any landscaping or protected trees required as part of a land development permit. 5. Comments: No additional landscaping or protected trees are proposed for removal. YES The land clearing and tree removal shall maintain visual screening and buffering between land uses of differing intensity, consistent with applicable landscaping and setback provisions 6. Comments: Not applicable. The proposed mitigation planting does not propose to remove visual screening and buffering between land uses of differing intensity. YES The land clearing and tree removal shall not create or contribute to a hazardous condition, such as increased potential for blowdown, pest infestation, disease, or other problems that may result from selectively removing trees and other vegetation from a lot. 7. Comments: The permit is requested mitigate for a tree removal violation. The proposed replanting will not create or contribute to a hazardous condition. DECISION: The Reeves Vegetation Management Routine Vegetation Management Permit is Approved with Conditions*. *CONDITIONS OF APPROVAL: The applicant shall submit a revised tree replacement plan that includes tree species similar to the tree removed, for review and approval by the Current Planning Project Manager and Urban Forester, prior to tree installation. The tree replacement plan shall identify and label the location and size for each tree species. Appeals to the Examiner are governed by RMC 4-8-110 and more information regarding the appeal process may be obtained from the Renton City Clerk’s Office, 425-430-6510. Reconsideration: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. Expiration: The Routine Vegetation Management Permit shall be valid for one year from the date of issuance. An extension may be granted by the Planning Division for a period of one year upon application by the property owner or manager. Application for such an extension must be made at least thirty (30) days in advance of the expiration of the original permit and shall include a statement of justification for the extension. Reeves Case #19-000707, 1624 Jones Ave. NE To Whom it May Concern, Ms. Reeves received a Warning of Violation on November 19 , 2019 from the City of Renton regarding removal of a large tree from her front yard without a permit. The Notice outlined her options for remediation. The removed tree had a diameter of 39 caliper inches , precluding replacement with a tree of eq ual size. In addition, there is insufficient space on the property for planting of 39 caliper inches of smaller trees. This is a proposal for partial replacement planting. The proposed new planting is provided by Conservation Tree Care of Seattle , whom Ms. Reeves plans to work with to carry out the project. The tree that was removed was a cedar tree. As laid out in the proposal from Conservation Tree Care included with this application, the plan is to replace 11. 75" caliper with new trees in the front yard to include the following: o 1 Parrotia persica 2 " caliper o 1 Gary Oak 2" caliper o I Chinese Kousa dogwood 1.75" caliper o 2 multi-stemmed Vine maples 3" caliper each For the balance remaining , the Notice provides the option of paying into the Urban Forestry Program Fund at a rate of$215 per caliper inch, which in this case comes to $5 ,805. I am requesting that the City consider reducing the balance Ms. Reeves owes to the forestry fund to $4 ,000. In this circumstance, Ms . Reeves is elderly. The removed tree was dropping limbs and she was afraid one would fall on her house or herself. The proximity of the tree to her house can be seen in the Google street view photograph provided. Ms. Reeves now understands that she needs to get an arborist involved and obtain a permit for limbing or removal of any other large trees on her property. I am back in Renton and working from home during the ongoing health concerns. I have sent the proposal to our Urban Forestry team and they have a few requests. Please see the response below: “This plan would be acceptable to forestry with a slight change. Please ask the applicant to swap out the Vine Maples for something else. This is more of a multi-stemmed shrub than a tree and we would prefer to see a larger stature single stem tree. The whole idea here is to replace the tree lost with plantings which will eventually provide benefits to the community from having larger canopies. If the dogwood can be found at 2” caliper that would be best as well.” Could you please check in with the homeowner and see what trees they would be open to using in lieu of the Vine Maples?
