5997CITYOFRENTON,WASHINGTONORDINANCENO.5997ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,EXTENDINGANDAMENDINGTHEINTERIMZONINGCONTROLESTABLISHEDBYORDINANCENO.5974INRESPONSETOTHEOPERATIONALLIMITSONBUSINESSESDURINGTHECOVID-19DECLAREDPUBLICHEALTHEMERGENCYBY(1)EXTENDINGTHETEMPORARY“ECONOMICRECOVERYREVOCABLERIGHT-OF-WAYPERMIT”FORBUSINESSES;(2)EXTENDINGTHETEMPORARY“ECONOMICRECOVERYSIGNS”FORBUSINESSES;AND(3)AMENDINGTHEINTERIMZONINGCONTROLTOWAIVETHEREQUIREMENTTOOBTAINATEMPORARYUSEPERMITFORTHETEMPORARYEXPANSIONOFABUSINESSINTOANADJACENTVACANTSPACEINAMULTI-TENANTBUILDING;AUTHORIZINGTHETEMPORARYDESIGNATIONOFALIMITEDNUMBEROFEXISTINGPUBLICPARKINGSTALLSWITHINTHECENTERDOWNTOWNZONINGDISTRICTTOSUPPORTPARKINGFORSHORT-TERMCURBSIDEPICK-UPORTOGOORDERSFROMBUSINESSES;TEMPORARILYWAIVINGPARKINGFEESFORPARKINGFORPERIODSOFUPTO10HOURSWITHINTHECITY’SCITYCENTERPARKINGGARAGELOCATEDAT655SOUTH2NDSTREET;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,onJuly13,2020,inresponsetobusiness-relatedimpactsduetothenovelcoronavirus(COVID-19)pandemic,theCityCounciladoptedinterimzoningcontrolsviaOrdinanceNo.5974,validthroughDecember31,2020orthedatethattheCityentersPhase4oftheGovernor’sSafeStartplan,whicheveroccurredfirst;andWHEREAS,OrdinanceNo.5974establishedanewtypeoftemporaryright-of-waypermitknownasan“EconomicRecoveryRevocableRight-of-WayPermit”whichissimilartoexistingright-of-waypermitsbutdoesnotcarryapermitfeetoassistbusinessesthatareabletousepublicright-of-wayand/ortheirprivateparkinglotareasinordertoexpandtheareawithinwhichcustomerscouldbeserved—inkeepingwithappropriatesocialdistancingstandardsandotherpublichealthguidelines—inordertohelpstrugglingbusinessesincludingrestaurantssurviveand1 ORDINANCENO.5997helpkeeptheemployeeswhodependonthejobsthathavebeenimpactedandjeopardizedbythecoronavirusshut-downsemployed;andWHEREAS,parkletsandprefabricatedoutdoorspacesmeettheintendedpurposeof“expandingtheareawithinwhichabusinessmayprovidegoodsorservicestocustomerswhilekeepingwithpublichealthguidelines”thatservedasthebasisforestablishingEconomicRecoveryRevocableRight-of-WayPermits,and,thus,theCityCouncilwishestoallowforthemasanelementofencouragingeconomicrecoveryintheCity;andWHEREAS,OrdinanceNo.5974alsoestablishedandtemporarilyallowedbusinessestoplacesignsknownas“EconomicRecoverySigns”intheformofA-FrameSignsandEventSigns,throughDecember31,2020;andWHEREAS,theCityhasnotyetenteredPhase4oftheGovernor’sSafeStartplan,andtheCityCouncilhasdeterminedthatthereisaneedtoextendbeyondDecember31,2020theinterimzoningcontrolsestablishingtheEconomicRecoveryRevocableRight-ofWayPermitandestablishingandallowingEconomicRecoverySigns;andWHEREAS,theCityCouncilhasfurtherconsideredtheimpactstoCitybusinessesandthepubliccausedbytheCOVID-19pandemic.Asaresult,theCityCouncilhasdeterminedthatthereisaneedtotemporarilywaivetherequirementtoobtainaTemporaryUsePermitforthefollowingactivity:thetemporaryexpansionofabusinessintoanadjacentvacantspaceinamulti-tenantbuildingincompliancewiththeGovernor’sSafeStartplanandpublicheathguidelinesforCOVID-19;and2 ORDINANCENO.5997WHEREAS,theCityCouncilheldapublichearingonDecember7,2020,toconsiderasix-monthextensionofandamendmenttotheinterimzoningcontrolsestablishedinOrdinanceNo.5974;andWHEREAS,theCityCouncilhasfurtherdeterminedthatdesignatingalimitednumberofexistingpublicparkingstallswithintheareazonedCenterDowntown(CD)asshort-termparkingforcurbsidepick-uportogoordersmayalsoassistthestrugglingdowntownbusinesscommunity,andtheCityCouncilfurtherfindsthatthereisnotacomparableneedtodesignateshort-termparkingforbusinessesoutsideoftheareazonedCD;andWHEREAS,theCityCouncilhasfurtherdeterminedthattoaccommodatetheanticipatedincreasesinshort-termparkingintheCenterDowntownandtoassistthestrugglingdowntownbusinesscommunity,hourlyparkingfeesintheCity’sCityCenterParkingGaragelocatedat65552FSt.shouldbetemporarilywaivedforparkingperiodsofupto10hours;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINasfollows:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportoftheinterimcontrolsadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.CouncilherebyextendsandamendstheinterimzoningcontroltemporarilyestablishingthenewpermitknownasanEconomicRecoveryRevocableRight-ofWayPermitintheCityofRenton.EconomicRecoveryRevocableRight-of-WayPermitsshallbe:(1)Availabletobusinessesseekingtousethepublicright-of-wayfrontingtheirbusinessesand/ortheirprivateparkinglotsabuttingtheirbusinessestoexpandtheareawithinwhich3 ORDINANCENO.5997customersareserved,suchasforsidewalksales,sidewalkpick-up,parkletswithoutstructuralcomponents,pre-fabricatedandengineeredparklets,and/oroutdoorrestaurantseating.ObtaininganEconomicRecoveryRevocableRight-of-WayPermitforsuchusesshallnotexcuseabusinessfromcomplyingwithapplicablepublichealthrequirementsandguidelines,includingsocialdistancing;and(2)IneffectfromthedateofissuancethroughJune7,2021orthedatethattheCityentersPhase4oftheGovernor’sSafeStartplan,whicheveroccursfirst;and(3)Subjecttothesameapplicationandreviewprocessasarevocableright-of-waypermitissuedunderRMC4-8-120andRMCChapter9-2,exceptthatnoapplicationfeeorpermitfeeshallberequired;and(4)Subjecttoleaseholdexcisetaxtothesameextentasarevocableright-of-waypermitissuedunderRMC4-8-120andRMCChapter9-2.(5)ForEconomicRecoveryRevocableRight-of-WayPermitsthatwereapprovedand/orissuedbetweenJuly8,2020andDecember31,2020andthatwerestillvalidandunexpiredasoftheeffectivedateofthisordinance,thefollowingshallapply:TheperiodofvaliditythatwouldotherwiseapplyunderthestandardexpirationdateslistedinthisordinanceisextendeduntilJune7,2021orthedatethattheCityentersPhase4oftheGovernor’sSafeStartplan,whicheveroccursfirst.SECTIONIII.Asaninterimzoningcontrol,CouncilherebyextendstheperiodforthenewsigntypeknownasanEconomicRecoverySignintheCityofRenton,byextendingthesameregulationsestablishedunderOrdinanceNo.5974forsuchsigns.Accordingly,EconomicRecoverySignsshallcontinuetobesubjecttothefollowingforanextendedperiodasstated:4 ORDINANCENO.5997(1)Allowedforbusinessestoadvertiseeconomicrecovery-relatedeventssuchasgrandre-openingsorexpandedservicesorcapacities;and(2)AllowedintheformofA-FrameSignsandEventSigns,asfurtherspecifiedbelow;and(3)IfanA-FrameSign,subjecttothefollowingstandardsandrequirementsdrawnfromRMC4-4-100J.5:a.Number:i.WithinCityCenterSignRegulationArea:Onlyoneofthesesignsispermittedperbusinessperstreetfrontage.ii.ElsewhereintheCity:Oneofthesesignsispermittedperbusinessperstreetfrontageand,inaddition,anadditionalsignispermittedtobelocatedabuttingthebusinessandbuildingtowhichthesignrelates.b.LocationRequirements:I.PermittedLocation:(1)WithinCityCenterSignRegulationArea:A-framesignsmustbeplacedagainstthebuildingandbusinesstowhichthesignrelates.(2)ElsewhereintheCity:A-framesignsmaybelocatedonthepublicsidewalkabuttingthebusinesssiteand/orwithinthelandscapingareaonorabuttingthebusinesssite,however,A-framesignscannotbeplacedinthelandscapestripbetweenthecurbandouteredgeofthepublicsidewalk.Additionally,forbusinesseslocatedwithinshoppingcenters,anadditionalA-framesignmaybeplacedagainstthebuildingandbusinesstowhichthesignrelates.5 