AN ORDINANCE OF TIIE CITY OF RENTON, WASHINGTON,
VACATING PORTION OF 150th PLACE , 83rd AVENUE
SOUTH, CERTAIN ALLEYS, ALL IN C. D. HILLMAN' S
EARLINGTON GARDENS, DIVISION NO. 1, SITUATED IN
RENTON, KING COUNTY, WASHINGTON.
WHEREAS a proper petition for vacating of certain streets
and alleys as hereinafter more particularly described was duly filed
with the City Clerk on or about November 21, 1968, and said Petition
having been signed by the owners of more than two-thirds of the
property abutting upon such streets and alleys sought to be vacated ,
and
WHEREAS the City Council by Resolution No. 1590 approved
and passed on December 9 , 1968 , and after due investigation did fix
,. and determine the 13th day of January, 1969, at the hour of 8 : 00 P.M.
in the City Council Chambers of the City of Renton to 1-)e the time and
place for public hearing thereon, and directed the Clerk to give notice
of such hearing in the manner provided by law, and such notice having
been duly given and published, and after such public hearing, the
City Council did Fix +:Ind dc•,L{,rmi.ne a renewed hearing on said Petition,
which such additional hearing was duly held on the 7th day of April,
1969, and notice thereof was duly given and published as required
by law, and all persons having been heard appearing in favor of or
in opposition thereto , at both of such hearings; and
WHEREAS the Planning Commission having duly considered said
Petition and said vacation as hereinafter more particularly described
being found to be in the public interest and for the public benefit,
and no injury or damage to any person or properties will result ,
therefrom; and
WHEREAS the City Council caused to have made an appraisal
of the properties sought to be vacated as provided for in City of
Renton Ordinance No. 2349 ; NOW THEREFORE
BE IT ORDAINED BY THE MAYOR AND THE CITY COUNCIL OF THE
CITY OF RENTON, WASHINGTON, AS FOLLOWS :
SECTION I : The following described streets, portions of

fully set forth,
BE AND THE SAME ARE HEREBY VACATED, SUBJECT TO PAYMENT UNTO
THE CITY BY THE ABUTTING OWNERS THEREFOR, OR THEIR ASSIGNEES, OF THE
TOTAL SUM OF $ , WHICH SAID SUM DOES NOT EXCEED ONE-HALF
OF THE APPRAISED VALUE OF THE AREAS SO VACATED ; AND FURTHER SUBJECT
TO the presently existing utility line located on South 150th Place
pending relocation thereof within that certain 30 foot utility easement
granted and conveyed by the vacating owners unto the City of Renton
and located along the South 30 feet of Petitioners' property, as more
particularly described on that certain easement executed simultaneously
herewith in favor of the City of Renton; said relocation of the
existing power line shall be at the expense of the petitioning owners
or as otherwise agreed on between said owners and Puget Sound Power
and Light Company.
SECTION :CT: : This Ordinance shall be in full force and
effect from and after its passage , approval and legal publication
as provided by law. A certified copy of this Ordinance shall be
filed with the King County Auditor' s office and as otherwise provided
by law.

83rd Avenue South)lying between the southerly margin of Southwest Grady Way (formerly
Grady Way-Penton Junction Way) and the northerly margin of PSH No. 1-RE (FA1 #r405) .
TOGETHER with all that portion of Southwest 12th Street (formerly South 150th
Place) lying between the easterly margin of Thomas Avenue Southwest (formerly 83rd
Avenue South) and the westerly margin of Raymond Avenue Southwest (formerly 84th Avenue
South) .

Dear Lyman:
This is to acknowledge receipt of your letter dated July 31, 1969
together, with the proposed !:ricC3T."rlt from Homeland Associates, Inc.
et al. We prt:cui e that the legal description has been checked and
verified by your office and is fully satisfactory to the City.
We believe that in the second paragraph entitled "Access" , third line ,
the oord "haintining should also be added since it is also mentioned
in r arav raph 1, the Purpose clause, I am somewhat concerned about
the City's liability re+;ard:inr; compensation to the Grantor for any
dama e done to r;rentors ' property caused by the exercise of the right
of access. This for the reason that the Grarttor still retains Mc
right to use said property except for the construction of any building.
Conceivably, the Grantor could place other improvements within the
ease .mt right of way which would undoubtedly complicate any maintenance
or construction. It mi aht be preferable for Grantee if the Grantor
were proiiibite:1 frow.. constructing "any building or structure of any
type that would interfere with Grantee 's rights herein e ranted.
We are also wondering whether the' Power Company will assume the
obligation of cuttirtr! or trimming; trees so that the City will not be
bothered with this problem.
Except for the above comments, the proposed Easement is in proper
legal form.
Asp mentioned several times before, it would save time if any such
document is submitted to our office before the signatures have been
affixed in order to make any necessary corrections prior to execution.

