Jack Wilson expressed doubt that itshould be included and noted that the Bakamus matter had been resolved, the Gas Company also expressing some concern in this regard. Do you think such insertion feasible or should the companies work that out with petitioners for the vacation" Thanks for opinion on the matter. As you know, we had prepared the subject deeds in October of 1968 based on the information furnished to us by the City Engineer' s office. At that time Mr. Milfred was not listed as any proposed Grantee. Assuming that the City Engineer has verified this ownership and the description, then there is no objection to delete the words "Cheltenham Properties , Inc. , a Delaware Corporation" and in lieu thereof insert the names of Mr. Fred Milfred and his wife, and if not married, then show him to be an unmarried man. We would recommend that the City Engineer check over the legal description to be sure it is absolutely correct. We were unable to ascertain at the Council meeting on Monday, August 26th, whether the City intends to retain an easement or not. If there is such an intention, then, of course, the Ordinance should be changed to spell out the location of the easement to be retained. We notice, however, in the limited liability report issued by Pioneer Title Insurance Company that Mr. Barei had forwarded to us that there are certain easements of record. These should be checked out by the Engineer and it should be determined whether they are to be vacated or not which, of course, is an engineering question. The appropriate amount should be inserted in Section I and we would appreciate having a copy of the appraisal for our file. We are also sending a copy of the above referenced limited liability report to the Engineer since we should be furnished, as previously requested, the names and addresses of the abutting owners, or their assignees, who are purchasing the City's interest in the vacated area. We shall be glad to prepare the necessary deeds once this information has been furnished to us, together with the correct legal descriptions for each parcel to be so conveyed. Although I have not received any information from the City Engineer as to the plat dedication, it would appear from Item 18 of the Title Report that the City has an ease- ment in said roadway. This is the usual procedure since the City holds the easement in trust for the benefit of the public and the underlying fee is owned one half each by the respective abutting owners. As a matter of law, upon vacation of a roadway, one half vests in each of the said owners. There- fore any appraisal, as previously stated, would be predicated on the City's easement rights to said public street. Audience comment was invited and Attorney John Dobson, on behalf of petitioners, noted that the street has not been open to for public travel since 1960, widening of Sunset not affecting the property, other properties also lying between Sunset & 10th Place, and the development would open up the area to the South. Also,the development of the through street and three building sites of approximately 28,000 sq. ft. , would allow utilizing of access road to Sunset for ingress and egress. Moved by Delaurenti, seconded by Edwards, the hearing be closed. Carried. The hear- ing was declared closed and council action invited. Upon inquiry, City Engineer Wilson noted existing 8" water line within the street which has been abandoned and replaced, and sanitary sewer running half way through and dead ending and a 2" gas main. It was noted by Mr. Dobson that the gas Company advised the line can be re- located with no problem and the other utilities merely serve area within the property and proposed improvement, Albertsons Store being served otherwise at present. Carried. el May 22, 1968 City Council Re: STREET VACATION AT 10th PLACE Gentlemen: The Board of Public Works reviewed the proposed Street Vacation of 10th Place between "J Street and "K" Street.at the Boards regular. meeting May 21, 1968. It is the recommendation of the Board of Public Works, that the request be denied for the following reasons: (a) With the proposed widening and improve- ments to Sunset Blvd by the State High- way Department, 10th Place will become more and more important as a frontage road to permit circulation among the adjoining properties, (b) The present utilities in the street right-of-way indicate that the street will be continued to be used for that purpose. Mayor Custer recalled that Mr. Eckart of the Railroad Company had been invited to the Public Hearing meeting on the pending Franchise to be held Aprill 22nd, however since he will be unable to attend, it is requested that the hearing be continued until May 6th. Moved by Trimm, seconded by Maxin, to concur, continuing the hearing until said date as requested. Carried. City Attorney Shellan noted than anyone may be heard on the 22nd if they desire and the hearing can then be continued. Letter from Mr. Anthone R. Durkan, Senator and Chairman of the Municipal Committee, submitted list of Municipal Code and Citizen's Advisory Committee Members and advised that hearings will be held on the Code during the 1967-69 biennium to allow all in- terested persons to appear and submit suggestions for amendments.
