The property is located within the R -4 zone and is developed with one single-family house. The applicant proposes to retain the existing four-foot (4’) landscape strip located between the existing fence and the east property line, rather than the required eight feet per RMC4-4- 040.D.3.e.ii (Exhibit 2 – Site Plan). The existing four-foot (4’) wide landscape strip along the side yard consists of six-foot (6’) tall laurel hedges, two (2) red maple trees and bark nuggets on the ground (Exhibit 3 - Elevations). The applicant is proposing to retain the existing landscaping. The proposed privacy fence would be constructed utilizing high-quality cedar wood fence with a natural stain color to match other fences in the neighborhood (Exhibits 4 and 5 – Neighborhood Detail Map and Fence Style). The applicant is proposing the special use permit to replace and old dilapidated fence and provide extra security. The fence would be constructed outside of the clear vision area. City staff agrees with the applicant's justification (Exhibit 6 – Justification) for reduced setback and concurs that the proposed fence strikes an appropriate balance between preserving private space and protecting the safety and aesthetics of the neighborhood. Therefore, staff recommends approval of this Special Fence Permit request as submitted. The proposed fence improves the privacy and security of the adjoining yard space. b. The proposed fence does not detract from the quality of the residential environment by being out of scale or creating vast blank walls along public roadways. c. The proposed fence compliments the environment it serves in an aesthetically pleasing manner. d. The proposed fence does not present a hazard to vehicular or pedestrian traffic. The administrative land use decision will become final if the decision is not appealed within 14 days of the decision date. APPEAL: Due to Governor Jay Inslee’s Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. If the situation changes such that the City Clerk’s Office is open when you file your appeal, you have the option of filing the appeal in person. RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. This fence is to replace an old, dilapidated fence that was present at the house at the time of purchase, of which multiple posts and boards have rotted, bent, and broken. I would like to construct a fence that is 72” to provide extra security for my family, as we have young children who could be lifted over the existing 48-inch-tall fence by a malicious party while they are playing in the backyard. In addition, a 72” fence will provide increased privacy for my family, neighbors, and passersby, in a location that will not limit our usable back yard space. The following measures will be taken to help maintain the neighborhood aesthetic and not create vast blank spaces along public roads: 1. The fence will be constructed of high-quality cedar wood with a natural stain color to match numerous other fences in the neighborhood. 2. The fence will be oriented towards the view of the public. 3. The fence will be built in the style of the existing 72” fences in the community. 4. The fence will be offset from the sidewalk 4’. In this space, the existing landscaping is 72" tall laurel hedges, and two red maple trees, leaving no gaps greater than 24" except where municipal easements exist, with bark nuggets on the ground. 5. The fence will be constructed outside of the clear vision area so it will not be a safety hazard. Attached you will find the proposed path and styling for the fence that would like to construct.