acknowledged, HOMELAND ASSOCIATES , INC. , a Washington corporation,
and M. B. INVESTMENT CO. , a partnership consisting of Mike W. Lotto,

in the City of Renton , in the northeast one quarter
of Section 24 , Township 23 North , Range 4 East, W.M. :
The southerly 30 feet of blocks 38 and 40
abutting P.S.H. #1-RE (SR #405) .
Also , the southerly 30 feet of 83rd Avenue So.
lying northerly of PSH #1-RE (SR #405) . Also
that portion of the vacated alley within the
southerly 30 feet of block 40 .
Also , an easement 30 feet in width over that
portion of the west 10 feet of Lot 27 and all
of Lot 28 , Block 40 , lying northerly of PSH
#1-RE (SR #405) having 15 feet of such width on
each side of a center line described as follows :
Beginning on a point 10 feet east of the west
line of lot 27 , block 40 of said plat, at a point
15 feet north of the northerly margin of PSH #1-RE
(SR 405) ; thence northwesterly to a point on the
east margin of 80th Avenue South , said point being
5 feet north of the northwest corner of Lot 28 ,
block 40 , and the end of said center line.
Also together with all the remainder of Lot 28 ,
Block 40 , not previously described.

1 . PURPOSE. Grantee shall have the right to construct,
repair, replace, service and maintain water lines, sanitary sewer
lines, and storm sewer lines and any other public utilities and
services over and/or under the above-described easement. In addition,
Puget Sound Power & Light Company, a Washington corporation, its
successors and assigns, shall have the right to construct, operate,
maintain, repair, replace and enlarge one or more electric trans-
mission and/or distribution lines over and/or under the easement
together with all necessary or convenient appurtenances therefore,
which may include but are not limited to the following:
a) Overhead facilities . Poles and/or towers with
crossarms , braces, guys and anchors; electric
• transmission and distribution lines; communication
and signal lines; transformers .
b) Underground facilities. Underground conduits,
cables, vaults, manholes, switches and transformers;
semi-buried or ground mounted facilities such as pads,
transformers and switches .
2 . ACCESS . Grantee and Puget Sound Power & Light
Company shall have the right at time as may be necessary, to enter
upon Grantors ' property for the purpose of constructing, repairing,
altering or reconstructing said utilities or making any connection
therewith, without incurring any legal obligation or liability
therefore; provided, that grantee and Puget Sound Power & Light
Company shall compensate grantors for any damage to grantors '
property caused by the exercise of said right of access .
3 . CUTTING OF• TREES . Grantee and Puget Sound Power &
Light Company have the right to cut or trim any and all brush or
trees standing or growing upon the easement, and also the right
to cut or trim any trees upon grantors ' property which, in falling,
could, in grantee ' s and Puget Sound Power & Light Company ' s
reasonable judgment, be a hazard to grantee 's and Puget Sound
Power and Light Company ' s facilities .

4 . GRANTORS USE OF EASEMENT. Grantors reserve the
right to use the surface of said easement for any purpose not inconsistent
with the rights herein granted, provided that grantors shall not construct
or maintain any building on the easement and grantors shall do no blasting
within Three Hundred (300) feet of grantee ' s and Puget Sound Power &
Light Company 's facilities without prior written consent.
5 . INDEMNITY . By accepting and recording this easement ,
grantee and Puget Sound Power & Light Company agree to indemnify and
hold harmless grantors from any and all claims for damages suffered by
any person which may be caused by grantee or Puget Sound Power. & Light
Company exercise of the rights herein granted, provided that grantee
and Puget Sound Power & Light Company shall not be responsible to grantors
for any damage resulting from injuries to any person or damage to
property caused by acts or omissions of grantors .
6 . SUCCESSORS AND ASSIGNS . The rights and obligations
of the parties shall inure to the benefit of and be binding upon their
respective successors and assigns.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
VACATING PORTION OF 150th PLACE , 83rd AVENUE
SOUTH, CERTAIN ALLEYS, ALL IN C. D. HILLMAN' S
EARLINGTON GARDENS, DIVISION NO. 1, SITUATED IN
RENTON, KING COUNTY, WASHINGTON.
WHEREAS a proper petition for vacating of certain streets
and alleys as hereinafter more particularly described was duly filed
with the City Clerk on or about November 21, 1968 , and said Petition
having been signed by the owners of more than two-thirds of the
property abutting upon such streets and alleys sought to be vacated,
and
WHEREAS the City Council by Resolution No. 1590 approved
and passed on December 9 , 1968 , and after due investigation did fix
and determine the 13th day of January, 1969 , at the hour of 8 : 00 P.M.
in the City Council Chambers of the City of Renton to be the time and
place for public hearing thereon, and directed the Clerk to give notice
of such hearing in the manrer provided by law, and such notice having
been duly given and published, and after such public hearing, the
City Council did fix and determine a renewed hearing on said Petition,
which such additional hearing ww.s duly held on the 7th day of April,
1969 , and notice thereof was d"J.y given and published as required
by law, and all persons having been heard appearing in favor of or
in opposition thereto , at both of such hearings ; and
WHEREAS the Planning Commission having duly considered said
Petition and said vacation as hereinafter more particularly described
being found to be in the public interest and for the public benefit ,
and no injury or damage to any person or properties will result
theref:2om; and
WHEREAS the City Council caused to have made an appraisal
of the properties sought to be vacated as provided for in City of
Renton Ordinance No. 2349 ; NOW THEREFORE
BE IT ORDAINED } ; THE MAYOR AND THE CITY COUNCIL OF THE
CITY OF RENTON, WASHINGTON, AS FOLLOWS:
SECTION I : The following described streets, portions of

