A snip of the pertinent section is below: We request that the required right-of-way dedication be reduced to 5.5’ from 15.5’ to eliminate the unused portion of the right of way. The following shows this request to be consistent with RMC 4-9-250(D)(2) outlining criteria for approving Modification from Standards: A. Substantially implements the policy direction of the policies and objectives of the Comprehensive Plan Land Use Element and the Community Design Element and the proposed modification is the minimum adjustment necessary to implement these policies and objectives; The physical features of the roadway will be unchanged from the required road, bicycle, landscape strip and sidewalk features. The unused portion of the required right of way dedication will only be eliminated, satisfying the objectives of the Comprehensive Plan Land Use Element and the Community Design Element. B. Will meet the objectives and safety, function, appearance, environmental protection and maintainability intended by the Code requirements, based upon sound engineering judgment. The physical features of the roadway will be unchanged from the required road, bicycle, landscape strip and sidewalk features. The unused portion of the required right of way dedication will only be eliminated. C. Will not be injurious to other property(ies) in the vicinity; The proposed right-of-way dedication aligns with the existing properties along 156th Ave SE, including those that have been recently developed. See Neighborhood Map. D. Conforms to the intent and purpose of the Code. The physical features of the roadway will be unchanged from the required road, bicycle, landscape strip and sidewalk features. The unused portion of the required right of way dedication will only be eliminated. E. Can be shown to be justified and required for the use and situation intended. The preapplication conference communication provides support from Staff in conjunction with Transportation Division that the proposed modification has been previously determined to be amenable. F. Will not create adverse impacts to other property(ies) in the vicinity. The physical features of the roadway will be unchanged from the required road, bicycle, landscape strip and sidewalk features. The unused portion of the required right of way dedication will only be eliminated, allowing the additional space to be absorbed by the proposed development.
