� the City of Renton,hereinafter called the Grantor,and HING COiJNTY,WASHINGTON,hereinafter
a called the Grantee.

WITNESSETH:

`� WHEREAS,the Grantor represents and warrants to be the owner of that certain parcel of land
� described as follows:

`" The southwest quarter of the southwest quarter of the southwest quarter of Section 15,
Township 23 North,Range 5 East,W.M.,less coal and mineral rights and less the following
described nortion: Beginning at a noint on the south line of said Subdivision, 147 feet East of the
southwest corner of said Section 15; thence North 57°47'10"West to the centerline of a creek
and the True Point of Beginning;thence South 57°47'10"East to the south line of said section;
thence North 27°37'S0" East,72.02 feet;thence South 57°47'10" East, 69.38 feet;thence South
27°37'S0"West to the south line of said section; thence West along said south line to the
centerline of said creek; thence northerly along said centerline to the True Point of Beginning.
WHEREAS,the Crrantee is about to perform certain improvement work on Maplewood Creek.
NOW,I�REFORE,in consideration of the premises,the Grantor hereby grants to the Grantee,by
this Agreement,the right to locate equipment and materials on the above-described land for the purposes of
carrying on said construction activities consistent with the purposes of the project,to include placement of
large woody debris and boulders in the stream corridor for channel stabilization and fish passage
enhancement.

WHEREAS,the Grantee herein agrees to restore those areas affected by said constr-uction activities.
The Grantee herein agrees to be responsible for the restoration,cleanup,and repair of damaged areas used
for staging and construction. The Grantee shall perform restoration,cleanup,and repair of damaged areas
affected by said construction to the Crrantor's acceptance.
WHEREAS,it is agreed that by acceptance of this easement,the Grantee agrees to hold the Grantor
harmless from loss,cost,or damage resulting from the use of said easement,except only to the extent of the
Grantee's negligence,or concurrent negligence by both parties.
WHEREP.S,the Crrantor will notify the Crrantee of changes in ownership within thirty(30)days of
transfer. In the event of such transfer of ownership,the Grantor shall provide a copy of this Agreement to
the suvCPP�i�nU�u�?er�r:or to such transf�r. .
NOW,THEREFORE,this Agreement shall remain in existence until such time as the Grantee will
have fully carried out the original conshuction and monitoring necessary to complete the project. The
proposed construction will be completed by the end of March 2000,but in any event the Agreement will
terminate on December 31,2005. After project construction(in 2000),access will be limited to project
monitoring,and the Grantor will perform any necessary maintenance of only the portion that is constructed
in the Temporary Construction Easement area. The portion of the project constructed outside the City
(upstream of the easement area)will be King County's responsibility to maintain.
