IN CONSIDERATION of the approved City of Renton Utilit�Construction permit
for application fileNo. LUA/SWP U16-005827 relating to the realproperty("Property")
described above,the Grantor(s),the owner(s)in fee of that Property,hereby covenants(covenant)with the
City of Renton, a political subdivision of the state of Washington,that he/she(they)will observe, consent
to, and abide by the conditions and obligations set forth and described in Paragraphs 1 through 10 below
with regard to the Property, and hereby grants(grant) an easement as described in Paragraphs 2 and 3.
Grantor(s)hereby grants(grant), covenants(covenant), and agrees(agree) as follows:
1. The Grantor(s)orhis/her(their)successors in interest and assigns("Owners ofthe described
property") shall at their own cost, operate,maintain, and keep in good repair,the Property's stormwater
facilities and/or best management practices ("BMPs") constructed as required in the approved
construction plans and specifications dated 1-5-17 on file with
the City of Renton and submitted to the City of Renton for the review and approval of permit(s) U16-
005827_ _.The property's stormwater facilities and/or best management practices ("BMPs") are shown
and/or listed on Exhibit B. The property's stormwater facilities and/or BMPs shall be maintained in
compliance with the operation and maintenance schedule included and attached herein as Exhibit C.
Stormwater facilities include pipes, swales,tanks,vaults,ponds, and other engineered structures designed
to manage and/or treat stormwater on the Property. Stormwater BMPs include dispersion and infiltration
devices,native vegetated areas,permeable pavements,vegetated roofs,rainwater harvesting systems,
reduced impervious surface coverage, and other ineasures designed to reduce the ainount of stonnwater
runoff on the Property.
2. City ofRenton shall have the right to ingress and egress over those portions ofthe Property
necessary to perform inspections of the stormwater facilities and BMPs and conduct maintenance
activities specified in this Declaration of Covenant and in accordance with RMC4-6-030.
3. If City ofRenton determines that maintenance or repair work is required to be done to any of
the stormwater facilities or BMPs, City of Renton shall give notice of the specific maintenance and/or
repair work required pursuant to RMC 4-6-030. The City shall also set a reasonable time in which such

4. If at a1�y tim�;the City of Renton reasonably deterrnines that a starmwater ta�ility or�MP an

suecessar°s c�des as applicable and l�er�i�incorpc�rated by reference, the City m�y take pneasures
sp�cified thereim.
5. The t�wners sha11 assurne all res�onsibility for fh� cost of any maintenance c�r re�air wark
completed by the�ity as describ�d ir�Paragrapl� 3 or any n�easures tak�n by th� City to addr�sshazard��s
eanditions as described in Paragc-apl�4. �uch responsibi�xt�shall in�lude rermburs�ment to the �idy
witdain thirty(30} days of the receipt of the invoace for any such work performed. Ov�rdue payments v✓ill
require payment af interest at the �urrent legal rate �s liquidated datriages. If legad action eii�ues, the
prevailing�arty is entitled to recover reasonable liti�;atian costs and attorriey's fees.

Covenant.
7. Any notac� or cans�nt required to be giv�n or rstherwise prc�vided fc�r by th�p�-ov�si�ns ofthis
�greement sh�ll be effective upor��ersc�nal delivery, or three{3) days after rr�aili:n�by Certi�ed Mail,
returr►rec��pt req�est�c�.
8. With r�gard to the matter�s addressed herein,this agreernent constitt�tes the entire agreesnent
bet�vee�tize�arties, and supersedes all prior ciiscussic�7is, negotiatiams, and all agreenrsents v�rhatsoever
whether oral or wt-itten.

C.2.5.3 MAINTENANCE INSTRUCTIONS FOR A RAIN GARDEN
If the rain garden flow control BMP is proposed for a project,the following maintenance and operation
instructions must be recorded as an attactunent to the required declaration of covenaut aud grant of
easement per Requirement 3 of Section C.133(p.G18). The intent of these instsuctions is to explain to
future property owners,the purpose of the SMI'and how it must be maintained and operated. These
instrnctions are intended to be a minimnm;DDES may require additional instrnctions based on site-
specific conditions. Also,as the County gains more experience with the maintenance and operation of
these BMYs,future updates to the instructions will be posted on King County's Surface Water Desigr�
Manual website.
❑ TEXT OF INSTRUCTIONS
Your property contains a storniwater ri�anasenient flow control BMP(best managenient practice)called a
"rain garden,"which was installed to mitigate the stormwater quantity and quality impacts of some or all of
the impervious or non-native pervious surfaces on your property. Rain gardens,also known as
"bioretention,"are vegetated closed depressions or ponds that retain and filter stormwater from an area of
impervious surface or non-native pervious surface. The soil in the rain garden has been enhanced to
encour�ge and Gupport vigorous pl?nt growth th�t ServeG to filter the w�ter�nd sust�in infiltr?tion c�pacity.
Depending on soil conditions,rain gardens may have water in them throughout the wet season and may
overflow during major storm events.
The size, placement,and design of the rain garden as depicted by the flow control BMP site plan and
design details must be maintained and may not be changed without written approval either from the King
County Water and Land Resources Division or through a future development permit from King County.
Plant materials may be changed to suit tastes, but chemical fertilizers and pesticides must not be used.
Mulch may be added and additional compost should be worked into the soil over time.
Rain gardens must be inspected annually for physical defects. After major storm events,the system
should be checked to see that the overFlow system is working properly. If erosion channels or bare spots
are evident,they should be stabilized with soil,plant material,mulch,or landscape rock. A supplemental
watering program may be needed the first year to ensure the long-term survival of the rain garden's
vegetation. Vegetation should be maintained as follows: 1)replace all dead vegetation as soon as
possible;2)remove fallen leaves and debris as needed;3)remove all noxious vegetation when
discovered;4)manually weed without herbicides or pesticides;5)during drought conditions,use mulch to
prevent excess solar damage and water loss.
