The work on pedestrian facilities shall be limited to one corner at a time, with the least possible inconvenience or delay to pedestrians. •Signage shall be used to warn motorcyclists/bicyclists of the potential hazards on any uneven surfaced or slippery road conditions during work and non-work hours. •The start of Work Time begins when any street or travel lane is fully/partially closed or impacts the follow of traffic. This includes set up within the traveled way or immediately adjacent to the roadway. •Emergency services (253-852-2121) shall be notified twenty-four (24) hours before any street or lane closures. •Contractor or entity must call Renton School District (425-204-4455) or any public/private agency, including public transit, to be affected by a temporary lane or road closure. •TCP for all street and/or lane closures shall be implemented and performed in compliance with the Manual on Uniform Traffic Control Devices (MUTCD) and/or State of Washington Department of Transportation (WSDOT) and all traffic regulations of the City of Renton and Revised Code of Washington (RCW). •Any lane or street closures not in conformance with the approved traffic control plan and/or without notification of emergency services may result in receiving a citation for violation of RCW 47.36.200 Signs or Flaggers at thoroughfare work sites and RCW 9A.36.050 Reckless Endangerment, and other applicable State and City codes. •Indemnify and hold harmless the City of Renton from any and all claims, actions, and judgments, including all costs of defense and attorney’s fees incurred in defending against same, arising from and related to implementation of the approved traffic control plans including claims arising from towing of private vehicles and the acts of the Applicant’s agents and employees. •The City of Renton shall be entitled, in its reasonable discretion, to settle claims prior to suit or judgment, and in such event shall indemnify and hold harmless the City for any such claims paid, including the City’s reasonable attorney’s fees and litigation costs incurred resulting from such claim. •In the event any claim or suit is brought against the City within the scope of this Agreement, Applicant will pay for legal counsel chosen by the City to defend against same. •Flagger and sign placement are subject to revision by the City Inspector on site, if needed to address traffic or pedestrian safety or travel. •Total road closure lasting more than twenty-four (24) hours is subject to the approval by the City Council. •Approved Temporary TCP must be at the work site during work hours. •Complete assistance and accommodation shall be provided to all kinds of pedestrian traffic when sidewalk or walkway is impeded to safely redirect pedestrians around a work zone. •Any vehicle, equipment, barricade, or portable tow-away sign used within the work area must display a company logo or any legally acceptable sign showing the company name, address, and telephone number at a conspicuous place on the vehicle or equipment. In the case of Temporary No Parking Zones, all the following apply in addition to previous: •Contractor must complete form to show limits of Temporary No Parking Zone identifying barricade locations for vacate parking or curb lane usage. •Contractor must post notice of dates and time of Temporary No Parking Zone with at least two signs per block seventy-two (72) hours in advance of effective date and time. •The cover sheet of this TCP form must be attached to each Temporary No Parking Sign on the project site. •Temporary traffic control devices must be removed immediately when work is done or no construction activities are going on. Comcast is requesting that the City of Renton approve this variance request based on the fact that the requirements for undergrounding this proposed over-lash on existing plant will cause undue hardship. 1. Installation of undergrounding facilities will increase the total cost of construction roughly 15-25 times the amount of an aerial over-lash on the existing Comcast strand. 2. Risk of potential damage to underground facilities will be increased. 3. Over-lash will not cause substantial adverse impact to other persons or entities in the immediate area. Over-lashing the cable will be accomplished in a few days, and the residents will not notice any impact. Comcast will clean up the over-lashed spans as necessary and identify and remove any existing dead cables along this route. 4. The variance is necessary to prevent any undue hardship due to the increased construction costs if forced to install the proposed extension underground. 5. The granting of the variance will not be materially detrimental to the public welfare. Comcast does agree to participate in future underground improvements for its proportionate share of the undergrounding costs, waiving the obligation into the future when all other utilities are undergrounded to prevent an undue hardship against Comcast currently. Comcast proposes to have Cannon Construction, Inc. overlash 96ct fiber approximately 4,182 lineal feet to existing Puget Sound Energy (PSE) poles within the City. Beginning at the pole on the corner of S Renton Village Pl and Talbot Rd S, continuing west for 460’ before crossing onto private property for 1,992 Lineal feet. Overlashing crosses over SR 167 to the pole to the north of property 55 SW 12th St and continues west along the south side of SW 12th St for 1,316 lineal feet before ending at the pole to the north of property 325 SW 12th St. Aerial work continues on SW 16th St at the pole to the south of property 500 SW 16th St and crosses over SW 16th before continuing east for 332 lineal feet and ending at the pole to the northwest of property 1600 Lind Ave SW. ANALYSIS: The City has considered the request for an exemption from RMC 4-6-090. Ordinance 5720 grants Comcast, the right to install fiber optic cable and related appurtenances under, along, over, below, through and across the streets, avenues and alleys of City of Renton within the right-of-way of Renton. Section 3.4 of the franchise ordinance states that if all of the distribution lines all the wireline service providers, such as telecommunications service providers, as defined in RCW 35.99.010, a utility service provider or a Cable Operator (collectively “Service Providers”) in any portion of the Franchise Area are underground, Grantee shall place its Cable System’s distribution cables underground within that area; provided that such underground locations are actually capable of accommodating Grantee’s cable and other equipment without technical degradation of the Cable Systems’ signal quality. The proposal would utilize existing poles with other attached franchisee communication facilities and overlash to the existing Comcast aerial path. As minimum vertical height clearance of 15’-6” would need to be provided for, any existing obsolete cable will need to be removed; staff recommends these as conditions of approval. Therefore, the City is granting an exemption with conditions, per the Comcast franchise agreement which allows new overhead facilities to be placed overhead provided there are other similar providers overhead as well. Comcast is required to obtain all necessary private utility easements for work on private property and any permit required to cross WSDOT right of way. A traffic control plan must be separately submitted to the City, and no construction may take place until the City has approved a traffic control plan. 4. The new aerial fiber lines within the Project Reach must be converted to underground facilities in the future, at Comcast’s cost, when any one of the following events occurs: (1) any other utilities are undergrounded within the Project Reach, (2) a joint use trench is proposed by a franchisee within the Project Reach, in which case Comcast shall participate in the joint use trench installation for the purpose of undergrounding its aerial lines, or (3) a conduit is made available within the Project Reach that will accommodate the aerial lines. The new aerial lines must be undergrounded within one year, or approved otherwise by the City of Renton Community and Economic Development Administrator or designee, from the first event triggering the requirement to underground the aerial lines. This decision to approve the exemption with conditions is subject to a fourteen (14) day appeal period from the date of this letter per RMC 4-8-110. Any appeals of the administrative decision must be filed with the City Clerk, along with the required appeal fee, by 5:00 pm, April 1, 2021.
