PROJECT DESCRIPTION: The applicant, King County Wastewater Treatment Division (WTD), is
requesting a Shoreline Exemption for emergency maintenance and repairs at the Black River Pump
Station (BRPS), located at 550 Monster Rd SW, Renton, WA (APN’s 3779200090 and 7229500281) (see
attached drawings). The BRPS is located on a concrete dam that spans the Black River channel, conveys
all Springbrook Creek flow to the Green River, and is a critical component of the Green River flood
control system. The BRPS has operated continually since it was constructed in 1972 and the pump
station protects against signification flood damage that could occur if the Green River flood flows back
up in the Black River. The repair project is in the Resource Conservation zone and is within the Black
River/Springbrook Creek Shoreline Jurisdiction, Reach A (BRSC-A). The Black River is a Shoreline of the
State and a Type S stream.
Recent heavy rains made two (2) existing King County fish screens inoperable at the BRPS, which is a
violation of local, state, and federal fish protection regulations. Due to the storm flows, the fish screens
at the BRPS have become blinded with sediment and the inefficient screen cleaning system resulted in
increased hydraulic force on the screens. This force caused two screens (6E and 6W) to bend and be
permanently deflected. These issues pose a significant risk to the operation of the BRPS, both in terms
of flood control operations as well as for fish protection, to keep fish from entering the pump bay. The
hydraulic forces on the screens pose a risk of further damage occurring to the screens.
The work to correct the current situation would require the following efforts:
a. Expedited Fish Screen Replacement – Remove and replace the damaged screens with in-kind
and available spare screens as soon as possible.
b. Diving Services for Expedited Fish Screen Maintenance – Remove sediment upstream of the fish
screens to help free the screens to be raised.
c. Fish Screen Cleaning – Raise the “stuck” fish screens out of the channel so they can be cleaned.

The work to restore the BRPS to a state comparable to its original condition would occur within the
ordinary high-water mark of the Black River or on the uplands immediately adjacent to the Black River.
The proposed project would not alter the current use of the facility or property. The proposed project
does not include any fill or excavation, nor the removal of any trees, nor does it include any work that
would exceed 35 feet above the average grade level or obstruct any views. The proposed work would
occur as soon as permits are received or January 29, 2021, whichever occurs first.

EXEMPTION JUSTIFICATION: An exemption from a Shoreline Management Substantial Development
Permit is hereby Approved on the proposed project in accordance with RMC 4-9-190C ‘Exemption from
Permit System’ and for the following reasons:
The project meets the requirements of an emergency because it requires immediate action within a
time frame too short for full compliance with a shoreline management permit. The damaged fish
screens and recent sediment build-up, due to a severe storm event, pose a significant risk to the
operation of the BRPS, both in terms of flood control operations as well as for fish protection, and are a
threat to public health, safety and the environment.
The proposed development is:
Consistent with the Shoreline Management Act.
Not Applicable to the guidelines of the Department of Ecology where no Master Program has been
finally approved or adapted by the Department.
Consistent with the City of Renton Shoreline Master Program.

RECONSIDERATION: Within 14 days of the decision date, any party may request that the decision be
reopened by the approval body. The approval body may modify his decision if material evidence not
readily discoverable prior to the original decision is found or if he finds there was misrepresentation of
fact. After review of the reconsideration request, if the approval body finds sufficient evidence to amend
the original decision, there will be no further extension of the appeal period. Any person wishing to take
further action must file a formal appeal within the 14-day appeal time frame.
APPEAL: This administrative land use decision will become final if not appealed in writing to the
Hearing Examiner on or before 5:00 PM on February 9, 2021. An appeal of the decision must be filed
within the 14-day appeal period (RCW 43.21.C.075(3); WAC 197-11-680). Due to Governor Jay Inslee’s
Proclamation 20-25 (“Stay Home, Stay Healthy”), the City Clerk’s Office is working remotely. For that
reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov. The
appeal fee, normally due at the time an appeal is submitted, will be collected at a future date. Appeals
to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal
process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov.
EXPIRATION: Two (2) years from the date of decision (date signed).
