That said Grantor(s) (hereinafter, "Grantor"),fpr and in consideratian of mutual benefits,do by these presents,grant,
bargain, sell, convey, and warrants unta the said Grantee, its successors and assigns, en easement for oublic utilities
jincludin�water, sanitary sewer, and storm draina�e with necessary appurtenances over, under,thraugh, ecross and
upon the property in King County,Washington,described on page 1.
For the purpose af construc#ing, reconstrueting, installing, repairing, repiacing, enlarging, operating and maintaining
utilities and utilitv pipelines includin� but not lirnited to water sanitary sewer and storm draina�e together with the
right af ingress and egress thereto without prior institution of any suit or proceedings af law and wi#hout incurring any
legal obligation or liability therefor. Following the initial construction of its facilities,Grantee may from#ime to time
construct sueh additianal facilities as it may require or desire. This easement is granted subaect to the following terms
and conditions:The Grantee shall,upon completion of any work within the property covered by the easement,restare
the surfaee af the easement, a�d any private impravernents disturbed or destrayed during execution of the work, as
nearly as practicable to the condition they were in immediately before cornmeneement af the wark or entry by the
Grantee. Grantee shall promptly restore any darnage to the described easement area or the surrounding area caused
by Grantee or any af its employees,cantractors,su6contractors,agents,and other representatives.
1. The Grantee shall, upon completinn of any wark within the praperty covered by the easement, restore
the surface of the easement,and any private improvements disturbed ar destroyed during executiorr af
the work, as nearly as pratticable to the condition they were in immediately before comme�cement af
the wark or entry by the Grantee.
2. Grantar shall retain the right to use the surface of the easement as long as such use does not interfere
with the easement rights granted to the Grantee. Grantor shall nat,howeuer,have the right to:
a, Erect or maintein any buildings or structures within the easement;or
b. Plant trees,shrubs or vegetation having deep root patterns which may cause damage to or interfere with
the utilities to be placed within the easement by the Grantee;or
c. Develop, landscape, or beautify the easement area in any way which would unreasonably increase the
costs to the Grantee of restoring the easement area and any private impravements therein;ar
d. Dig, tunnel or perfarm ather forms of construction activities an the property which would disturb the
compaction ar unearth Grantee's facilities an the right-of-way,or endanger the lateral support fadlities;
or
e. Blast within fifteen(15)feet of the easement;or
f. Erect fences in such a way as to prevent access by the Grantee's vehicles to the Grantee's facilities. Any
fence construction must provide far an opening(gated,removable sections, barriers,etc.)of at least ten
(10)feet in widkh;or
g. Erect any objects within fifteen(15)above the ground surface within the easement.
This easement shall run with the land described herein,and shall be binding upon the parties,#heir heirs,successors in
interest and essigns.Grantor covenants that it is the lawful nwner of the abave property(ies)and that it has a good and
lawful right to execute this agreement.
Grantor shall protect, save and hold harmless, and defend, with caunsel of its sole reasona6le choice, Grantee, its
tenant(s), and their successars, assigns, custamers and invitees, from all claims, actions, filed or threatened, cos#s,
damages,or expenses of any nature whatsoever arising out of or in conneetian with any acts ar omissians of Grantor in
connection with this easement. The obligation ta pratect,save and hoid harmless,and defend shall not inciude such
claims,actions,casts,damages,or expenses which may be caused by the sale negligence c�f Grantee or its tenant(s),ar
their successors ar assigns; Provided that if the claims actions, costs, damages, or expenses are caused by or result
from concurrent negligence of(a) Grantee or its tenant(s), ar their successars ar assigns and (b) Grantor, its agents,
contractors or assigns,and involves those actians covered by RCW 4.24,115,this indemnity pravision shall be valid and
enforceable only ta the erckent of the negligence of Grantor,its agents,contractors or assigns. Grantor shall pramptly
notify Grantee arrd its tenant(s) of any loss, damage, injury or death arising out af ar in connec,tion with any acts or
amissians of Grantor in cannectian with ihis easement. Grantee shall indemnify, defend and hald harmless Grantor
from and against any and all claims,actions,suits,losses,expenses(including reasonable attorneys'fees),and damages
which may accrue or be suffered by any persans or property to the extent arising from pr relating to the activities of
Grantee pursuant to this utility easement, except to the extent caused or cantributed to by the gross negligence ar
willful miscanduct of Grantor.
