Sometimes, as part of the land use application process, a stream study is conducted to verify the existing classification. As a result of such stream studies there are three streams that need to be reclassified. Background: The City’s Critical Areas Regulations identify three pes of streams or creeks that require buffers from them. Type F are fish bearing and require a 115 foot buffer, Type Np are non-fish bearing perennial streams that require a 75 foot buffer, and Ns are non-fish bearing seasonal streams that require a 50 foot buffer. The Critical Areas Regulations also identify what the City needs to do when a stream study has been done and a stream needs to be reclassified, code states that “Administrator acceptance of a stream or lake study or consultation with the Washington Department of Fish and Wildlife, followed by a legislative amendment to the map”. The Administrator has accepted three stream studies and this docket item is to legislatively amend the streams map. The City classified the streams within its jurisdiction in approximately the year 2000. For areas such as Benson that have annexed since the initial stream classifications the city has relied on data from King County. As development occurs, a stream study may be conducted. Primarily, a study is done when one is requested (by a Party of Record, a Tribe, etc.) or if the applicant is seeking to reduce a buffer or use buffer averaging. As shown in the attached maps, there are three reclassifications of streams the city needs to formally adopt. Specifically, reclassification of approximately 2,400 feet of Maplewood Creek from Type Np to F, a second approximately 140 feet of Maplewood Creek from Type Np to F, and reclassification of approximately 400 feet of Kennydale Creek from Type Ns to Np. Staff Recommendation: Staff recommends formally amending the City’s stream map to classify portions of Maplewood Creek to Type F and a portion of Kennydale Creek to Np. Impact Analysis Effect on rate of growth, development, and conversion of land as envisioned in the Plan Not applicable. There is no anticipated effect on the rate of growth, development, and conversion of land envisioned in the Plan. Effect on the City’s capacity to provide adequate public facilities Not applicable. AGENDA ITEM #1. a) #D-172 Code Clean Up Page 1 of 2 April 29, 2020 CITY OF RENTON Community and Economic Development Department D-172 Code Clean-Up Staff: Katie Buchl-Morales Date: April 29, 2020 Applicant or Requestor: Staff ______________________________________________________________________________ General Description: Chapter-by-chapter review of Renton Municipal Code to improve consistency of language, formatting, and other superficial changes. These proposed code amendments are non-substantive and will not impact adopted policies or procedures. Background Staff has initiated a chapter-by-chapter review of code to eliminate inconsistency related to language, formatting, and other superficial changes. Additionally, the proposed code amendments remove references to obsolete code sections and division and employee titles that are no longer in use. Examples of proposed code changes include: - Remove references to RMC 4-1-170, Land Use Review Fees In 2012, the City of Renton Fee Schedule was removed from Renton Municipal Code by Ord. 5676. Reference to the repealed code section is prevalent throughout code and should be removed. For example, “The application for preliminary approval of a planned urban development shall be filed with the Department of Community and Economic Development accompanied by a filing fee as established by RMC 4-1-170, Land Use Review Fees” (RMC 4-9-150F.2). - Use consistent language to reference the City of Renton Fee Schedule Fee schedule terminology used in code varies from City of Renton Fee Schedule Brochure, City of Renton Fee Schedule, City’s Fee Schedule, and Fee Schedule, with varied capitalization of the words. Staff proposes making code amendments so that references to the fee schedule use consistent terminology and punctuation. - Remove references to Development Services Director and Development Services Division AGENDA ITEM #1. b) #D-172 Code Clean Up Page 2 of 2 April 29, 2020 Following a department reorganization in 2008, the Development Services Division was disbanded and replaced by the Community and Economic Development Department. References to the Development Services Division and Development Services Director remain. Staff recommends correcting the use of Development Services Division and Development Services Director to reflect department and title changes. This process shall be ongoing until the proposed code amendments are submitted to the City of Renton Attorney’s Office for final review. Staff Recommendation Staff recommends continued review of Renton Municipal Code to achieve consistent use of language and formatting as appropriate.
