CODE-20-000321 DECLARATION OF NATE MALONE IN SUPPORT OF CITY OF RENTON’S FINDING OF VIOLATION REGARDING RED LION DE- INTENSIFICATION SHELTER I, Nate Malone, declare as follows: 1.I am competent to testify in this matter and have personal knowledge of the facts stated herein. 2.I am employed by the City of Renton. I serve as the Tax & Licensing Program Manager within the City’s Administrative Services Department. I have been employed with the City since 2017. In my capacity as Tax & Licensing Program Manager, one of the programs that I manage is the City’s business licensing program. I am familiar with the de-intensification shelter that is operating at the site of the former Red Lion Inn & Conference Center, at 1 South Grady Way, Washington (the “Property”). 4. No one applied for a City of Renton business license to operate the de- intensification shelter. This includes the Downtown Emergency Service Center (“DESC”), King County, and Renton Hotel Investors, LLC – none of them even inquired about applying for a City of Renton business license. 5. I searched Seattle and state licensing records and discovered that DESC has multiple state and Seattle licensed locations; however, a separate business license is still required for business conducted in the City of Renton. 6. Renton Hotel Investors, LLC obtained a City business license for the former hotel use as the Red Lion Inn & Conference Center. Attached hereto as Exhibit A is a true and correct copy of that business license. 7. City business licenses are non-transferable pursuant to RMC 5-5-3.A.1. Renton Hotel Investors, LLC’s business license for the Red Lion Inn & Conference Center cannot be transferred to a different primary operator (DESC) for a different business (de-intensification shelter). 8. In accordance with RMC 5-5-3.E.5, the City requires all businesses engaging in business within the City to apply for a business license before operating. And see generally RMC 5-5-3. Registration applications are required even if the business may be exempt from taxation or application fees. One purpose is to allow the City to know what businesses are operating within the City and to assist in determining whether such businesses are subject to the City’s business and occupation tax. One of the regulatory purposes of this requirement is to allow the City to check to see if the business’ planned use of property complies with City zoning and building regulations.
