5985CITYOFRENTON,WASHINGTONORDINANCENO.5985ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSECTION4-1-210OFTHERENTONMUNICIPALCODERELATEDTOWAIVEDFEES;LIFTINGTHEWAIVEDFEESMORATORIUMESTABLISHEDBYORDINANCE5973;PROVIDINGFORSEVERABILITY;ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,onApril6,2020,viaOrdinanceNo.5967,theCityCounciladoptedamoratoriumordinanceentitled“AnOrdinanceOfTheCityOfRenton,Washington,DeclaringAMoratoriumOnLandUseApplicationsForLargeResidentialProjects(150DwellingUnitsOrMoreInAProject)WithinTheSunsetArea;DeclaringAMoratoriumOnApplicationsForWaivedFeesForLargeResidentialProjects;SettingForthFindingsOfFactInSupportOfSaidMoratoriums;ProvidingForSeverability;DeclaringAnEmergency;AndEstablishingAnImmediateEffectiveDate.”(Hereinafter,“Ordinance5967”);andWHEREAS,althoughOrdinance5967alsocoveredtopicsotherthanwaivedfees,atitsSectionIIIOrdinance5967imposedamoratoriumon“thesubmission,acceptance,processingorapprovalofanyapplicationsforWaivedFees(RMC4-1-210)forLargeResidentialProjects,”with“LargeResidentialProjects”definedasprojectsinvolving150dwellingunitsormore;andWHEREAS,Ordinance5967wasscheduledtoexpirebyitstermsonOctober6,2020.OnOctober5,2020,viaOrdinanceNo.5982,theCityCouncilextendedpartofthemoratoriumestablishedinOrdinance5967,buttheCityCouncildidnotextendthewaivedfeesmoratoriumfoundatSectionIIIofOrdinance5967.Therefore,thewaivedfeesmoratoriumforLargeResidentialProjectsthatwasestablishedinOrdinance5967expiredonOctober6,2020;andWHEREAS,althoughthemoratoriumestablishedinOrdinance5967isnolongerineffectastowaivedfees,acity-widewaivedfeesmoratoriumdoesremainineffect.Thisisbecauseon1 ORDINANCENO.5985June22,2020,theCityCounciladoptedabroadermoratoriumonwaivedfeesapplicationsviaOrdinanceNo.5973entitled“AnOrdinanceOfTheCityOfRenton,Washington,DeclaringAMoratoriumOnApplicationsForWaivedFees(RMC4-1-210)DueToEconomicConsiderationsRelatedToTheCOVID-19Pandemic;ProvidingForSeverability;DeclaringAnEmergency;AndEstablishingAnImmediateEffectiveDate.”(Hereinafter,“Ordinance5973”);andWHEREAS,Ordinance5973imposedamoratoriumon“thesubmission,acceptance,processing,orapprovalofanyapplicationforwaivedfees(RMC4-1-210);”andWHEREAS,SectionIIIofOrdinance5973providesthat“[t]hemoratoriumimposedhereinshallbeineffectuntilDecember22,2020,unlessendedearlierbysubsequentCityCouncilaction,orunlesssubsequentlyextendedbytheCityCouncilpursuanttostatelaw;”andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,includingconsiderationoftheeconomicissuesrelatedtowaivedfeesthathadbeenraisedbytherelevantmoratoriums.ThematterwasconsideredbythePlanningCommission;andWHEREAS,pursuanttoRCW36.70A.106,onMay5,2020,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;andWHEREAS,thePlanningCommissionheldpublichearingsonJune3,2020andJuly1,2020,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:2 ORDINANCENO.5985SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Section4-1-210oftheRentonMunicipalCodeisamendedasfollows:4-1-210WAIVEDFEES:A.GENERAL:TheRentonCityCouncilmayinitsdiscretionapprove,partiallyapprove,ordenyarequesttowaiveanyandallfeesasauthorizedunderthisChapterofTitle4.B.AFFORDABLEOWNER-OCCUPIEDHOUSINGINCENTIVE:1.Purpose:Toencouragethedevelopmentofnewaffordableowner-occupiedhousingintheCitybywaivingcertaindevelopmentandmitigationfeesforeligibleaffordable“ForSale”housingprojects,subjecttoCityCouncilapproval.2.Definitions:InconstruingtheprovisionsotthissubsectionB,thefollowingdefinitionsshallbeapplied:a.