b) AB - 2805 City Clerk reports bid opening on January 15, 2021 for the Renton Elementary
and Middle Schools project, CAG-20-150, and submits the staff recommendation to
award the contract to the lowest responsive and responsible bidder, PGH Excavating, Inc.,
in the amount of $374,702.96.The construction contract provides for installing
Rectangular Rapid Flash Beacons (RRFBs) at three (3) Renton school locations
(Maplewood Heights Elementary, Sierra Heights Elementary, and McKnight Middle
School) to improve pedestrian safety. The work shall include but is not limited to
excavation, pavement removal, RRFBs with accessible push buttons, signage, pavement
markings, pedestrian refuge island, bulb outs, sidewalk widening, ADA/curb ramps
improvements, drainage improvement, and visibility improvements.

c) AB - 2797 Community & Economic Development Department recommends approval of a
resolution declaring that acquisition of the property located at 13279 89th Avenue South,
Renton, WA (King County Parcel No. 2144800910) is necessary to eliminate neighborhood
blight; and requests authorization to acquire, condemn, and abate the property pursuant
to Chapter 35.80A RCW.

d) AB - 2799 Public Works Transportation Systems Division recommends approval of Change
Order No. 1 to CAG-20-001, contractor Cascade Civil Construction, LLC, in the amount of
$520,000, for additional work on Houser Way S at Williams Ave S and Wells Ave S
necessary to replace the old City utilities under BNSF railroad tracks.

Proclamation
Whereas, the traditional Chinese Lunar New Year celebration, also known as the Spring
Festival, dates back as early as the fourteenth century B.C.; and
Whereas, 2021 is the Year of the Ox, which is a symbol of wealth, prosperity, diligence and
perseverance, and those born during the Year of the Ox are said to be balanced, trustworthy,
patient and modest individuals; and
Whereas, the Lunar New Year is celebrated uniquely in many different Asian countries but
regardless of the country, culture, religion or ethnicity, the day is a time for family reunions,
gatherings, reaffirming bonds and reflection; and
Whereas, the diverse Asian community in Renton is home for many Asian families that have
been here for generations as well as newer Asian immigrants; and
Whereas, the City of Renton, with its rich demographic diversity, beautiful parks, friendly and
prosperous businesses, many community services, and excellent schools, has provided a
welcoming environment for the Asian community to call Renton their home;
Now, therefore, I, Armondo Pavone, Mayor of the City of Renton, do hereby proclaim
February 22, 2021, to be
Lunar New Year Day
in the City of Renton, and I encourage all members of the community to join me in this special
observation.

URBAN CENTER (UC) ZONE –INTERIM ZONING CONTROLS

BACKGROUND
Emergency Ordinance 6012 was adopted on January 25, 2020.
Established interim zoning controls for the UC zone:
1.Development of multifamily requires commercial space integrated into
the ground floor equivalent to 33% of the site’s land area;
2.Subject to Residential Mixed-Use Standards of RMC 4-4-150; and
3.Building setbacks of the Commercial Arterial zone.
State law requires a public hearing for emergency ordinances be held within
60 days of adoption.
Ord. 6012 will sunset on June 25, 2021 unless lifted sooner by City Council or
extended pursuant to state law.AGENDA ITEM #4. a)
BACKGROUND
The Urban Center (UC) zone is intended for the creation of dense employment,
destination retail, recreation, and public gathering spaces, with the potential for
large scale redevelopment opportunities that will create a mixed-use retail,
employment and residential center;
The purpose of the UC zone is to provide an area for pedestrian-scale urban
mixed-use development that supports the residential and employment goals of
Renton’s Regional Growth Center;
A development agreement between the City of Renton and The Boeing Company
governing many of the use and development standards in the UC zone sunset on
December 31, 2020;
Without that development agreement there are insufficient zoning controls for new
development in the UC zone, as compared to the zoning controls of other
commercial zones in the City, thereby limiting the City’s ability to further the policy
and purpose of the zone. AGENDA ITEM #4. a)

PROCLAMATION
a) National Black History Month: A proclamation by Mayor Pavone was read declaring February
2021 to be National Black History Month in the City of Renton, encouraging all residents to
join in learning more about the rich history of African Americans during this special
observance. Rev. Dr. Linda Smith and Renton resident Joseph Todd and his family accepted
the proclamation with appreciation.

