CITYOFRENTON,WASHINGTONORDINANCENO.6001ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,AMENDINGSECTION4-1-045OFTHERENTONMUNICIPALCODEBYRENAMINGTHESECTIONFROM“VESTING”TO“VESTINGREGULATIONS,”ELIMINATINGSHORELINEDEVELOPMENTPERMITSANDCONDITIONALUSEPERMITSFROMTHELISTOFAPPLICATIONSTHATVESTATCOMPLETEAPPLICATION,CLARIFYINGDURATIONOFVESTING,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,withthisOrdinance,theCityprimarilyseekstonarrowandclarifythescopeoftheCity’svestinglawsbyeliminatingShorelineDevelopmentPermitsandConditionalUsePermitsfromthelistofapplicationsthatvestuponcompleteapplication;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,thePlanningCommissionheldapublichearingonSeptember16,2020,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;andWHEREAS,pursuanttoRCW36.70A.106,onOctober6,2020,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdevelopmentregulations;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.Subsection4-1-045oftheRentonMunicipalCodeisrenamedfrom“Vesting”to“VestingandDurationofApprovalsRegulations.”1 ORDINANCENO.6001SECTIONIII.Subsection4-1-045.C.1,oftheRentonMunicipalCodeisamendedasshownbelow.Allotherprovisionsin4-1-045.Cremainineffectandunchanged.C.VESTINGAPPLICABILITY:1.ThisSectionappliesto,andvestingoccurswith,thefilingofacompleteapplicationandpermitapprovalsrequiredbytheCityofRentonpursuanttoTitleIV,includingandlimitedtoofthefollowing:a.Buildingpermits(includingbutnotlimitedtocombopermits,gradinglicenses,andsignpermits);b.Preliminaryplats,finalplats,shortplats;andc.Shorelinedevelopmentpermits;uscpermits;andec.AnyotherlandusepermitapplicationthatisspecificallyidentifiedbytheWashingtonStatelegislatureasbeingcoveredbythevestedrightsdoctrine.2.Vestingdoesnotapplytothefollowing:a.Incomplete,invalid,inaccurateordefectivebuildingpermitapplications;b.Feesortaxes,including,butnotlimitedto,impactfees;c.Pre-applicationplans;d.AnyotherapplicationorpermitnotspecificallyidentifiedinthissubsectionC,asitexistsormaybeamended;e.Usesnotspecificallydisclosedintheapphcation;or2 ORDINANCENO.6001f.Anyapplicationorpermitthatmayreasonablyresultinathreattothepublichealth,safety,orwelfareofthecommunity.TheCity’sexerciseofpolicepowertoprotectthepublichealthandsafety,and/orgeneralwelfareimmediatelyextinguishesany“vestedright.”SECTIONIV.Subsection4-1-045.F,oftheRentonMunicipalCodeisamendedasfollows:F.DURATIONOFAPPROVALSVESTING:1.BuildingPermits:Developmentofabuildingshallbebasedonthecontrolscontainedintheapprovedpermitapplication,andpermitsaresubjectto7VestingrightsapplicablctobuildingpermitapplicationswouldexpirepursuanttopermitexpirationperiodsidentifiedintheInternationalBuildingCode(IBC)andadoptedbyreferencehereininRMC4-5-050,asitexistsormaybeamended.2.PreliminaryPlot:DevelopmentofanapprovedpreliminaryplotshallbebasedonthecontrolscontainedintheHearingExaminer’sdecision.AfinalplotmeetingalloftherequirementsofthepreliminaryplotapprovalshallbesubmittedwithinthetimeframespecifiedinRMC47OSOL,unlessadifferenttimelimitationwasspecificallyauthorizedinthefinalapproval.2.FinalPlat:Thelotsinafinalplatmaybedevelopedbythetermsofapprovalofthefinalplat,andthedevelopmentregulationsineffectatthetimethepreliminaryplatapplicationwasdeemedcompleteforaperiodoffive(5)yearsfromtherecordingdateunlesstheCityfindsthatachangeinconditionscreatesaseriousthreattothepublichealth,safetyorwelfare.3 ORDINANCENO.60011.ConditionalUcPermit:Thcuseauthorizc-shallbcallowedtodevelopforaperiodoftwo(2)yearsfromtheeffectivedateofthepermitapprovalunlessadifferenttimelimitationwasspecificallyauthorizedinthefinalapproval.ThedevelopmentofanapprovedconditionalusepermitshallbegovernedbythetermsofapprovalofthepermitunlesstheCityfindsthatachangeinconditionscreatesaseriousthreattothepublichealth,safetyorwelfare.3.PermitsAssociatedwithaPreliminaryPlat:Permitapplications,suchasPlannedUrbanDevelopments(PUD)applicationsLthatareapprovedasacompaniontoapreliminaryplatapplication,shallremainvalidforthedurationofthepermitapplicationtypeorpreliminaryandfinalplatasprovidedinsubsectionsF2and3ofthisSection,whicheverislongerastheyexistormaybeamended.64.ShortPlat:Thelotsinashortplatmaybedevelopedbythetermsandconditionsofapproval,andthedevelopmentregulationsineffectatthetimetheapplicationwasdeemedcompleteforaperiodoffive(5)yearsfromtherecordingdateunlesstheCityfindsthatachangeinconditionscreatesaseriousthreattothepublichealth,safetyorwelfare.;.noreiineueveiopment,-vi.i...julpiu’cdShorelinePermitshallballowedtodeveloppursuanttothetimelimitationslistedinRMC49190J(TimeRequirementsforShorelinePermits),asitexistsormaybeamended.Thedevelopmentofanappro’.cdshorelinepermitshallbegovernedbythetermsof4 ORDINANCENO.6001createsaseriousthreattothepublichealth,safetyorwelfare.g.AllapprovalspermitsdescribedinthisSectionshallbevestedforthespecificuse,density,andphysicaldevelopmentidentifiedinthepermitapproval.SECTIONV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVI.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis14thdayofDecember,2020.JasofA.Seth,C/CIerkAPPROVEDBYTHEMAYORthis;4thdayofDecember,2020.ArPavone,Mayor5