“Administrator”meanstheDepartmentofCommunityandEconomicDevelopmentAdministrator,oranyotherCityoffice,departmentoragencythatshallsucceedtoitsfunctionswithrespecttothissubsectionB.b.“Affordablehousing”means,forthcpurposesofhousingintendedforowneroccupancy,residentialhousingthatiswithinthemeansof,setasidefor,andpurchasedbymoderateincomehouseholds.reservedforoccupancyasaprimaryresidencebyeligiblehouseholdswhosemortgagepaymentisnomorethanthirtypercent(30%)ofhouseholdincomeandwhosetotalhousingexpenses3 ORDINANCENO.5985arenomorethanfortypercent(40%)ofhouseholdincome.Housingexpensesforownershiphousingincludemortgageandmortgageinsurance,propertytaxes,propertyinsurance,andhomeowners’dues.c.“Household”meansasingleperson,family,orunrelatedpersonslivingtogether.d.“Medianincome”meansthemedianhouseholdincomeadjustedforhouseholdsizeforKingCounty,asreportedbytheUnitedStatesDepartmentofHousingandUrbanDevelopmenttHUD).IntheeventthatHUDnolongerpublishesmedianincomefiguresforKingCounty,theCitymayuseordeterminesuchothermethodasitmaychoosetodeterminetheKingCountymedianincome,adjustedforhouseholdsize.e.“Moderate-incomehousehold”meansasingleperson,family,orunrelatedpersonslivingtogetherwhoseadjustedincomeisatorbeloweithereightypercent(80%)oronehundredandtwentypercent(120%)ofthemedianincome,asimpliedbycontext.3.EligibilitcCriteria:Uponapplication,theCityCouncilmaygrant,partiallygrant,ordenyarequesttowaivenomorethaneightypercent(80%)ofapplicableimpactfeesanduptoonehundredpercent(100%)ofallotherapplicablefees.Thedecisiontogrant,partiallygrant,ordenyanwaivercxcmptionfromapplicablefeesshallbebasedontheCityCouncil’sconsiderationofthepublicbenefitofthespecificproject,theimpactsoftheprojectonpublicfacilitiesandservices,andtheconsistencyoftheprojectwithadoptedCityplansand4 ORDINANCENO.5985policiesrelatingtoaffordablehousing.Toqualifyforwaivedfees,projectsshallconsistentirelyofnewconstructionwithallofthehousingunitsplattedorcondominium“ForSale”housing,andmeetthefollowingcriteria:a.Theprojectshallincludeaminimumoften(10)units;andb.Theprojectshalldesignateandsellatleastfiftypercent(50%)oftotalhousingunitsasaffordablehousingforhouseholdsatorbeloweightypercent(80%)ofmedianincome,anddesignateandsellanyremaininghousingunitsasaffordablehousingforhouseholdsatorbelowonehundredtwentypercent(120%)ofmedianincome;andc.Affordablehousingunitsforhouseholdswithincomeatorbeloweightypercent(80%)ofmedianincomeshallremainasaffordablehousinginperpetuitythroughacommunitylandtrustorothersimilarmodelacceptabletotheCity;andd.Theapplicant/ownershalldemonstratetheirexperienceand/orabilitytoprovideaffordablehousingandidentifyathird-partyentitywhowilldocumentcompliancewiththeaffordablehousingrequirementsfortheannualreportsdescribedinsubsectionB9ofthisSection.4.ApplicableFees:Foreachsite,amaximumofeightypercent(80%)ofapplicableimpactfeesanduptoonehundredpercent(100%)ofallotherapplicablefeesforuptoonehundred(100)dwellingunitsmaybewaived.a.Feeswhichmaybewaivedare:i.Buildingpermitfees;5 