Dear Ms. Schmitz,
The City of Renton (City) Department of Community and Economic Development has received your inquiry into
the status of the Shoreline Substantial Development that was administratively approved by the City on June 14,
2019 and subsequently received approvals from the State Department of Ecology (DOE) on June 25, 2019 with
activity allowed to begin on July 8, 2019 (21 days from the date of filing). The revised two-year time requirement
to commence construction now concludes on June 14, 2023 based on the findings of this letter.
The proposal, known as May Creek Trail Extension Project, is a six-foot (6’) wide trail extension from the existing
May Creek Trail on the west side of I-405 to Jones Ave NE on the east side of I-405. The project includes
enhancement of stream buffers and is located within the Shoreline Urban Conservancy environmental designation
of May Creek. The May Creek Trail is currently managed by the City’s Community Services Department. Pursuant
to Renton Municipal Code (RMC) 4-9-190.J.6 construction activities related to a shoreline permit must commence
within two (2) years of the effective date of filing. No construction activities directly related to this shoreline permit
have commenced as of the date of this letter.
The I-405, Renton to Bellevue Widening and Express Toll Lanes Request for Proposal (RFP) was released on
January 7, 2019 and was awarded on October 1, 2019. The design build project was issued a civil construction
permit (C20002949) by the City in 2020. The Renton to Bellevue widenting project was designed to reduce
congestion and improve safety performance along one of the state’s most congested sections of highway and is
expected to be open in 2024. Construction of the May Creek Trail Extension, one portion of the construction
schedule, is anticipated to be completed by the design builder (Flatiron Lane, A Joint Venture) during the
summer of 2023 or potentially sooner.
The decision date of the shoreline permits occurred on June 14, 2019. Pursuant to WAC 173-27-090(4) the
permit time period that requires construction activities to commence within two years of the effective date does
not include the time needed to obtain any other government permits and approvals that would authorize the
development to proceed. The May Creek Trail Extension would be constructed by Washington State Department
of Transporation (WSDOT) as a component of the I-405 - Renton to Bellevue Widening and Express Toll Lanes

design build project. The design build contract is a multi-year contract that provides schedule flexibility to
complete design and construction of the project by 2024 and therefore the time period between segments of
the project is excluded from the two year standard period of validity of RMC 4-9-190.J.6. The revised two-year
time requirement to commence construction now concludes on June 14, 2023.
