facilities include pipes, channels, flaw contral facilities, water quality facilities, an-site best
management practices (BMPs) and other engineered structures designed to rnanage and/ar

mainten�nee activities specified in this Declaratican of Ccavenant and in accmrdance with the
Rentcan N�iunicipal Cade.City af Rentart shakl pr�uide at 9east thirty(30)days'written notic�ta
the Owners that entry on the PrQperty is planned far the inspectinn aF drainage facilities.After
the thirty(30)days,the Owners shall allaw the City of Rentan ta enter for the sale purpase of
inspecting drainage fa�ilities.In lieu nf inspection ay the City,the Qwners may elect ta engage
a licens�d civil engineer registered in th�state af Washingtcan wha Mas expertise in drainage ta
inspect the drainage facilities and provid� a written r�port describing th�ir canditian. If the
engineer aption is chosen,th�t7wners shall provide written notice to the City of R�nton within
fifte��n(15)days of receiving the City's natice of inspectia�.Within thirty(3Qk days r�f giving this
natice,the Owners,or engineer on belialf of the Qwners,shall provide the engineer's report to
the City of Renton.If the report is ncat pravided in a timely manner as specified�bove,the City
of Renton m�y inspect the drainage facilities without further notice.
�. 1f City o� I��ntQn determines from its inspe�tic�n, ar frorn an engineer's report pravided in
ac�ordance with paragraph�,that maintenance,repair,restaration,a�dfor mitigation work is
required to be done to any af the drai�age facilities,City af Rentan shall notify the Qwners of
the speciPic maintenanee, rep�ir, restnr�tian, and/ar mitigation work ("Vllark") rec�uired
pursuant ta the Ftentfln Municipal Cade.The City shall alsc�set a re�seanable deadline far the
(�vuners ta complete the Wark, or to provide an engineer's reporC that verifies completian nf
the Wnrk. After the deadline has passed,the Owners sh�ll allow the City access Ya re-inspe�k
the drainage fac4lities unless an engineer's report has been provided veri�ing cr�mpl�tic�n of
the Work. If the Wvrk is nc�t tompleted within the time fr�me set by the City, the City may
initiate an enfor�ement action and/ar perfarm the Work and hereby is given actess to the
Property f4r such purposes. Written ncstice will kae sent to the Owners stating the City"s
intentian to perform such Wark.This Work will nat cammence ue�til at I�ast seven(7')days after
such nntice is m�iled. If, within the sole discretion of the City, ther� exists an imminent ar
present danger, th� seven (7} day notice period will be waived and Wark will begin
immediately.
4. The Owners shall assume all responsibility far the cost af any Work,or any measures taken by
the City tc� address conditions as described �n Para�raph 3. Such responsibility shall irrclude
reim�ursement to the City within thirty C30j days of the receipt of the invoice for any such Work
performed. Uverclue payments wil{ requir� payment of Interest at the maximum legal r�te
al�owed by RCW 19,52.�24(currently twe{ve percent(12°/b��, Vf the City inil:iates IQgal action to
enforce this agreement, the prevailing p�rty in such action is entitled to recovpr reasanable
litigatian costs and attorney's fees.
5. The t�wners are required tca obtain written appraval from City af Renton pr�ar to fillin�,pipin�,
cuttiing,or remaving v�getatican (ex�ept in routine landscape maintenance)in np�n uegetated
stormwater facilities (such as swales, chann�ls, ditckres, ponds, etc.), ar performing any
alterations ar modi�catians to the draina�e facilities referenced in this Declaration of Covenant.

6. Any natice ar consent requir�d to be given ar otherwise prcrvic�ed fnr by the provisions of this
Agreement shall be effective upern persc�nal deliuery,ar thr�e(3�days after rnailing by Certified
Mail, return receipt requested.
7. With regard ta the m�tters addr�ssed her�ein,this agreemenz cc�nstitutes the entire agreement
between the parties, and supersed�s all prior discussfons, negotiatic�ns, and all agreements
whatsoever whether aral c�r written.
8. This Declaratior� af Cpvenant is intended to protec# the value anrl desirability and promcrte
efficient and ef�ective man�gement af surface water drainage of the real property d�scribed
�bave, �rrd shall inure to the benefit caf aCl the citizens of khe City of Rentan and its successcars
and assi�ns. This Declaration af Cavenant shall run with the land and be fainding upon
Grantc�r(s),anrl Grantor`s(s')successors irr interest,and assigres.
9. This �eclaraticrn af Govenant may be terminated by execa�tion of a written agreernent by the
Qwners and the City that is r�corded by King County in its real praperty recards.

MAINTENANCE INSTRUCTIONS FOR FULL INFILTRATION
Your property contains an on-site BMP (best management practice) called"full infiltration,"which
was installed to mitigate the stormwater quantity and quality impacts of some or all of the impervious
surfaces on your property.
Full infiltration is a method of soaking runoff from impervious area(such as paved areas and roofs)
into the ground. If properly installed and maintained per Appendix A of the City of Renton's Surface
Water Design Manual, full infiltration can manage runoff so that a majority of precipitation events are
absorbed. Infiltration devices, such as gravel filled trenches, drywells, and ground surface depressions,
facilitate this process by putting runoff in direct contact with the soil and holding the runoff long
enough to soak most of it into the ground. To be successful,the soil condition around the infiltration
device must be reliably able to soak water into the ground for a reasonable number of years.
Infiltration Devices
The in�ltration devices used on your property include the following as indicated on the site
plan(CHECK THE BOX(ES)THAT APPLY):

MAINTENANCE RESTRICTIONS
The size,placement, and composition of these devices as depicted by the site plan and design details
must be maintained and may not be changed without written approval from the City of Renton or
through a future development permit from the City of Renton.
INSPECTION FREQUENCY AND MAINTENANCE GUIDELINES
• Infiltration devices must be inspected annually and after major storm events to identify and
repair any physical defects.
• Maintenance and operation of the system should focus on ensuring the systein's viability by
preventing sediment-laden flows from entering the device. Excessive sedimentation will result
in a plugged or non-functioning facility.
• If the infiltration device has a catch basin, sediment accumulation must be removed on a yearly
basis or more frequently if necessary.
• Prolonged ponding around or atop a device may indicate a plugged facility. If the device
becomes plugged,it must be replaced.
• Keeping the areas that drain to infiltration devices well swept and clean will enhance the
longevity of these devices.
• For roofs, frequent cleaning of gutters will reduce sediment loads to these devices.