TOTAL SUM OF $ 11 ,554.90 , WHICH SAID SUM DOES NOT EXCEED ONE-HALF

TO the presently existing utility line located on South 150th Place
pending relocation thereof within that certain 30 foot utility easement

herewith in favor of the City of Renton; said relocation of the
existing power line shall be at the expense of the petitioning owners

Dear Jack:
We are handing you herewith original and two copies of a proposed
Ordinance to be passed on by the Council at its next meeting on
April 7 , 1969 , providing for the vacation of streets and alleys
in the Earlington Flats area. Would you please prepare the
Exhibit "A" consisting of the legal description of the areas to
be vacated, duly proof-read , but exempting the portion, as
determined at the last Council meeting , abutting the property
in Block 41 owned by E. R. Turner.
The City Council or your office should also insert the amount in
Section I that is to be paid by the Petitioners to the City of
Renton.
You will note that we have made reference to the existing power
line , subject to its re-location along the south 30 feet of the
owners ' property. Latter should submit to your office and ours
the easement which should be for all utilities and related purposes
and same should be made available to the City simultaneously with
the additional hearing on this matter on April 7 .

RESOLUTIONS ADOPTED BY THE COUNCIL
Resolution No. 1603 was read authorizing the appropriation of $24,000.00, unexpended
balance in the Street Department Fund #1320, Capital Outlay 605 for 1968, unto the
1969 budget. Moved by Trimm, seconded by Edwards to adopt the legislation. Carried.
Councilman Shane inquired regarding anticipated street repair and maintenance program
for the coming year. Budgetary allocations were outlined and attention called to the
specific locations designated within the budget. Mayor Custer advised he could make
available a list of neighborhood streets contemplated to be repaired, noting the
Capital Improvement Priority program contains some such items and rendered explanation
of revisions which may result in the list such as unanticipated mode of funding, in
some instance, or emergency need in others. Councilman Barei requested a list of the
streets being contemplated for repairs.
Resolution No. 1604 was read authorizing transfer of Street Department unexpended funds,
1968 budget account 1320, from Account 306, $1,300.00; 416, $3,500.00; 419, $3,500.00;
and 110, $2,003.00, in total sum of $10,303.00, unto Acct. 315, Equipment Rental.
Moved by Schellert, seconded by Edwards, to adopt the legislation as read. Carried.
Resolution No. 1605 was read, authorizing execution and delivery of a contract with
Puget Sound Power and Light Company for furnishing municipal water pumping power for
the Cedar River Park Pump #8 for a period of ten years. Moved by Trim, seconded by
Maxin, to adopt the legislation as read. After discussion regarding the need for
such a contract and among other reasons it being noted the city is thereby guaranteed
a specific rate, Committee referral and report was noted along with concurrence by
the Council and subsequent referral for the Resolution now before the body. Vote on
the pending motion was declared to be in affirmative majority and carried.
CORRESPONDENCE AND CURRENT BUSINESS:
oved by Perry, seconded by Schellert, the matter of vacating streets and alleys,
South 150th Place, 83rd Avenue South and the alleys adjoining, between 80th and 84th
Avenues South, be taken from the table and placed before the council for discussion
at this time. Carried.
Letter from N. E. Todhunter, Puget Sound Power & Light Company advised that new
alignment of 115 KV electric pole line as proposed by vacation petitioners is
satisfactory providing adequate right of way easements are granted and costs in
connection therewith are paid.
Letter from Attorney Norman Winn, on behalf of Mr. R. E. Turner, owner of Lots 29
through 41, Block 41, advised that satisfactory access has not been offered and 80th
Avenue South would not constitute access since the terrain is not feasible for a road
at that point. Present zoning was noted as R-1, the use for which would not be per—
mitted in event of proposed vacation. Validity of the petition was questioned in
regard to statutory requirements as to ownerships and attention was called to
the fact that abutting owners adversely affected by vacations must be compensated
for damages and that vacations are void if made solely for private benefit of
adjoining owners without some element of public use.
Letter from City Engineer Wilson reported examination of the request for relocation
of utility line and easements and reported that a 30 ft. wide easement would be
adequate for purposes of present or future utilities and it was suggested that the
easement be Located adjacent to the freeway rather than in South 150th Place,
assuming petitioners arrange to have the existing power line easement moved to the
freeway.
Letter from Hullin, Ehrlichman, Roberts & Hodge, by John E. Phillips, Attorneys for
Petitioners, reported willingness to grant an easement for utility purposes over the
south 30 ft. of all of blocks 38 and 40 in C. D. Hillmans Earlington Gardens, Div.
#1, and to pay reasonable costs to move the power lines now running along 150th Place
South between 80th Avenue South and 84th Avenue South to location with the easement
described so long as power line is placed 10 ft. from PSH. #1. Petitioners agree to
grant the City a 30 ft. easement for water and sewer facilities prior to getting a
building permit and will work out with the City Engineer the most reasonable place
for such easement.
Moved by Perry, seconded by Shane, to grant the vacation as requested providing it
is agreeable to the City Engineer. Discussion ensued wherein both Mr. Turner and
the Attorney for petitioners were allowed to address remarks to the Council. (Cont.)

