approvat of permit(s} 820000843 (Construction/eurlding/UtilityPermit#).The
Property's drainage facilities are sh�wn and/or listed on Exhibit �—Sit� Pi�n. The Praperty's
drainage facilities shall be maintained in compliance with the operatian and rnaintenar�ce
schedule inclu�ed and attached herein as Exhibit�—�per�ti�r►s a�cl t�l�inter��ra��. Drainage
facilities include pipes, channels, flaw control facilities, water quality facilities, on-site best
management practices (BI�Ps} ancl other engineered structures designed ta manage andjor

treat stormwrater on the Property. �n-site BMPs incl�ade dispersion and ir�filtrafiion devices,
bioretention, �errneable pavemer�ts, rainwat�r harvesting systerns, tree retention credit,
r�duced irv�pervious surFace fo�tprint,vegetated roofs and other rneasures designed to mimic
pr�-developed hydrolcsgy and minimize starrn�ra�Eer r�anoff or�the Property.
2. City of R�nton shail have the right ta ingr�ss and egress aver those portions of the Property
necessary to perform ins�ec�ions of the stormwater facilities and BMPs and conduct
mainte�ance activities spec�fied in �his f3eclara�ian of Covenant and in accardance �rith the
Renton Mur�icipaf Cade.City of Rentan shall provide at least thir�y (30) days' written natice to
the Owners that entry an the Property is pfanned for the inspectinn of draina�e facilities. After
the thirty(30)d�ys,the dv�rners shall a(low th�City of Renton�o enter for the sole pa�rpase af
inspecting drainage facilities. fn lieu af ins�ection by the Ci�ky,the Owners may elect to engage
a licensed civil engineer registered in the state of Washington who has expertise in drainage to
inspeet the drainage faeili�ies and provide a �nrritten report describin�; their eondifian. If the
engineer option is chosen,the Owners shaBl provid�written notice ta the City af Renton within
fifteen (15j days t�f receiving the City's notice of inspeetion.lNithin thirty(30)days of giving this
notice,the(7�rners,or engineer on behalf of tlle Ovvners,shall provide the engineer's report to
the City of Renton. If the reporfi is not provided in a tirrrely manner as specified above,the City
a�f Renton rnay inspeck the drainage faciliti�s�ithaut furfiher notice.
3. If City of Rentora det�rrnines from its inspection, or frcam �n en�ineer's report provided ira
accordance vvith Paragraph 2,that rrtaintenance, repair, restoration, and/or mitigation work is
required to be done to any of the drainage facilities, City of Renton shall natify the Ovvners of
the specific mainfenance, repair, restoration, andjor mitigatoon work {"Work"} reqtaired
purstaant to the Rentun Municipal Code. The City shal{ also set a reasonable deadline for th�
O�nrners to com�lete the Work, or to provide an engineer's report that uerifies comgal�tion of
the W�rk. After the deadline has passed, the Owners shafl aflow the City aceess to re-ins�ect
the drainage facilities unfess an en�ineer's report has been provided verifying completion of
the �1lork. If the Work is not completed within the time frame set by the Cityy the City may
initiate an enfarcern�r►t actian and/or perf�rrn the Work and hereby is �i�ten access to the
Property far saach purposes. Writter� notice will b� sent to the �wners stating the City's
intention to perform such Wark.This Work will not commence�ntil at least seven(7)days after
such notice is mailed. If, within the sofe discretian of' the City, there exists an imminent or
pres�nt danger, the seven (7) day notice period will be waived and Work will begin
imrra�diately.
4. The C)vuners shall assume all responsibility far the cost of any�(ark, ar any measures taken by
the Citye to address concfitions as describec! ir� Paragraph 3. 5uch responsibilify shall includ�
reimbursement�o the City wi�hin thirty(3�)days af the receipt of the invoiee for any such�A/ork
perfs�rmed. Overdue payments will rec�uire payment of interest at th� maximurx� legal rate
allowed by RCW 19.52.020 (currently��relve percent (12�}�. If the City initiates iegal action tc�
enforce this agreement, the pr�vailing party in such action is entitled to recover reasonable
litigation costs and attorne�'s fe�s.
5. The Ov�rners are requir�d to obtain written approval from City of Renton prior to filling, piping,
cutting, ar removing vegetation (except in roufine landsca�e maintenance} in apen vegetated
stormwater facilities (such �s swales, channels, ditches, ponds, etc.}, ar peeforrr�ing �ny
alterations or modificafiions to the drainage facflities referenced in this Dec6aration of Covenant.

6. Any natice ae�consent rec�uired ta be given or otherwise prov'sded for by th� pravisions of this
Agreement shalf be effective upon personal de{►�oer�!,or three(3)days after mailing by Certified
Mail, return receipt requested.
7. V�/ith regard�o the matters�ddressed herein,this agreem�nt canstitutes the entire agreement
between the parties, and supersedes �61 prior discussions, negatiations, and all agreerrrents
whatsoever v�rhether oral or written.
8. This Declaration �f �ovenant is intended to protect th� value and desirability and prarnote
efficierrt and efFective managerrsent of surFace water drainage af the real property described
abov�, and shall inure to the benefit af all the citizens of the Cit�r of Rentan and its suceessars
and assigns. This Declaration of Covenar�t shalB raan with the land and be binding upon
Grantor(s), and t�ranta�r`s(s')successors in interest,and assigns.
9. This Declaration of Coveraant may be terminated by ex�cution of a vvri�tfen agreement by the
Owners and the City that is recorded by Kin�Co�nty in its real property r�cords.
