Hi Jill,
Thanks for the clarification. Because they are applying for 2 variances (one for added height in setback
and one for building coverage), they’ll need to demonstrate that each one meets the shoreline variance
criteria in WAC 173-27-170 and RMC 4-9-190.I.4.
My main feedback is on the following shoreline variance criteria from WAC 173-27-170:
· (2)(a): “That the strict application of the bulk, dimensional or performance standards set forth in
the applicable master program precludes, or significantly interferes with, reasonable use of the
property.”
o As the applicant notes in their project narrative, “The reasonable use of the property
includes the right to use the property for single-family dwelling in the R-6 zone, and
within the Single-Family Residential SED.” It’s not clear how a strict application of the
SMP standards would significantly interfere with this identified reasonable use of the
property, which already contains a single family dwelling, and thus already has
reasonable use. If the shoreline variances were denied, it appears that the applicant
would still have a useable single family dwelling. It sounds like part of the footprint
expansion is necessary to construct a garage on the site. Garages are identified as an
appurtenances to single family residences in WAC 173-27-040(2)(g), meaning they are
“necessarily connected to the use and enjoyment of a single-family residence.” If the
existing residence does not have a garage, then there may be an argument that the
shoreline variance for the footprint expansion is needed to accommodate a structure
appurtenant to single family uses. However, this justification does not apply to the
height increase variance.
· (4): “In the granting of all variance permits, consideration shall be given to the cumulative
impact of additional requests for like actions in the area. For example if variances were granted
to other developments and/or uses in the area where similar circumstances exist the total of the
variances shall also remain consistent with the policies of RCW 90.58.020 and shall not cause
substantial adverse effects to the shoreline environment.”
o A response to this criterion is missing and should be included in the applicant’s
narrative.
I would recommend the applicant enhance their justification for these criteria. Ultimately, Renton and
Ecology cannot approve a shoreline variance if it is not consistent with every one of the criteria. Right
now, I’m not seeing sufficient justification for the variances, especially the variance for the added height
in the setback.

Hi Maria,
Thanks for taking a look at this project. There are 2 shoreline variances that the applicant is requesting:
1. They are requesting a 3rd story at just under 30 feet in height, of which a majority of this
additional story is located within the non-conforming shoreline setback.
2. The are requesting a variance to the 25% lot coverage requirement for buildings as required
under RMC 4-3-090D.7.a

Hi Jill,
I’ve taken a look at the site plan and the applicant’s project narrative that you shared. Just to confirm, is
the shoreline variance for the 3rd floor a variance to the SMP height limit or a variance to the shoreline
setback to allow an expansion of a structure non-conforming to the setback? I’m drafting some
feedback, but it will be helpful to better understand which SMP standard they’re requesting relief from.

Hi Misty,
We have received an application for a remodel/addition to an existing single family residence, located at
3901 Lake Washington Blvd N. A portion of the existing residence is located within the existing shoreline
setback. They are requesting shoreline variances to add a 3rd story within the existing building footprint
and to exceed the maximum building coverage permitted. I have attached a proposed site plan, building
elevations, and a project narrative to give you more information regarding the proposal. Could you take
a look and let me know if you have any initial comments as we move this proposal through the land use
review process?
