DESCRIPTION: The applicant, Renton Prep School, is requesting a Shoreline Exemption and Tier
1 Temporary Use Permit for installation of a wooden fence around the existing
building podium. The school currently operates on three floors of the existing multi-
story, multi-tenant building at 200 Mill Ave S. The purpose of the fence is to provide
a secure outdoor space for students to attend class outside temporarily due to the
COVID-19 pandemic. The six-foot tall wood slat fence would extend approximately
250 linear feet in a rectangular shape. The fence panels would be installed using
steel plates that would be bolted to the cement podium. The expected total cost
of the fence is approximately $5,790.00. Access to the site would remain off of
Mill Ave S. Critical areas mapped on-site include sensitive slopes (15-40%),
seismic hazards, and a Special Flood Hazard Area. The site is also located within
Reach B of the Cedar River Regulated Shoreline High Intensity Overlay. The
applicant submitted a site plan with the application. No trees or vegetation are
proposed for removal. The fence is anticipated to be installed in August of 2020.

SHORELINE EXEMPTION JUSTIFICATION/DECISION: An exemption from a Shoreline Management Substantial
Development Permit, is hereby APPROVED on the proposed project in accordance with RMC 4.9.190C “Exemption
from Permit System” and for the following reasons:
Any development of which the total cost or fair market value, whichever is higher, does not exceed seven thousand
and forty seven dollars ($7,047.00), if such development does not materially interfere with the normal public use of
the water or shorelines of the state.
TEMPORARY USE PERMIT (TIER 1) JUSTIFICATION/DECISION: Due to the challenges related to indoor student
instruction resulting from the current COVID-19 pandemic, the applicant is seeking to create a temporary, secure
area for students to learn in an outdoor environment. The proposed fencing would only remain in place until
instruction can safely take place indoors, after which time the fencing would be removed and the area restored to
its current state. The area would not be utilized during inclement weather and would likely only be used during the
summer and early fall months. The Temporary Use Permit is hereby APPROVED.
FINDINGS:
i. The proposed development is consistent with the policies of the Shoreline Management Act and the
City of Renton Shoreline Master Program.
ii. The proposed wood fence would be located approximately twenty five (25) feet from the Cedar River
Ordinary High Water Mark at the nearest point
iii. According to the 1995 FIRM Map currently effective at the time of the decision, the proposed wood
fence would not be located within the Cedar River Special Flood Hazard Area. In addition, the proposed
development would be located within an area of the site with an elevation of approximately 44 feet
according to GPS data collected by staff on July 30, 2020. The base flood elevation for the section of
Cedar River adjacent to the project site is 31 feet according to the FIRM Map (attached). Therefore
the proposed development is approximately 13 feet above the base elevation and would not be
impacted by a 100-year flood event.
DECISION: The Renton Prep School Fence shoreline exemption and Tier 1 Temporary Use Permit, LUA 20-
000175, SME, TUP, is approved.

RECONSIDERATION/APPEAL: Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”),
the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City
Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected
at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information
regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. If the situation
changes such that the City Clerk’s Office is open when you file your appeal, you have the option of filing the appeal
in person.
EXPIRATIONS: Shoreline Exemption - Two (2) years from the date of decision (date signed).
Temporary Use Permit – One (1) year from the date of decision (date signed).