ADMINISTRATIVE REPORT
Interim CAO Ed VanValey reviewed a written administrative report summarizing the City’s
recent progress towards goals and work programs adopted as part of its business plan for
2021 and beyond. Items noted were:
Renton PD Loves Campaign, started in 2018, continues this year with our officers
showing their love toward local organizations and businesses that have stepped up to
help those in our community who have been impacted by COVID‐19. Via social media,
the campaign will highlight the efforts of organizations such as the Chamber of
Commerce, Community Services Department, Renton Senior Activity Center,
Sustainable Renton, and the Salvation Army. These organizations have set up drive‐
thru food events and lunch programs to feed the community, or creative pop‐up
events to support local businesses. Please visit the Police Department’s Facebook,
Nextdoor, and Instagram accounts where they are recognizing the efforts of these
groups and the difference they are making in our community.
Preventative street maintenance will continue to impact traffic and result in
occasional street closures.
AUDIENCE COMMENTS
Claire Wilkinson, Renton, expressed concern about the health of puppies and the
financial practices of Puppyland, a retail pet store opening soon in Renton. She urged
Council to pass a Humane Pet Store ordinance that prohibits the sale of cats and dogs
in pet stores.
Ashly Dale, Puyallup, Director of Operations for Bailing Out Benji, expressed concern
about Puppyland, a retail pet store opening soon in Renton. She noted that
Puppyland sources its puppies from puppy mills and is known for its unscrupulous
financial practices. She urged Council to adopt a Humane Pet Store ordinance that
prohibits the sale of cats and dogs in pet stores.
Amy Jesse, Denver, Director of Public Policy, Puppy Mills for the Humane Society of
the United States, noted that Puppyland and other stores like it source their puppies
from puppy mills in the Midwest and urged Council to adopt a Humane Pet Store
ordinance that prohibits the sale of cats and dogs in pet stores.

389816‐389820, 389832‐390078; payroll benefit withholding vouchers 6482‐6493,
389821‐389827, 389829‐389831 and one wire transfer.
2. Payroll – total payment of $1,405,718.94 for payroll vouchers that include 557 direct
deposits and 4 checks. (01/01/21‐01/15/21 pay period).

b) Finance Committee Chair O'Halloran presented a report concurring in the staff recommendation
to authorize the change in the 2021‐2022 adopted budget to reflect a reduction of 2.0 FTE Solid
Waste Maintenance Workers and the addition of 2.0 FTE Maintenance Services Worker I
(Street/Solid Waste).

LEGISLATION
Ordinance for second and final reading:
a) Ordinance No. 6013: An ordinance was read granting Extenet Systems, Inc., a Delaware
Corporation authorized to do business within the State of Washington, its affiliates,
successors and assigns, the right, privilege, and authority to install communications facilities,
specifically fiber optic cable and related appurtenances, under, along, over, below, through
and across the streets, avenues and alleys of the City of Renton within the Public Right‐of‐
Way of Renton.

SUMMARY OF ACTION:
The City Clerk Division opened sealed bids for the Renton Elementary and Middle Schools Project, CAG -20-150,
on January 15, 2021, and submits the staff recommendation to award the contract to the lowest responsive
and responsible bidder.
The construction contract provides for installing Rectangular Rapid Flash Beacons (RRFBs) at three (3) Renton
school locations (Maplewood Heights Elementary, Sierra Heights Elementary, and McKnight Middle School) to
improve pedestrian safety. The work shall include but i s not limited to excavation, pavement removal, RRFBs
with accessible push buttons, signage, pavement markings, pedestrian refuge island, bulb outs, sidewalk
widening, ADA/curb ramps improvements, drainage improvement, and visibility improvements.
The bid opening met the following Council criteria:
1) There was more than one bid submitted;
2) The lowest responsive and responsible bidder was within the total project budget; and
3) There were no irregularities with the lowest responsive and responsible bid .
Therefore, staff recommends awarding the Renton Elementary and Middle Schools project to the lowest
responsive and responsible bidder, PGH Excavating, Inc., in the amount $374,702.96.

