CITY OF RENTON, WASHINGTON ORDINANCE NO. 6012 AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON, ADOPTING INTERIM ZONING CONTROLS FOR THE URBAN CENTER (UC) ZONE BY AMENDING SUBSECTIONS 4-2-080.A.6.iv, 4-2-120.A, 4-4-150.C, 4-4-150.13, AND 4-4-150.E OF THE RENTON MUNICIPAL CODE; PROVIDING FOR SEVERABILITY; DECLARING AN EMERGENCY; AND ESTABLISHING AN IMMEDIATE EFFECTIVE DATE. WHEREAS, the City of Renton's Comprehensive Plan policy for the Urban Center (UC) zone is as follows, "Zone lands that are located within Renton's Designated Regional Growth Center, if there is a potential for the creation of dense employment, destination retail, recreation, or public gathering space with the Urban Center (UC) zone. The Urban Center zoned areas have large parcels of land with the potential for large scale redevelopment opportunities that will create a mixed -use retail, employment, and residential center. UC zoning implements the Commercial Mixed Use land use designation." Policy U-17 (sic; "Policy L-17" appears to have been intended); and WHEREAS, the purpose of the UC zone, as partly stated in Subsection 4-2-0203 of the Renton Municipal Code, is as follows, "The Urban Center Zone (UC) is established to provide an area for pedestrian -scale urban mixed -use development that supports the residential and employment goals of Renton's Urban Center;" and WHEREAS, a development agreement between the City of Renton and The Boeing Company (King County Recording Number: 20031210001637) governing many of the use and development standards in the UC zone sunsetted on December 31, 2020; and WHEREAS, without said development agreement there are insufficient zoning controls for new development in the UC zone, as compared to the zoning controls of other commercial 1 ORDINANCE NO. 6012 zones in the City, thereby limiting the City's ability to further the aforementioned policy and purpose of the zone; and WHEREAS, the City Council has determined a need for interim zoning controls for the Urban Center (UC) zone; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION I. The above recitals are adopted as findings of fact in support of this interim zoning control ordinance adopted herein pursuant to RCW 35A.63.220 and RCW 36.70A.390, and are found to be true and correct in all respects. SECTION II. All portions of the Renton Municipal Code in this ordinance not shown in strikethrough and underline edits remain in effect and unchanged. SECTION III. Subsection 4-2-080.A.6.a.iv of the Renton Municipal Code is amended as shown below. All other provisions in 4-2-080.A.6 remain in effect and unchanged. a. Standalone Residential — Where Allowed: Standalone residential buildings are permitted: i. In the CD Zone outside of the Downtown Business District, provided residential amenity space and/or lobby space is provided on the ground floor along the street frontage, which shall be at least twenty feet (20') wide and at least fifty percent (50%) of the facade width for facades less than sixty feet (60') wide, or a minimum of thirty feet (30') wide for facades greater than sixty feet (60') wide. (Widths shall be measured along the building facade.) The ground floor shall have a floor -to -ceiling height of twelve feet (12'). Where located on the 2 ORDINANCE NO. 6012 ground floor and within ten feet (10') of public sidewalk, the floors of attached dwellings shall be at least two feet (2') elevated above the grade of the sidewalk; ii. In the CV Zone where not abutting NE Sunset Blvd. east of Harrington Avenue NE; iii. In the CA Zone where abutting a residential zone if at least one vertical mixed building is constructed along the street frontage(s) with a minimum of two (2) residential stories above commercial, the standalone residential building(s) are sited closest to the abutting residential zone and, if townhouses, limited to three (3) stories; and process. iv. In the UC Zone where currently existing ale%^+.