ORDINANCENO.5985ii.Buildingpermitplanreviewfees;iii.Water,surfacewater,andwastewatersystemdevelopmentcharges;iv.PublicWorksplanreviewandinspectionfees;v.Transportationandparksimpactmitigationfees;vi.Fireimpactmitigationfees,totheextentsuchwaiverisauthorizedbyinterlocalagreementwiththeRentonRegionalFireAuthority;vii.Civilplanreviewandinspectionfees;andviiii.Technologysurchargefees.b.FeeswhichmaynotbewaivedareallfeesnotlistedinsubsectionB4aofthisSection,including:i.Fireplanreviewandpermitfees.5.ApplicationandApprovalProcess:ToapplyforwaivedfeesunderthissubsectionB,theapplicant/ownershallapplybysendingawrittenletterdescribingtheprojectby,ataminimum,addressingtheeligibilitycriteriaandrequestingthefeewaivertotheAdministratorortheCommunityDevelopmentandHousingManager,astheAdministrator’sdesignee,priortosubmittingatthetimeofthelanduseapplicationsforeitherbuildingpermitsorcivilconstructionpermitunlessotherwiseapprovedbyCityCouncil.AdditionalinformationmayberequiredbyCityCouncil.Approvedorpartiallyapprovedfeewaiversshallbegrantedbyresolution.6 ORDINANCENO.59856.RestrictiveCovenant:IftheCityCouncilwaivesfeesunderthissubsectionB,allrealpropertysubjecttothewaivershallbeencumberedbyarestrictivecovenantrequiringthattherealpropertybeplattedorrestrictedtocondominiumhousing,thatthehousingunitsdesignatedasaffordablehousingforhouseholdsatorbeloweightypercent(80%)ofmedianincomeshallbemaintainedandsoldasaffordablehousingtohouseholdsatorbeloweightypercent(80%)ofmedianincomeinperpetuityexceptthatthepropertymaybeconvertedtoauseotherthanforlow-incomehousingifthepropertyownerpaysthewaivedapplicablefeesineffectatthetimeofconversion;feesshallbecalculatedandchargedasthoughnewconstructionwereoccurring,andthatthehousingunitsdesignatedasaffordablehousingforhouseholdsatorbelowonehundredtwentypercent(120%)ofmedianincomeshallbeinitiallysoldasaffordablehousingtohouseholdsatorbelowonehundredtwentypercent(120%)ofmedianincome.AfterreviewandapprovalofthefeewaiverbytheCityCouncilandreviewandapprovaloftherestrictivecovenantbytheAdministrator,therestrictivecovenantshallbeexecutedandrecordedattheapplicant/owner’sexpensepriortotheissuanceofanybuildingpermitfortheproject,unlessotherwiseapprovedbyCityCouncil.Iftheapplicant/ownerfailstotimelyexecuteandrecordthecovenant,thefeewaivershallberevokedandtheapplicant/ownershallpayallapplicablewaivedfeesplusinterestaccruedatthestatutoryratefromthedateoftheCityCouncil’sfeewaiver.7 ORDINANCENO.59857.Contract:IftheCityCouncilwaivesfeesforaproject,theapplicant/ownershallenterintoacontractwiththeCity,approvedbytheCityCouncil,regardingthetermsandconditionsoftheprojectunderthissubsectionB.Thecontractshallbeexecutedandrecordedagainstthesubjectrealpropertyattheapplicant/owner’sexpensebeforetheprojectisentitledtoissuanceofaCertificateofOccupancy.Iftheapplicant/ownerfailstotimelyexecuteandrecordthecontract,thefeewaivershallberevokedandtheapplicant/ownershallpayallapplicablefeesplusinterestaccruedatthestatutoryratefromthedateoftheCityCouncil’sfeewaiver.8.Cancellation:Iftheapplicant/ownerorprojectfailstomeetanyrequirementofthissubsectionBaftertheCityCouncilwaivesfees,thefeewaivershallberevokedandtheapplicant/ownershallpayallapplicablefeesplusinterestaccruedatthestatutoryratefromthedateoftheCityCouncil’sfeewaiver.9.AnnualCertificationandReport:Withinthirty(30)daysafterthefirstanniversaryofissuanceoftheproject’sCertificateofOccupancyandeachyearthereafterforthirty(30)years,theapplicant/ownershallfileanannualreportwiththeAdministrator.ThereportshallcontainsuchinformationastheAdministratormaydeemnecessaryoruseful,andshallataminimumincludethefollowinginformation:a.AcertificationthattheprojecthasbeenincompliancewiththeaffordablehousingrequirementsasdescribedinsubsectionsB3bandcofthisSectionsincethedatetheCityissuedtheproject’sCertificateofOccupancyand8 ORDINANCENO.5985thattheprojectcontinuestobeincompliancewiththecontractwiththeCityandtherequirementsofthissubsectionB;b.Abreakdownofthenumberandspecifichousingunitssoldduringthetwelve(12)monthsendingwiththeanniversarydate,asapplicable,tomeettheaffordablehousingrequirementsinsubsectionsB3bandcofthisSection;c.Thetotalsaleamountofeachaffordablehousingunitforhouseholdsatorbeloweightypercent(80%)and/oronehundredtwentypercent(120%)ofmedianincomesoldduringthetwelve(12)monthsendingwiththeanniversarydate,asapplicable;d.Theincomeofeachpurchaserfatthetimeofpurchase)ofanaffordablehousingunitforhouseholdsatorbeloweightypercent(80%)and/oronehundredtwentypercent(120%)ofmedianincomeduringthetwelve(12)monthsendingwiththeanniversarydate,asapplicable;ande.Documentationthatathird-partyentityhasmonitoredtheproject’scompliancewiththeaffordablehousingrequirementsinsubsectionsB3bandcofthisSection,asapplicable.10.Sunset:TheCitywillacceptapplicationsforwaivedfeesunderthissubsectionBuntilcloseofbusinessonDecember31,2021,unlessextendedbyCityCouncilaction.C.AFFORDABLERENTALHOUSINGINCENTIVE:9 ORDINANCENO.59851.Purpose:ToencouragedevelopmentofnewaffordablerentalhousingintheCitybywaivingcertaindevelopmentandmitigationfeesforeligibleaffordablerentalhousingprojects,subjecttoCityCouncilapproval.2.Definitions:InconstruingtheprovisionsofthissubsectionC,thefollowingdefinitionsshallbeapplied:a.“Administrator”meanstheDepartmentofCommunityandEconomicDevelopmentAdministrator,oranyotherCityoffice,departmentoragencythatshallsucceedtoitsfunctionswithrespecttothissubsectionC.b.“Affordablehousing”meansresidentialhousingthatisreservedforoccupancyasaprimaryresidencebyeligiblerentedbyalowincomehouseholdswhosemonthlyhousingcosts,includingrentandutilitiesotherthantelephone(i.e.,anappropriateutilityalIowajçj1donotexceedthirtypercent(30%)ofthehousehold’smonthlyincome.However,ifthehousingprojectisfundedwithfederallow-incomehousingtaxcredits(LIHIC)asprovidedforinSection42oftheInternalRevenueCode,aunitwillbeconsideredaffordablehousingifitisrentedatorbelowtherentalrateforahouseholdatsixtypercent(60%)oftheKingCountymedianincomeundertheLIHTCprogramruleswithadeductionforutilitycosts,ifapplicable.TheKingCountyLIHTCrentsarepublishedannuallybytheWashingtonStateHousingFinanceCommissionandarebasedonunitsizeassumingoccupancyofonepersonforastudiounitandoneandone-half(1.5)personspetbedroom.10 ORDINANCENO.5985c.