Pulte is requesting a modification to the standard that requires overhead utilities to be installed
underground when a property is redeveloped. Due to the many utilities in and along Union Avenue, the
limits on property we control, the feasibility issues outlined following the criteria, and the fact that Pulte
does not own the parcel of land between our main entrance and Lot 25, we request a modification from
the undergrounding requirement along Union Avenue. This modification is justified by the criteria from
RMC 4-9-250-D-2 below:
a. Substantially implements the policy direction of the policies and objectives of the
Comprehensive Plan Land Use Element and the Community Design Element and the proposed
modification is the minimum adjustment necessary to implement these policies and objectives;
New private utilities will be installed underground within the interior of the newly developed
property. Leaving the existing overhead utilities in place does not alter land uses or the
Community Design. Nearly all of Union Avenue from SR 900 to the north end of the site has
these overhead utilities in place.
b. Will meet the objectives and safety, function, appearance, environmental protection and
maintainability intended by the Code requirements, based upon sound engineering judgment;
Leaving the existing overhead utilities in place will actually increase the safety of services
provided by these utilities. As noted below, where poles are being relocated, existing
deficiencies with existing services can be resolved. PSE has concerns with being able to safely
provide service to existing and new customers if the utilities are relocated underground. As
noted above, leaving existing overhead utilities in place will not alter the appearance along
the frontage of Union Avenue.
c. Will not create substantial adverse impacts to other property(ies) in the vicinity;
Leaving overhead utilities in place will not create adverse impacts to other properties. In fact,
attempting to place the utilities underground could create safety issues with service to existing
users as well as new users. Additionally, the project will place conduit in an easement along
the frontage we own in the event placing the utilities safely underground is a possibility in the
future.
d. Conforms to the intent and purpose of the Code; and
This modification conforms to the intent and purpose of the code. As noted above, leaving the
existing overhead utilities in place ensures the safety and welfare of the residents of Renton.

e. Can be shown to be justified and required for the use and situation intended
The physical constraints and safety concerns identified above as well as below characterize the
practical difficulties in conforming to the letter of the Code. By providing the conduit within
easements to allow for safely undergrounding in the future when possible implements the
policies, objectives, and intent of the code.
In addition to the criteria outlined above, we’ve identified several challenges to undergrounding the
existing power and utilities. Please see the attached marked up plans (which are also inset for
convenience) and descriptions below.
1. The house outline on the survey doesn’t include the steps to the front porch. Once the right-
of-way is dedicated there will only be a few feet to locate the trench or other vaults needed
for the underground. The neighborhood across Union Avenue is served from this existing pole
which means that a switch vault, a transformer, and a junction vault will be needed to
maintain these services. In addition, we don’t have an easement on this parcel and we don’t
control it either and the owners are not interested in accommodating an easement.
2. Related to the easement issue, the transformer needed to serve this house and the
development to the east is an above ground transformer so it cannot be located in the planter
or sidewalk.
3. We could potentially locate this junction box, switch, and transformer on the parcel to the
south we do control. However, this parcel is narrow and all of the equipment will take up
approximately 50% of the total lot width.
4. In addition, the voltage drop to the services to the existing house to the north requires the
transformer to be oversized which is an explosion hazard for the service on lot 25.

5. The pole at the south end of our underground needs to be relocated because of the sidewalk
tie in. There is a service to the east that crosses another parcel without an easement. If PSE
touches this service it has to be upgraded to be in compliance with their standards. Because
of the slope up to this lot it becomes difficult either because the underground needs to go up
the slope, or the service length gets to be too long with excessive voltage drop. If this service
remains overhead, PSE can tie it off their primary feed and keep the service off the adjacent
parcel and remove the existing noncompliant service.
6. Lastly, there are four telecom lines on the poles, three of which are confirmed fiber optic
lines. PSE records show that one of these is the telemetry for the pump station, one is for
Renton School District, and one is for Centurylink. Fiber optics can’t be cut so they would

either need to be spliced or replaced completely to underground just this 500 feet of
frontage.
7. You may recall when we were working through the conflict of the storm and the SPU water
main that SPU was adamant that we can’t place a CB on their main. This CB we’re connecting
to doesn’t have a sump and was likely cast in place. We really struggled with finding a
solution that didn’t change the angle of the outlet so we didn’t have to replace this CB. The
HPDE line that allowed us to come out straight but deflect the line to a new alignment was the
best solution. Even if we pursued the option across the street and opened the space under the
sidewalk, it doesn’t solve the matter due to the remaining above ground issues with vault
location, fire hazard, existing overhead services, and communication conflicts.