SUBJECT:Renton Elementary and Middle Schools Project –
Construction Contract CAG-20-150
The Transportation Systems Division recommends that the Renton Elementary and
Middle Schools Project construction contract in the amount of $374,702.96 be awarded
to PGH Excavating Inc. P.O. Box 1151, Enumclaw, WA 98022.
On Friday January 15, 2021 the Bids were opened. There were nine (9) bids submitted
for the project. The bid submitted Road Construction Northwest, Inc., the apparent low
bidder, was determined to be Irregular and Non-Responsive for failure to submit a
completed Underutilized Disadvantaged Business Enterprise (UDBE) Bid Item
Breakdown Form with their proposal for the project. As a result, the bid from Road
Construction Northwest, Inc. has been rejected.
RCW 39.04.350 has fifteen (15) responsibility criteria that must be met to determine the
successful bidder. FHWA-1273 has additional requirements that have also been met.
PGH Excavating Inc. has been determined to be a responsible bidder. The bid submitted
by PGH Excavating Inc. has been determined to be the lowest responsive bid.
To date, none of the bidders have filed a bid protest.
The bid submitted by PGH Excavating Inc. was under the Engineer’s Estimate of
$533,701.00, by $158,998.04. Seven (7) bidders were under the Engineer’s Estimate
and two (2) bidders were over the Engineer’s Estimate. After analysis of the bids, we
feel that the bid submitted by PGH Excavating Inc. is a fair representation of the cost of
the work associated with this project.
The City has been awarded $728,905 in Highway Safety Improvement Program (HSIP)
funding, Federal Aid No. HSIP-000S(533), for design and construction of this project. Of
that amount $662,605 is for the construction phase (construction contract and
construction management). The City’s match is presently $13,060 for the construction

phase (environmental services). Therefore, the total funding available for the
construction phase is presently $675,665 (construction contract and construction
management, and environmental services). Of that amount, $583,385 is encumbered
for the construction contract. The bid from PGH Excavating Inc. is $374,702.96. So, there
is sufficient project budget to cover this construction contract. However, this assumes a
contingency of 0% for the construction contract. There is $208,682 in federal fund
balance to cover a contingency for construction, should the need arise. For now, the
Transportation Systems Division is requesting that the Council award this construction
contract to PGH Excavating Inc. in the amount of $374,702.96.
The bids were received January 12, 2021. The contract provides for 45 calendar days for
award. There is one (1) remaining council meeting (February 22) before that deadline is
reached. Should the City fail to award this contract before March 1, the City will be
forced to rebid the project. This will result in the City having to spend additional funds to
update the contract documents to the 2021 WSDOT standard specifications because the
project would be re-advertised in 2021. The project was originally bid in 2020.
Additionally, WSDOT will require the City to obtain a new Disadvantaged Business
Enterprise (DBE) goal for the construction contract. Prior to October 1, 2020, WSDOT
required UDBE goals for federally funded projects. As of October 1, 2020, DBE goals are
now required.

FISCAL IMPACT SUMMARY:
Staff requests Council approve the resolution declaring the acquis ition of the property at 13279 89th Avenue
South necessary to eliminate neighborhood blight. The estimated funds necessary to acquire, condemn, and
abate the property, removing all public nuisances and bringing the property into complete compliance is
approximately $100,000. The clean up would allow the City to resell the property and offset the costs
associated with restoring this property’s compliance with City Code.

The property located at 13279 89th Avenue South (the "Property") has been a source of steadily increasing
community complaints tracing back to 2011. However, in recent months, calls ranging from code compliance
concerns to 911 reports have exponentially risen, overwhelming the City’s ability to maintain compliance and
enforce its laws. As no use for the land has been approved by the City, and there is no utility service on the
Property, numerous inhabitants are unlawfully living in junk or vehicle hulks, tr ailers, containers and tents
without running water or sewer facilities. The Property has become a nuisance and a blight on the surrounding
neighborhood that constitutes a threat to Renton’s public health, safety, and welfare. Since 2018, the Renton
Police Department (RPD) has opened several criminal investigations for events occurring on the property. The
Property has become a gathering place for unauthorized camping and trespassing for fugitives that constantly
threatens the health, safety, and peaceful enjoyment of our community.
The City can only acquire private property through condemnation if the purpose satisfies a public use. RCW
35.80A.010 authorizes the Council to declare that acquisition of a property is necessary to eliminate
neighborhood blight in order to satisfy the public use requirement. If the Council adopts the proposed
resolution, staff will seek authority to proceed with the condemnation process.

property pursuant to RCW 8.25.290. After such notice requirements are satisfied, the Council
will be asked to adopt a final ordinance authorizing the condemnation. Adopting the ordinance
is a prerequisite to the City filing a petition for condemnation with the King County Superior
Court to initiate formal proceedings. However, prior to engaging in litigation, City staff hope to
be able to negotiate a voluntary sale.
Acquisition of the property requires the City to pay the fair market value of the property. The
total costs for acquisition and clean up have not yet been determined and may be subject to
negotiation, but preliminary estimates place those combined costs of acquisition and cleanup in
the general range of $100,000.
These acquisition and cleanup costs are not currently accounted for in the 2021‐2022 budget.
The Administration is not asking the Council to amend the budget to accommodate the
acquisition at this time, but amendments will be necessary if the Property is ultimately
acquired. After acquisition, the City will be able to market the Property for sale for its fair
market value at the time of sale, taking into considerations any conditions the City places on its
use in the future, recapturing a portion of these projected expenditures.
Taking charge of the abatement of the Property and bringing the Property to code would be a
tremendous win for a large section of the central Renton community. The abatement would set
a positive example for some neighboring properties in decline, remove criminal trespassers
which would make a significant dent in local crime, and show the many community members
and businesses who have reported code violations and suspicious activity, that Renton cares
about its community members and takes action when action is needed.