“Household”meansasingleperson,family,orunrelatedpersonslivingtogether.d.“Low-incomehousehold”meansasingleperson,family,orunrelatedpersonslivingtogetherwhoseadjustedincomeisatorbelowsixtypercent(60%)ofthemedianincome.e.“Medianincome”meansthemedianhouseholdincomeadjustedforhouseholdsizeforKingCounty,asreportedbytheUnitedStatesDepartmentofHousingandUrbanDevelopment(HUD).IntheeventthatHUDnolongerpublishesmedianincomefiguresforKingCounty,theCitymayuseordeterminesuchothermethodasitmaychoosetodeterminetheKingCountymedianincome,adjustedforhouseholdsize.1.“Rentalhousing”meanshousingthatprovidesrentalaccommodationonanontransientbasis.Thisdefinitionincludesrentalaccommodationthatisleasedforaperiodofatleastonemonthbutexcludes,forexample,hotelsandmotelsthatpredominantlyofferrentalaccommodationonadailyorweeklybasis.3.EligibilityCriteria:Uponapplication,theCityCouncilmaygrant,partiallygrant,ordenyarequesttowaivenomotethaneightypercent(80%)ofapplicableimpactfees,anduptoonehundredpercent(100%)ofallotherapplicablefees.Thedecisiontogrant,partiallygrant,ordenyanexemptionfromapplicablefeesshallbebasedonthepublicbenefitofthespecificproject,theimpactsoftheprojectonpublicfacilitiesandservices,andtheconsistencyofthe11 ORDINANCENO.5985projectwithadoptedCityplansandpoliciesrelatingtoaffordablehousing.Toqualifyforwaivedfees,projectsshallconsistentirelyofnewconstructionandmeetthefollowingcriteria:a.Theprojectshallincludeaminimumofeight(8)unitsifintheResidential-i(R-i),Residential-4(R-4),Residential-6(R-6),Residential-S(R-8),Residential-iO(R-10),Residential-14(R-i4),orResidentialMulti-Family(RMF)Zones;ortheprojectshallincludeaminimumofthirty(30)unitsifintheCenterNeighborhood(CN),CommercialArterial(CA),CenterVillage(CV),CenterDowntown(CD),orCommercialOffice(CO)Zone;b.Theprojectshalldesignateandrentonehundredpercent(100%)ofthehousingunits,orifonehundredpercent(100%)affordableunitsisnotallowedonthesiteduetoCVzonerestrictionsthegreatestnumberofaffordabledwellingunitsallowedbytheCVzone,asaffordablehousingforhouseholdsatorbelowsixtypercent(60%)ofmedianincome;c.Forprojectsfundedbythefederallow-incomehousingtaxcreditprogram(LIHTC),incomeaveragingispermittedprovidedallunits,orifonehundredpercent(100%)affordableunitsisnotallowedonthesiteduetoCVzonerestrictionsthegreatestnumberofaffordabledwellingunitsallowedbytheCVzone,areaffordablehousingforhouseholdswithincomeatorbeloweightypercent(80%)ofmedianincome,andtheaveragerentforallhousingunitsdoesnotexceedtherateaffordableforhouseholdswithincomeatorbelowsixtypercent(60%)ofmedianincome;12 ORDINANCENO.5985d.Affordablehousingunitsforhouseholdswithincomeatorbelowsixtypercent(60%)ofmedianincomeshallremainasaffordablehousingforaminimumofthirty(30)years;ande.Theapplicant/ownershalldemonstrateexperienceand/orabilitytoprovideaffordablehousingandidentifyathird-partyentitywhowilldocumentcompliancewiththeaffordablehousingrequirementsfortheannualreportsdescribedinsubsectionC9ofthisSection.4.Fees:Foreachsite,amaximumofeightypercent(80%)ofapplicableimpactfeesanduptoonehundredpercent(100%)ofallotherapplicablefeesforuptoonehundred(100)dwellingunitsmaybewaived.a.Feeswhichmaybewaivedare:i.Buildingpermitfees;ii.Buildingpermitplanreviewfees;iii.Water,surfacewater,andwastewatersystemdevelopmentcharges;iv.PublicWorksplanreviewandinspectionfees;v.Transportationandparksimpactmitigationfees;vi.Fireimpactmitigationfees,totheextentsuchwaiverisauthorizedbyinterlocalagreementwiththeRentonRegionalFireAuthority;vii.Civilplanreviewandinspectionfees;andViii.Technologysurchargefees.13 ORDINANCENO.5985b.FeeswhichmaynotbewaivedareallfeesnotlistedinsubsectionC4aofthisSection,including:i.Fireplanreviewandpermitfees.5.ApplicationandApprovalProcess:ToapplyforthewaivedfeesunderthissubsectionC,theapplicant/ownershallapplybysendingawrittenletterdescribingtheprojectby,ataminimum,addressingtheeligibilitycriteriaandrequestingthefeewaivertotheAdministratorortheCommunityDevelopmentandHousingManager,astheAdministrator’sdesignee,priortosubmittingatthetimeofthelanduseapplicationsforeitherbuildingpermitsorcivilconstructionpermits,unlessotherwiseapprovedbyCityCouncil.AdditionalinformationmayberequiredbyCityCouncil.Approvedorpartiallyapprovedfeewaiversshallbegrantedbyresolution.6.RestrictiveCovenant:IftheCityCouncilwaivesfeesunderthissubsectionC,allrealpropertysubjecttothewaivershallbeencumberedbyarestrictivecovenantrequiringthattherealpropertyshallbemaintainedandtentedasaffordablehousingasdescribedinsubsectionsC3b,canddofthisSectionexceptthatthepropertymaybeconvertedtoauseotherthanforlowincomehousingifthepropertyownerpaysthewaivedapplicablefeesineffectatthetimeofconversion;feesshallbecalculatedandchargedasthoughnewconstructionwereoccurring.AfterreviewandapprovalofthefeewaiverbytheCityCouncilandthereviewandapprovaloftherestrictivecovenantbytheAdministrator,therestrictivecovenartshallbeexecutedandrecordedatthe14 ORDINANCENO.5925applicant/owner’sexpensepriortotheissuanceofanybuildingpermitfortheproject,unlessotherwiseapprovedbyCityCouncil.litheapplicant/ownerfailstotimelyexecuteandrecordthecovenant,thefeewaivershallberevokedandtheapplicant/ownershallpayallapplicablewaivedleesplusinterestaccruedatthestatutoryratefromthedateoftheCityCouncil’sfeewaiver.7.Contract:IftheCityCouncilwaivesleesforaproject,theapplicant/ownershallenterintoacontractwiththeCity,approvedbytheCityCouncil,regardingthetermsandconditionsoftheprojectunderthissubsectionC.Thecontractshallbeexecutedandrecordedagainstthesubjectrealpropertyattheapplicant/owner’sexpensebeforetheissuanceoftheCertificateofOccupancy.Iftheapplicant/ownerfailstotimelyexecuteandrecordthecontract,thefeewaivershallberevokedandtheapplicant/ownershallpayallapplicablefeesplusinterestaccruedatthestatutoryratefromthedateoftheCityCouncil’sfeewaiver.8.CancellationorModification:litheapplicant/ownerorprojectfailstomeetanyrequirementsofthissubsectionCaftertheCityCouncilwaivesfees,thefeewaivershallberevokedandtheapplicant/ownershallpayallapplicablefeeswithinterestaccruedatthestatutoryratefromthedateoftheCityCouncil’sfeewaiver.AftertheCityCouncilwaivesfees,theprojectmaynotbemodifiedtoowner-occupied“ForSale”housingwithouttheadvanceapprovaloftheCityCouncil15
