6002CITYOFRENTON,WASHINGTONORDINANCENO.6002ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,REVISINGACCESSORYDWELLINGUNIT(ADU)REGULATIONSBYAMENDINGSUBSECTIONS4-2-11O.C,4-2-11O.E,AND4-2-116.B.2OFTHERENTONMUNICIPALCODE,PROVIDINGFORSEVERABILITY,ANDESTABLISHINGANEFFECTIVEDATE.WHEREAS,theCityseekstoreducebarrierstoAccessoryDwellingUnit(ADU)developmentandstreamlinetheapplicationprocesswiththeintentofdiversifyingandincreasinghousingopportunitiesinRenton;andWHEREAS,thismatterwasdulyreferredtothePlanningCommissionforinvestigationandstudy,andthematterwasconsideredbythePlanningCommission;andWHEREAS,thePlanningCommissionheldapublichearingonSeptember16,2020,consideredallrelevantmatters,andheardallpartiesinsupportoropposition,andsubsequentlyforwardedarecommendationtotheCityCouncil;andWHEREAS,pursuanttoRCW36.70A.106,onOctober6,2020,theCitynotifiedtheStateofWashingtonofitsintenttoadoptamendmentstoitsdev&opmentregulations;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.AllportionsoftheRentonMunicipalCodeinthisordinancenotshowninstrikethroughandunderlineeditsremainineffectandunchanged.SECTIONII.TheMaximumNumberandSizeandMaximumWallPlateHeightregulationsinsubsection4-2-110.CoftheRentonMunicipalCodeareamendedasshownbelow.Allotherprovisionsin4-2-110.Cremainineffectandunchanged.1 ORDINANCENO.6002asidentifiedinRMC4-2-1OA,DevelopmentStandardsforResidentialZoningDesignations.ADUsshallnotbepermittedbetweentheprimarystructureandthestreetunlessapprovedintheConditionalUsePermitprocess.RCandR-125ft.R4,R-6andR-85ft.R-lOandR-144ft.RearYardRC,R-1,R-4,R-6,R-8,5ft.R-10andR-14Whenlocatedwithin10ft.oftherearpropertyline,atleast25%ofthelineallengthoftherearyardshallremainunoccupiedfromaccessorydwellings,exceptwhentherearpropertylineabutsanalley.ClearVisionAreaRC,R-1,R-4,R-6,R-8,JInnocaseshallastructureover42in.inheightintrudeintotheR-10andR-14J20_ft.clearvisionareadefinedinRMC4-11-030.CRITICALAREASGeneralRC,R-1,R-4,R-6,R-8,SeeRMC4-3-050,CriticalAreasRegulations,and4-3-090,R-10andR-14jhorelineMasterProgramRegulations.SECTIONIII.Subsections4-2-110.E.40and4-2-110.E.41oftheRentonMunicipalCodeareamendedasshownbelow,andsubsection4-2-110.EoftheRentonMunicipalCodeisamendedtoaddanewsubsection4-2-110.E.42toreadasshownbelow.Allotherprovisionsin4-2-110.Eremainineffectandunchanged.40.Forthepurposeofcalculatingmaximumunitsizeonly,thesquarefootcalculationshallnotincludeporchesorexteriorstairs.Garagesattachedtoaccessorydwellingsshallbeincludedinthesquarefootcalculation,exceptforwhentheentiretyofthelivingareaacccssorydwellingislocatedaboveagarage.3SideYard ORDINANCENO.600241.ConversionofaccessorybuildingstoADUsshallbeexemptedfromtherelevantdevelopmentregulationsiftheaccessorybuildingwasconstructedpriortoJanuary1,2020.However,modificationsmadetoaccessorybuildingsafterJanuary1,2020thatwouldincreasethenonconformanceoftheproposedconversionareineligiblefromsuchexemptions.42.ADUsbuiltusingCityproducedpre-approvedADUbaseplansmayexceedthewallplateheightoftheprimarystructurebyfourfeet(4’)andmaybeallowedanadditionalheightallowanceuponapplicationandapprovalofamodificationpursuanttoRMC4-9-250.ApplicantproducedADUplansseekingtoexceedthewallplateheightoftheprimarystructuremaybealloweduponapplicationandapprovalofamodificationpursuanttoRMC4-9-250.SECTIONIV.Subsection4-2-116.B.2oftheRentonMunicipalCodeisamendedasshownbelow.Allotherprovisionsin4-2-116.Bremainineffectandunchanged.B.APPLICABILITY:1.ThisSectionshallapplytoADUsinthefollowingzones:Residential-4(R4),Residential-6(R-6),Residential-S(R-8),Residential-lO(R-10),andResidential14(R-14).2.IftheprimarystructurewheretheADUisproposeddoesnotcomplywiththeadoptedarchitecturaldetailingstandardsadoptedintheResidentialDesignstandards(RMC4-2-115E3),theprimarystructureshallbebroughttoproportionalcompliancepriortotheissuanceofADUbuildingpermits.4 ORDINANCENO.6002a.Theamountinvestedinphysicalimprovementstoreduceor/eliminatethenonconformityrelatedtothearchitecturaldetailingshallbedeterminedbymultiplyingthevaluationoftheADU,asdeterminedbytheCity,bytenpercent(10%).b.TheDepartmentshallevaluateandapprovetheallocationoftherequiredinvestmentinbringingtheprimarystructureintocompliancebasedontheaboveformulaandRMC4-2-115E3.SECTIONV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONVI.Thisordinanceshallbeinfullforceandeffectfive(5)daysafterpublicationofasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis14thdayofDecember,2020.Jaso/A.SethjityClerkAPPROVEDBYTHEMAYORthisl4”dayofDecember,2020.ioPavone,Mayor5
