5994CITYOFRENTON,WASHINGTONORDINANCENO.5994ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,DIRECTINGTHECOMMISSIONINGOFASTREETMURALTHATCONVEYSTHEINDISPUTABLEFACTTHATBLACKLIVESMATTER,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,duringourcountry’shistory,institutionsdevelopedthathaveoppressedBlackpeople,beginninginthe1600swhenenslavedAfricansarrivedascaptivesincolonialAmerica;andWHEREAS,Blackpeopleexperiencedslavelaborfornearly250yearswhichinvolvedadeprivationoflibertyandunspeakableactsofviolence,includingassault,rape,mutilation,andmurder;andWHEREAS,theThirteenth,Fourteenth,andFifteenthAmendmentstotheConstitutionoftheUnitedStatesofAmericawereenactedfollowingtheendofthiscountry’sCivilWar,whichresultedintheabolishmentofthepracticeofslaveryandtheextensionofcivilandlegalprotectionstoBlackpeople;andWHEREAS,despitetheenactmentoftheThirteenth,Fourteenth,andFifteenthAmendments,manystatespersistedinsustaininginstitutionalizedracismbyenactinglawsthatbecameknownasJimCrowlawsperpetuatingtheracistlegalandsocialsystemexistingpriortotheCivilWarandresultedinasystemthatcontinuedtotreatBlackpeopleassecond-classcitizens;and1 ORDINANCENO.5994WHEREAS,theCivilRightsActsof1964and1968guaranteedequalrightsunderlawforallpeoplewithinthejurisdictionoftheUnitedStatesbyprohibitingdiscriminationbaseduponrace,color,andotherprotectedclasses;andWHEREAS,despitetheCivilRightsActsof1964and1968,theimpactsofthehistoryofstate-sanctionedoppressionagainstBlackpeoplepersist;andWHEREAS,althoughBlackpeoplecontinuetoexperienceinequalitiesandbiasesacrossmanyaspectsofdailylivingincluding,butnotlimitedto,housing,education,employment,andhealthasaresultofthiscountry’shistory,laws,andlawenforcementpractices,whichdisproportionatelyerodesthequalityoflifeforBlackpeople,theCityiscommittedtoworkingwithBlackpeopletoacknowledgeandeliminateingrainedandsystematicracialinequities;andWHEREAS,althoughcontinuedandingrainedexplicitandimplicitbiasagainstBlackpeopleresultsnationallyindisproportionateratesofarrest,incarceration,andoverallexposuretothecriminallegalsystemforBlackpeople,theCityanditsPoliceDepartmentarecommittedtoworkingwithBlackpeopletoworktowardequityinthecriminallegalsystem;andWHEREAS,theCityofRenton’sBusinessPlanwasupdatedin2020tocommittoachievingequitableoutcomesforallandtointegrateanti-racismapproachesintoitsdailywork;andWHEREAS,itisindisputablethatBlacklivesmatter;andWHEREAS,achievingequitableoutcomesforallrequiresacknowledgementanddenouncementofalonghistoryofinequitiesinthiscountrythathaveresultedinimplicitbiasesandtheresultingsystematicdevaluationofBlacklives;and2 ORDINANCENO.5994WHEREAS,topromotesuchacknowledgementanddenouncement,theCitywishestocommissionstreetartthatrepresentsandconveystheindisputablefactthatBlacklivesmatter;andWHEREAS,othercitieshavecommissionedsuchartorallowedfortheprivateinstallationofsuchartwithintheirstreets;andWHEREAS,theRentonMunicipalCodeprohibitsunauthorizedencroachmentsorothernon-trafficprivateuseofCityright-of-wayanddoesnothaveamechanismbywhichtoauthorizeprivatepersonstoseekapermittoinstallartonthesurfaceofstreets;andWHEREAS,itremainsimportanttorpublicsafetyandright-of-waymanagementandmaintenancereasonstopreventstreetsurfacesfrombecomingaforumforprivatespeechsothatalterationstostreetsurfacesarelimitedinlocationandtogovernmentpurposes;andWHEREAS,thenecessityanddesirabilityofwidelyconveyingtheindisputablefactthatBlacklivesmatteroutweighsthecostandmaintenanceconsiderationsinprohibitingnon-trafficrelatedtreatmentstothesurfaceofstreets;andWHEREAS,thesafetyreasonsforlimitingthetreatmentofstreetsurfacestotrafficmanagementcanbemitigatedbytheCitycommissioningcarefullydesigned,andplacedartwithCitydesignatedlocations,selectedmaterials,andinclusionofcommunityperspectives;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheMayorordesigneeshallestablishandimplementastreetartselectionprocessthatincludespublicoutreach,inclusionofperspectivesofBlackpeople,andcoordinationbetweentheCity’sArtsCommissionandPublicWorksdepartmenttoselecta3 ORDINANCENO.5994location,artist,anddesignforastreetmuralthatconveystheindisputablefactthatBlacklivesmatter.Themuralshallbedesigned,installed,andlocatedsoastominimizeongoingmaintenanceconcernswhilemaximizingpublicsafetyandtheconveyanceoftheCity’sinclusivemessagethatBlacklivesmatter.SECTIONII.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONIII.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis16thdayofNovember,2020.‘14€%,JasofA.Seth,IyClerkAPPROVEDBYTHEMAYORthis16thdayofNovember,2020.AroPavone,MayorApprovedastoform:ShaneMoloney,CityAttorneyDateofPublication:11/19/2020(Summary)4
