Without putting the necessary documentation together ahead of time, this case just has too many moving parts to resolve in one sitting in a hearing. Once we all have a better idea of what happened in the permit review process, we can figure out what witnesses, if any, are necessary to complete this evidentiary hearing. It appears that Ms. Locher has done a pretty good job of assembling all the email correspondence to identify the timing of document requests and responses from your permit team. At this point, as I mentioned before, I need to assess the reasons for the delays in response to see if they were reasonably justified. From what I've been able to gather from the emails provided by Donna, the first reason for delay was COVID and your consultant not being able to work from home. The second delay according to Rich (don't have his last name) was he made calls to Renton and they weren't returned. Do you have records of when those calls were made and when they were finally returned? A third delay I saw was Rich stating that a correction notice changed the review process and for the first time required a sewer permit to be reviewed in conjunction with the building permit application. I could not find a correction notice requiring the sewer permit. Could you send that to me or identify which of the correction notices that Donna has provided includes this sewer requirement? Finally, Rich said the City has changed the rules again and required structural engineering changes. Could you identify what those changes are, preferrably with documentation from the city requesting the changes? Any other documentation you have that helps explains the extraordinary time this permit review has taken would be very helpful. As you may recalled Donna said "It's not my job" to know what the City requesting. It's been my impression that City permit department and Donna are not on the same page. It's very frustrating to get multiple Violation notices from Donna since the City is in charge of issuing the permit. Is it possible to get someone from the City to get their statement as you mentioned in the hearing to resolve this? As you may recall, I need to determine if you took an unreasonably amount of time to respond to the City's requests for additional information and revisions on your building permit applications. The email that Ms. Locher sent shows that the City asked for plan revisions on March 17, 2020. The emails you have provided in response shows that the first response from your consultant was on April 30, 2021, more than a year later after the City's March 17, 2020 request. Was April 30, 2021 your first response to the City's March 17, 2020 request for permit revisions/information? We are not sure what permit to apply for to get this private sewer connection reviewed. We are assuming a straightforward side sewer permit, but there is a small pump station that will also be installed with this sewer connection. Please let me know if we should apply for a side sewer permit or other permit. Thanks for your help.
