1. The Grantar(s)or his/her(their)successors in interest and assigns("Uwners")shall at their own
cost, aperate, maintain, and Iceep in gaad repair,the Praperty's drainage facilities constructed
as required in the approved construction plans and specificatians PR16-q00215 (Project
Plan tt) on file with the City of Rentan and submitted to the City af Rentan for the review and
approval af permit(s) U160p6798 (Canstructlan/Building/UtilityPermitll).The
Property's drainage fa�ilities are shawn and/ar listed an Exhibig A—Site Plan. The Property's
drainage faeilities shall be maintained in corrrpliance with the aperation and maintenance
schedule included and attached herein as Exhibit B — Operatians and Maintenance. Drainage
facilities include pipes, channels, flow control facilities, water quality facil'tties, on-site best
management practices (BMPs) and ather engineered structures designed to manage and/or

treat stormwater on the Praperky. On-site BMPs include dispersion and infiltration devices,
bioretentian, permeable pavements, rainwater harvesting systems, tree retentian credit,
reduced imperviaus sur-face footprint, vegeta#ed roofs and ather measures designed to mimic
pre-developed hydralagy and minimize stormwater runoff on the Praperty.
2. City of Renton shall have the right to ingress and egress over thcrse partions of the Property
necessary to perform inspectians of the stormwater facilities and BMPs and conduct
maintenance activities specified in this Declaration of Covenant and in accordance with the
Renton Municipal Cade. City of Rentan shall provide at least thirky (3q} days'written notice to
the Owners that entry on the Praperty is planned for the inspection af drainage facilities. After
the thirty(30) days,the Owners shall allow the City r�f Renton to enter for the sole purpose of
inspecting drainage facilities, In lieu af inspectian by the City,the Owners may elect to engage
a licensed civil engineer registered in the state af Washington who has experkise in drainage to
inspect the drainage facilities and provide a written repart describing their candition. If the
engineer aption is chasen,the c�wners shall provide written natice ta the City of Rentan within
fifteen (15)days af receiving the City's notice of inspection.Within thirty(30)days af giving this
natice,the CJwners,ar engineer on behalf af the C)wners,shall provide the engineer's report ta
the City of Rentan. If the� report is nat provided in a timely manner as specified above,the City
of Renton may inspect the drainage facilities without further natice.
3. If City af Renton determines fr4m its inspectian, or fror�n an engineer's report pravided in
accordance with Paragraph 2,that maintenance, repair, restoration, and/or mitigation work is
required to be dane to any of the drainage facilities, City of Renton shall notify the awners of
the specific maintenance, repair, restoratian, and/or mitigation wark ("Work"� required
pursuant to the Rentan Municipal Code. The City shall also set a reasanak�le deadline for the
Owners to complete the Wark, or ta provide an engineer's repart that verifies completian of
the Work. After the deadline has passed, the Owners shall allow the City access to re-inspect
the drainage facilities unless an engineer's repart has been provided verifying completian af
the Work. If the Work is not completed within the time frame set by the City, the City may
initiate an enforcerrrent action and/or perform the Work and hereby is given access to the
Praperty for such purposes. Written notice will be sent to the Owners stating the City's
intentian to perfarm such Worle.This Work will not corrrmence until at least seven(7)days after
such r�atice is mailed. If, within the sale discretian of the City, there exists an imminent or
present danger, the seven (7) day notice period will be waived and Work will begin
immediately�
4. The Owners shall assume all responsibility far the cost of any Work, or any measures taken by
the City to address conditions as deseribed in Paragraph 3, Such responsibility shall include
reimbursement to the City within thirty(30)days afthe receipt af the invaice for any such Warlc
performed. C?verdue payments will require payment af interest at the maximum legal rate
allowed by RCW 19.5�.020 (currently twelve percent (12%)). If the City initiates legal action to
enforce this agreement, the prevailing party in such action is entitled ta recaver reasonable
litigatian costs and attarney"s fees.
S. The Owners are required to obtain written approval from City of Rentc�n prior to filling, piping,
cutting, ar removing vegetatian (except in routine landscape maintenance) in open vegetated
stormwater faeilities (such as swales, channels, ditches, prands, etc.), or performing any
alterations or modificatians ta the drainage facilities referenced in this Declaration af Covenant.

6. Any natice ar consent required ta be given or otherwise pravided for by the pravisions of this
Agreement shall be effective upon person�l delivery,orthree(3)days after mailing by Certified
Mail, return receipt requested.
7. With regard to the matters addressed herein,this agreement constitutes the entire agreement
between the parties, and supersedes all prior discussions, negotiations, and all agreements
whatsoever whether oral ar written.
8. This Declaration of Covenant is intended to pratect the value and desirability and promate
efficient and effective management of surface water drainage of the real praperty described
above, and shall inure to the benefit of all the citizens af the City of Renton and its successars
and assi�ns. This Declaration af Cavenant shall run with the land and be binding upon
Grantor(s), and Grantor's(s')successors in interest,and assigns.
9, This Declaration of Cavenant may be terminated by execution of a written agreement by the
Owners and the City that is recorded by I<ing County in its real property records.
