The proposed fence is near the center of the parcel within the side yard area of the property at 225 SW 29th St (APN 1253800040) to securely separate the northern tenant space of the building from the southern tenant space (Exhibit 2). Access to the southern space would remain off of SW 34th St and access to the northern tenant space would remain via SW 29th St through the abutting property (parcel no. 1253800090) that is also owned by LBA Realty | LBA Logistics. The property is located within the Heavy Industrial Zone (IH) and is developed with a warehouse facility. The fence would be constructed outside of the clear vision area and parking stalls designated for each tenant’s side of the building are to be maintained. The design and materials of the fence are proposed to match the existing chain link fence at the perimeter of the commercial property as well as existing security gates and will not detract from the visual quality of the environment (Exhibit 4). Analysis: City staff agrees with the applicant's justification (Exhibit 4) for barbed wire and concurs that the proposed fence strikes an appropriate balance between preserving private space and protecting the safety of the tenants while not detracting from the visual characteristics of the neighborhood. Therefore, staff recommends approval of this Special Fence Permit request as submitted. The administrative land use decision will become final if the decision is not appealed within 14 days of the decision date. APPEAL: Due to Governor Jay Inslee’s Proclamation 20 -25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. If the situation changes such that the City Clerk’s Office is open when you file your appeal, you have the option of filing the appeal in person. RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be reopened by the approval body. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation of fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame.