ORDINANCENO.5997ii.PedestrianClearance:Aminimumoffourfeet(4’)ofunobstructedsidewalkareabetweentheouteredgeofthesignandthestreetcurbisrequired.iii.ClearVisionArea:NosignshallbelocatedastoposeadangerandviolatetheclearvisionareaspecifiedinsubsectionRMC4-4-100.C.6,ProhibitedSigns.Whereatrafficvisionhazardiscreated,theCitymayrequireamodificationtotheheightorlocationofasigntothedegreenecessarytoeliminatethehazard.c.Size:Signsshallbenolargerthanthirty-twoinches(32”)wideandthirty-sixinches(36”)tall.U.ConstructionSpecificationsandMaterials:Thesignmustbeprofessionallymanufacturedofdurablematerial(s).Nolightingorattachments,suchasballoonsarepermitted.e.MaintenanceandAppearance:SignsmustbemaintainedinaccordancewiththeprovisionsofRMC4-4-100.D.3,SignMaintenanceRequired,andsubsectionRMC4-4-100.D.4,AppearanceofSigns.f.AlterationofLandscapingProhibited:NolandscapingmaybedamagedormodifiedtoaccommodateanA-framesign.TheCitymayrequirereplacementofanydamagedlandscapingpursuanttoRMC4-4-070.Q,DamagedLandscaping.g.RemovaluponCloseofBusinessRequired:A-framesignsshallnotbedisplayedduringnonbusinesshours.6 ORDINANCENO.5997h.ProofofInsuranceandHoldHarmlessAgreementforSignsonPublicRight-of-Way:BeforeplacinganysuchA-Framesign,thebusinessmustprovidetheCommunity&EconomicDevelopmentDepartment’sDevelopmentServicesDivisionwith(1)proofofgeneralcommercialliabilityinsurance(certificateofliabilityinsurance)meetingtherequirementsofRMC4-4-100.L.4and(2)asignedholdharmlessagreementthatspecifiesthattheownerofthesignwilldefend,indemnify,andholdtheCityharmlessforanyloss,injuries,damage,claimsorlawsuit,includingattorney’sfeesthatarisefromthesign.i.ConfiscationofSigns:SignsthatdonotcomplywiththeseprovisionsmaybeconfiscatedbytheCity;and(4)IfanEventSign,subjecttothefollowingstandardsandrequirementsdrawnfromRMC4-4-100.i.6:a.[Intentionallyomitted.]b.TypesofEventSignageAllowed:Anycombinationofthefollowingtypesofsignagearepermitted:balloons,pole/wallstrungandwall-hungbannersnotexceedingonehundred(100)squarefeeteachinsize,pole-hungbannersnotexceedingtwenty(20)squarefeeteachinsize,flags,inflatablestatuary,pennants/streamers,searchlights,windanimatedobjects,andothersimilaradvertisingdevicesapprovedbytheDevelopmentServicesDivision.Rigidportablesignsarealsoallowedprovidedthesignisamaximumofthirty-two(32)squarefeetinareaononefacepersignnotexceedingsixfeet(6’)inheight.RigidportablesignsarelimitedtooneperStreetfrontageoutsidetheAutomall.7 ORDINANCENO.5997c.[Intentionallyomitted.]U.[Intentionallyomitted.]e.PlacementLimitationsforEventSigns:i.Roof:Nosignoradvertisingdeviceshallbeplacedontopofarooforextendverticallyabovethefasciaofthebuilding.ii.PerimeterStreetLandscaping:Eventsignageshallnotbelocatedwithinrequiredperimeterstreetlandscaping;and(5)AllowedwithoutapermitandwithoutafeethroughJune7,2021.SECTIONIV.Asaninterimzoningcontrol,CouncilherebytemporarilywaivestherequirementtoobtainaTemporaryUsePermitforthetemporaryexpansionofabusinessintoanadjacentvacantspaceinamulti-tenantbuildingincompliancewiththeGovernor’sSafeStartplanandpublicheathguidelinesforCOVID-19.Allotherpermitsrequiredforsuchexpansionsshallcontinuetoberequired.SECTIONV.CouncilherebytemporarilyapprovesthedesignationbytheAdministratorofthePublicWorksDepartment,ordesignee,ofalimitednumberofexistingpublicparkingstallswithintheCenterDowntown(CD)zonetosupportshort-termparkingforcurbsidepick-uportogoordersfrombusinesseslocatedintheCitycenter.SECTIONVI.CouncilherebytemporarilywaivesthefollowingparkingfeesestablishedinSectionIIIoftheCityofRentonFeeScheduleforthefollowingparkingperiodswithintheCityCenterParkingGarage:•Zero(0)totwo(2)hours;•Two(2)tofour(4)hours;8 ORDINANCENO.5997•Four(4)tosix(6)hours;and•Six(6)to(10)hours.SECTIONVII.TheMayororhisdesigneeisauthorizedtoimplementanyandalladministrativeproceduresnecessarytocarryoutthedirectivesofthislegislation.SECTIONVIII.ApublichearingwasheldonDecember7,2020.SECTIONIX.Theinterimcontrolsextended,amended,andestablishedhereinshallbeineffectuntilJune7,2021orthedatethattheCityentersPhase4oftheGovernor’sSafeStartplan,whicheveroccursfirst,unlessearlierliftedorsubsequentlyextendedbyactionoftheCityCouncil.SECTIONX.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONXI.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.ThisordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis7thdayofDecember,2020.Jaerk9