^^+� .,^+ v. In the COR Zone as determined through the Master Site Plan Where standalone residential buildings are not allowed, dwelling units shall be integrated into a vertically mixed use building with ground floor commercial. SECTION IV. Subsection 4-2-120.A of the Renton Municipal Code is amended as shown on Attachment A. All other provisions in 4-2-120 remain in effect and unchanged. SECTION V. Subsections 4-4-150.C, 4-4-150.1), and 4-4-150.E of the Renton Municipal Code are amended as shown below. All other provisions in 4-4-150 remain in effect and unchanged. c ORDINANCE NO. 6012 4-4-150 RESIDENTIAL MIXED USE DEVELOPMENT STANDARDS: A. PURPOSE: 1. Ensure that all development is consistent with the goals, objectives and policies of the Comprehensive Plan. 2. Provide development standards for integrated residential and commercial development within the same building or on the same parcel or contiguous group of parcels. B. DESIGN: 1. Where allowed, townhouses or carriage houses shall be subject to the standards of RMC 4-2-115, Residential Design and Open Space Standards, applicable to the R-10 and R-14 Zones, in lieu of the Design District Overlay standards of RMC 4-3-100. 2. For vertically mixed use buildings, the facade necessary for interior entrances, lobbies, and areas/facilities developed for the exclusive use of the building's residents, or their guests, is limited to twenty five percent (25%) of the overall facade along any street frontage or the primary facade. C. GROUND FLOOR COMMERCIAL — WHERE REQUIRED: 1. A vertically mixed use building with at least two (2) residential stories above ground floor commercial is required: a. Along any street frontage in the CA Zone; b. The CD Zone within the Downtown Business District; and 4 ORDINANCE NO. 6012 c. Along NE Sunset Blvd. for properties in the CV Zone abutting NE Sunset Blvd. east of Harrington Avenue NE. in: 2. A vertically mixed use building with ground floor commercial is required a. The CN Zone; and b. The UC Zone ^'^^^ pedestFian ^ nted StFeet. D. COMMERCIAL SPACE STANDARDS: 1. Commercial Area Requirement: Except in the UC zone, CD Z-zone outside of the Downtown Business District, and CV zoned properties not abutting NE Sunset Blvd. east of Harrington Avenue NE, any development wherein dwelling units are proposed shall provide gross commercial square footage equivalent to fifty percent (50%) of the gross ground floor area of all buildings on site. In the UC zone, any development wherein dwelling units are proposed shall provide gross commercial square footage equivalent to thirty-three percent (33%) of the site's land area. 2. Ground Floor Commercial Space Standards: At a minimum, the development shall include ground floor commercial space along any street frontage or, in the absence of street frontage, along the primary facade of the building in conformance with the following standards: a. A minimum average depth of thirty feet (30') and no less than twenty feet (20') at any given point; 5 ORDINANCE NO. 6012 b. A minimum floor -to -ceiling height of eighteen feet (18'), and a minimum clear height of fifteen feet (15') unless a lesser clear height is approved by the Administrator; c. ADA compliant bathrooms (common facilities are acceptable); d. A central plumbing drain line; and e. A grease trap and a ventilation shaft for a commercial kitchen hood/exhaust. E. MODIFICATIONS: Except for subsection C of this Section, Ground Floor Commercial — Where Required, and subsection D.1 of this Section as it pertains to the UC zone whenever there are practical difficulties involved in carrying out the provisions of this Section, modifications may be granted for individual cases in accordance with the procedures and review criteria in RMC 4-9-250D. SECTION VI. The interim zoning controls imposed herein shall be in effect for six (6) months from the passage of this ordinance, unless ended earlier by subsequent City Council action, or unless subsequently extended by the City Council pursuant to state law. SECTION VII. A public hearing will be scheduled and held within sixty (60) days of the passage of this ordinance. SECTION VIII. If any Section, subsection, sentence, clause, phrase or work of this ordinance should be held to be invalid or unconstitutional by a court or competent jurisdiction, such invalidity or unconstitutionality thereof shall not affect the constitutionality of any other Section, subsection, sentence, clause, phrase or word of this ordinance. 6 ORDINANCE NO. 6012 SECTION IX. The City Council declares an emergency for the protection of the public welfare and to enable the purpose and intent of this ordinance to be accomplished. This ordinance shall take effect immediately when passed by the City Council. The City Clerk shall cause to be published a summary of this ordinance in the City's official newspaper.