ACQUISITION OF REAL PROPERTY KNOWN AS KING COUNTY PARCEL NO.
2144800910 IN THE CITY OF RENTON NECESSARY TO ELIMINATE
NEIGHBORHOOD BLIGHT AND TAKING OTHER ACTION CONNECTED THEREWITH.
WHEREAS, eliminating neighborhood blight is essential in order to protect the health,
safety, and welfare of the citizens of the City of Renton; and
WHEREAS, chapter 35.80A RCW authorizes the City to acquire blighted property by
condemnation when any two of the following criteria are satisfied: (1) a dwelling, building, or
structure exists on the property that has not been lawfully occupied for a period of a year or
more; (2) the property, dwelling, building, or structure constitutes a threat to public health,
safety, or welfare as determined by the City’s executive authority; (3) the property, dwelling,
building, or structure has been associated with illegal drug activity during the previous twelve
months; and
WHEREAS, chapter 35.80A RCW requires the city council to adopt a resolution declaring

unabated violations of the municipal code now existing upon the Property; and

citations related to the property and its owner, visitors, and tenants for violations of the criminal
law occurring upon and around the Property; and
WHEREAS, the Renton Police Department has issued an increasing number of criminal
citations for violations of the criminal law occurring in the neighborhoods surrounding the
Property; and
WHEREAS, the code compliance investigation, the criminal charges against the Property
owner, and the numerous police contacts with individuals have not resulted in the abatement of
the nuisance conditions upon the Property; and
WHEREAS, the Mayor has declared the conditions on and around the Property, including
the dwellings thereon, to be a threat to the public health, safety, or welfare of the residents of
the City of Renton; and
WHEREAS, the City Council has considered this matter during a regular duly scheduled
public meeting, has given this matter careful review and consideration, and finds that passage of
this resolution is in furtherance of the public interest, and necessary to protect the safety and
welfare of its citizens;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON, WASHINGTON, DO
RESOLVE AS FOLLOWS:
SECTION I. The City Council finds as follows:
A. A dwelling and other structures exist on the Property, which have not been lawfully
occupied for a period of one year or more.

SECTION III. The City Council declares that the acquisition of the Property, more
particularly described below, is necessary to eliminate neighborhood blight.

As you know, the City has fielded a rising number of calls for service and compliance
complaints regarding the vacant parcel of property located at 13279 89th Avenue (King
County Parcel No. 2144800910). Complaints and calls for service to this address and the
surrounding area trace back to as early as 2011. However, in recent months, the number
of issues related to the property have steadily increased, to the point that the conditions
are overwhelming the City’s ability to maintain compliance and enforce its laws.
In recent months, this vacant property has become a nuisance and a blight on the
surrounding neighborhood that constitutes a threat to Renton’s public health, safety, and
welfare. Accordingly, we are recommending condemnation of this property, pursuant to
Chapter 35.80A RCW.
By way of background, in 2018, the Community & Economic Development (CED)
Department cited the owner of the property (Jerald Mossman) for a total of 19 violations
of the Renton Municipal Code, mostly related to excess junk and vehicle parts scattered
on the vacant parcel. There is no utility service on the property, and no use for the land
has been approved by the City. The property owner and any other inhabitants who are
living there are doing so unlawfully, without running water or sewer facilities, and without
a certificate of occupancy, as required by RMC 4-9-130. Earlier this year Mr. Mossman
was convicted of a criminal charge for maintaining a nuisance. As part of the sentence,
the municipal court judge ordered the owner to clean up the property. Unfortunately, the
property remains out of compliance, and continues to be occupied unlawfully.
Even more concerning than the numerous code violations and unsanitary conditions
associated with the property is the fact that, since 2018, the Renton Police Department
(RPD) has opened several criminal investigations for events occurring on the subject
property. These crimes include arson, homicide, detonation of explosives, domestic
assault, stolen motor vehicles, illegal drug activity, a dog attack, and the aforementioned
nuisance case, among others. Crime has also spread within the surrounding
neighborhood. RPD has opened investigations for arson, burglary, unlawful possession of

