Number 1323054086(hereinafter,collectively referred ta as'°Grantor"),for and in considera8ion of mutual benefits,do
by these presents, grant, bargain, sell, convey, and warrant unto the City of Renton (hereinafter "Grantee"), its
successors and assigns, an easement for public utilities (including water, sanitary sewer, and storm drainage) with
necessary appurtenances over, under, through, across and upon the property in King County, Washington, legally
described above(the"Property").
This easement is granted for the purpose of constructing, reconstructing, installing, repairing, replacing, enlarging,
operating and maintaining utilities and utility pipelines, including, but not limited to,water,sanitary sewer and starm
drainage,together with the right of ingress and egress thereto without prior institution of any suit or proceedings of law
and without incurring any legal pbligation or liability therefor. Following the initial construction of its facilities,Grantee '
may from time to time construct such additional facilities as it may require or desire. This easement is granted subject
to the following terms and conditions:
1. The Grantee shall,upon completion of any work within the Property,restore the surface of the easement,
and any private improvements disturbed or destro ed during execution of the work, as nearly as

� the easerrsent rights granted to the Grante�. Grantor shaPl not,however,have the right to:
Ia. Erect or maintain any buildings or structures within the easement;or
I� b. Piant trees,shrubs or vegetation having deep root patterns which rrray cause damag�to or interf�re with
the utifities to be piaced withira the easemerr4 by the Grantee;or
c. Develop,landscape, or beautify the easement area in any way which would unreasonably increase the
easts to the Grantee of restoring the�asement area and any private improvements therein;or
d. Dig,taanreel or perform ather#orms of constructian actrvities nn the Property uvhich would disturb the
campaction or unearth Grantee's facilities on the Property or on the right-of-way,or endanger the lateral
support facilities;or
e. Blast within fifteen(15)feet of the easement;or
f. Erect fences+n such a way as Yo�revent access by the Grantee's vehicfes to the Grantee's faciiities. Any
fence construction must provide for an opening(gated,removabfe sections,barriers,etc.}of at least ter�
(10)feet in v✓idth;or
g. Erect any objects vnrithin fifteen(15)feet above the ground surface within the easement.
This easement shald ruro with the land described herein, and shall be binding upan Grantor, Grant�e, their heirs,
successors in interest,and assigns.Grantor covenants that it is the lawful owner of the above property(ies)and that it
has a good and lawfuf right tn execute this easement. By signing this instrument, Grantor certifies �nder penalty of
perjury under the laws of the State of Washington that heJshe/iY/they is/are authorized to sign this easement as Grantor
' or on behalf af the Grantor.
� Grantor shall protect,save and hold harmless,and defend,with eounsel of Grantee's sole reasonable choice,Grantee,
its employees,its tenant(s),its successors,assigns,customers and invitees,from all claims,actions,filed or threatened,
costs, damages,or expenses of any nature�nrhatsoever arising out of or in connection vvi4h any acts or omissions of
Grantor on connection with this easement. The obligation to protect, save and hold harmless, and defend shalB not
include such claims,actions,costs,damages,or expenses which may be caused by the sole negligence of Grantee or its
tenant(s},or their successors or assigns; provided that if the ciaims actions,costs,damages,or expenses are caused by
or result from concurrent negligersce of(a)Grarotee or its tenant(s),or their successors or assigns and(b)Grantor,its
agents,contractors or assigns,and involves those actions covered by RCW 4.24.115,this indemnmty provision shall be
valid and enforceable�nly to the extent of#he negligence o#Grantor,its agents,corotractors or assigns. Grantor shall
prompt(y notify Grantee and its tenant(sj of any Ioss,damage,injury nr death arising out of or in cannection with any
acts or omissions of Grantor in connection onrith 4his easement.
Any lav✓suit or le�al action brought by any party to enforce or interpret this easernent or any of its terrns or covenants
shalP be brought ira the Kirtg County Superior Court for the State of Washing4on at the Maleng Regional Justice Center in
Kent,King County,Washington,or its rep0acement or successor. Grantor hereby expressly cansents to the personal and
excBusive jurisdiction and venue of such court even if Grantor is a foreign entity registered,or not registered,with the
5tate of Washington.
