CITYOFRENTON,WASHINGTONORDINANCENO.5968ANORDINANCEOFTHECITYOFRENTON,WASHINGTON,ADOPTINGANINTERIMZONINGCONTROLTOADDANEWSUBSECTION4-1-080.FTOTHERENTONMUNICIPALCODE,TEMPORARILYEXTENDINGTHEPERIODOFVALIDITYOFCERTAINLANDUSEANDSUBDIVISIONAPPROVALS,BUILDINGPERMITS,CIVILCONSTRUCTIONPERMITS,ANDPUBLICWORKSPERMITS;PROVIDINGFORSEVERABILITY;DECLARINGANEMERGENCY;ANDESTABLISHINGANIMMEDIATEEFFECTIVEDATE.WHEREAS,onFebruary29,2020,theGovernoroftheStateofWashingtonproclaimed,viaProclamation20-05,aStateofEmergencyduetothenovelcoronavirus(COVID-19);andWHEREAS,onMarch5,2020,MayorArmondoPavoneissuedtheCityofRentonProclamationofEmergencyduetoCOVID-19;andWHEREAS,theoutbreakofCOVID-19anditsrapidprogressioninWashingtonstatecontinuestothreatenthelivesandhealthofpeopleaswellastheeconomy;andWHEREAS,thePugetSoundAre,WashingtonState,andKingCountyhaveundergoneasuddeninterruptioninconstructionactivityasaresultofCOVID-19;andWHEREAS,theGovernoroftheStateofWashingtonhasorderedWashingtonianstostayhomeviaProclamation20-25StayHome—StayHealthy,whichorderidentifiesonlycertainessentialconstructionactivitiesthatmayproceedduringthedurationoftheorder;andWHEREAS,theconstructionsupplychainhasbeenaffectedbytheavailabilityofconstructionworkersandmaterialsduetoCOVID-19;andWHEREAS,socialdistancingrequirementsunderProclamation20-25StayHome—StayHealthynecessitatefewerworkersonjobsites;and1 ORDINANCENO.5968WHEREAS,developersandCitystaffhaveinvestedsubstantialamountsoftimeinlanduseandsubdivisionapprovals,andbuildingpermit,civilconstructionpermit,andpublicworkspermitreview;andWHEREAS,lossofthosevariousapprovalswouldbedetrimentaltotheCityandthegeneralpublic;andWHEREAS,theCityCouncilhasdeterminedthatthereisaneedforaninterimzoningcontrolordinancetoaddressandpreventthelossofcertainapprovals,asfurtherspecifiedinthisordinance;andWHEREAS,theCityCouncilfindsthatthesubjectofthisordinancecomplieswiththeGovernor’sProclamation20-28relatingtomeetingsduringtheCOVID-19crisisbecausethesubjectmatterofthisactionisnecessarytorespondtotheCOVID-19outbreakandthecurrentpublichealthemergency;NOW,THEREFORE,THECITYCOUNCILOFTHECITYOFRENTON,WASHINGTON,DOORDAINASFOLLOWS:SECTIONI.TheaboverecitalsareadoptedasfindingsoffactinsupportoftheinterimcontrolsadoptedhereinpursuanttoRCW35A.63.220andRCW36.70A.390,andarefoundtobetrueandcorrectinallrespects.SECTIONII.Asaninterimzoningcontrol,section4-1-080oftheRentonMunicipalCodeisamendedtoaddanewsubsection,4-1-080.Ftoreadasfollows:F.LIMITEDEXTENSIONOFPERIODOFVALIDITYFORLANDUSEANDSUBDIVISIONAPPROVALS,BUILDINGPERMITS,CIVILCONSTRUCTIONPERMITS,ANDPUBLICWORKSPERMITS:2 ORDINANCENO.5968Forlanduseandsubdivisionapprovals,buildingpermits,civilconstructionpermits,andpublicworkspermitsthatwereapprovedand/orissuedbetweenJanuary1,2015andtheeffectivedateofthissubsection4-1-O8O.Fandthatwerestillvalidandunexpiredasoftheeffectivedateofthissubsection4-1-0$0.F,thefollowingshallapply:TheperiodofvaliditythatwouldotherwiseapplyunderthestandardexpirationdateslistedinthisTitleisextendedbyanadditionalsix(6)months.ThisextensionisaddedtoanyotherextensionspossibleundertheRMC.Thisextensiondoesnotapplytotemporaryusepermits,permitsinconiunctionwithadevelopmentagreement,andshorelinepermits.ThisextensionisnotinadditiontoanyextensionsthatmaybeavailablethroughtheactionoftheGovernoroftheStateofWashingtonortheWashingtonStateLegislatureonoraftertheeffectivedateofthissubsection4-1-080.F.ThisextensionwillautomaticallyexpireonOctober20,2020,unlessanotherordinanceispassedextendingthisdate.SECTIONIII.Apublichearingwillbescheduledandheldwithinsixty(60)daysofthepassageofthisordinance.SECTIONIV.Ifanysection,subsection,sentence,clause,phraseorworkofthisordinanceshouldbeheldtobeinvalidorunconstitutionalbyacourtorcompetentjurisdiction,suchinvalidityorunconstitutionalitythereofshallnotaffecttheconstitutionalityofanyothersection,subsection,sentence,clause,phraseorwordofthisordinance.SECTIONV.TheCityCouncildeclaresanemergencyfortheprotectionofthepublicwelfareandtoenablethepurposeandintentofthisordinancetobeaccomplished.This3 ORDINANCENO.5963ordinanceshalltakeeffectimmediatelywhenpassedbytheCityCouncil.TheCityClerkshallcausetobepublishedasummaryofthisordinanceintheCity’sofficialnewspaper.Thesummaryshallconsistofthisordinance’stitle.PASSEDBYTHECITYCOUNCILthis_______dayof___________________,2020.JasonA.Seth,CityClerkAPPROVEDBYTHEMAYORthis_______dayof_____________________,2020.Approvedastoform:AeShaneMaloney,CityAttorneyDateofPublication:4-24-2020(Summary)ORD:2105:4/14/2020APavone,Mayor4