firearms, stolen motor vehicles, and numerous criminal trespassing violations in the
surrounding neighborhood since 2018. The subject property has become a gathering
place for unauthorized camping and trespassing for fugitives that threatens the health,
safety and peaceful enjoyment of our community.
Given the significant effort required to prosecute these crimes and bring the property into
compliance, the City can no longer afford to allow its resources to be excessively devoted
to the issues created by this property. The property owner has demonstrated no
willingness to work with the City or abate the unlawful conditions, and he refuses to abide
by a judicially imposed mandate to bring the property into compliance. His inaction has
left the City with no choice but to unilaterally abate the unlawful conditions through any
means allowed under state law.
To that end, we have ultimately concluded that the most effective way to abate these
unlawful conditions is by using the City’s power of eminent domain to acquire the
property and secure it from further unlawful activities. Upon your approval, staff will draft
a resolution for consideration by the City Council to begin the eminent domain process
and bring the property into compliance.

FISCAL IMPACT SUMMARY:
The fiscal impact of Change Order No. 1 to CAG-20-001 with Cascade Civil Construction for the Williams
Avenue South and Wells Avenue South Conversion project (TIP 20-28) is $520,000. Approximately $400,000 of
this change order will be funded by the Water Utility (425.455290) and Surface Water Utility (427.475 510)
enterprise accounts. The remaining cost will be funded by Transportation Systems Division Fund 317.
SUMMARY OF ACTION:
The Williams Avenue South and Wells Avenue South Conversion project will change both roadways from
one-way to two-way operation between South Grady Way and North 1st Street. The project includes:
• Installation of new signing and channelization.
• Reconstructed intersections.
• New traffic signals.
• Pedestrian lighting.
• Street furnishings and landscaping.
The project also required Burlington Northern Santa Fe Railroad (BNSF) to replace the Railroad Crossing
Signals on Williams Avenue South and Wells Avenue South where they cross Houser Way South. The
current equipment was designed for one-way traffic, and new signals must be installed to accommodate the
conversion to two-way traffic.
BNSF had originally indicated that they would accomplish the task by boring under Houser Way South to
accommodate the electrical connections required for the railroad crossing signals. As they got closer to the
construction window, BNSF did a more detailed review of the site and determined there were too many
conflicts in the right-of-way with other utilities. BNSF determined they would have to remove the railroad
tracks and dig trenches for new signal wiring. This change in construction techniques provided the city a
very small window to replace aging water mains and stormwater facilities under the railroad tracks along
Williams Avenue South and Wells Avenue South.
This change order pays Cascade Civil Construction for the additional work on Houser Way South at Williams
Avenue South and Wells Avenue South necessary to replace the old city utilities under the BNSF railroad
tracks. This work was performed via change order because Cascade Civil Construction was currently on -site.
With little advance notice from BNSF, there was no opportunity to bid this work as a separate contract. This

utility work was not part of the CAG-20-001 contract with Cascade Civil Construction. This utility work was,
however, within the physical project limits and the project environmental limits.
Without this opportunity, replacement of these utilities would have required us to try complex jack and
bore methods, which would have resulted in a substantially greater cost than this change order. In addition,
due to the complexities of the work and conflicts below ground, BNSF may not have even a pproved this
work in the future. In addition, due to these complex methods, this work was not planned as part of any
future city project by the Transportation or Utility Systems divisions. This opportunity allowed the city to
upgrade existing degraded infrastructure at a lower cost than waiting for the facilities to fail or become
obsolete.

The following is documentation of an oral order given by the Engineer per WSDOT Specification 1-04.4.
The Contractor shall incorporate the attached plan sheets 19A, 120, 121, 122, and 123 into the plans. The Contractor shall complete
the work shown on these plan sheets in coordination with the BNSF removal and replacement of the existing railroad panels and
tracks on Houser Way S at Williams Ave S and Wells Ave S. The work to reopen Houser, Williams, and Wells shall be completed by
the end of the day 11/25/20. The work to install the utilities and the new rat slab shall be completed by the end of the day
11/20/20 to allow BNSF to proceed with the reinstallation of the ballast, railroad tracks, and railroad panels.
The work to construct the items shown on these added plan sheets will be tracked and paid by force account as part of a future
change order.
The estimated cost to complete this work is $400,000.00 and it is estimated that this work will take an additional 10 working days.
This estimate is based on the engineers estimate with modifications to account for the accelerated schedule, small quantities, and
anticipated utility conflicts. This estimate took into account the Contractors quote to complete this work.