CORRESPONDENCE AND CURRENT BUSINESS
Vacation of Streets and Alleys in Earlington Flats
City Engineer Wilson , upon inquiry regarding access , reported that this
is a matter of whether one ownership is considered; that some of the lots
could have only an alley access but the total frontage is abutting a 30
foot street assuming the vacation were granted .
It was pointed out during discussion that without proper fill there would
still be an access problem.
Upon inquiry regarding access problem, Mr . E . R. Turner submitted a
diagram of the property and a plan proposed for creation of a right-of-
way at 82nd Avenue South , advising that he has a sale for ten lots of
his property providing access is available . He felt the valuation of his
land would be decreased ''; �% in event of the vacation, and pointed out
proposed access which he zelt desirable .
Attention was called to the fact that the area was platted many years
ago and had never developed and that present development should not be
prohibited , the land having to be filled above flood plain level to be
utilized in any event . \
Mr . John Phillips , Attorney for the petitioners , upon inquiry regarding
whether access problem had been resolved advised he had been unable to
contact Mr . Turner ' s Attorney but it was not felt a 60 ft . easement was
required . He pointed out that relocating the easement and power lines
had been resolved with respective parties , noting the area was not feasible
for residential development , that access along 150th ,which has never been
therc ,would never be opened being below flood level , and called attention
to Engineering and Planning Department recommendations for the vacation .
He felt Mr . Turner has adequate access onto Grady way. He noted the area
was platted in 1908 and that it has remained undeveloped over 50 years .
Opinion was expressed that platted land with access should not be deprived
of same and it was pointed out that access has never been developed; that
the entire area is pastureland .
Mr . Turner recalled his Attorney ' s letter noting that no satisfactory
agreement has been reached , pointing out that the whole valley is now
beginning to develop.
Film slides were shown by Attorney Phillips showing newly proposed location
of power lines and easement . After further discussion and proposed motion
to delete portion of South 150th Place from the vacation, which received no
second , motion made by Grant , seconded by Perry, called for the previous
question . The motion carried , Schellert opposing .
The original motion to vacate was voted upon and declared to be in the
affirmative majority. The dissenting voice vote brought request for roll
call which was taken as follows : Aye : Perry, Morris , Delaurenti , Trimm,
Garrett , Edwards , Grant , Shaneand Bruce . No : Schellert , Maxin and Barei .
' The motion carried . Moved by Barei , seconded by Schellert , to authorize
appraisal and sale of the city ' s easement interest therein , at one-half
of the appraised value , to the abutting property owners .
Attorney Shellan , upon inquiry , advised that if the council desired it
could vacate all , or a portion of the right of way if abutting owner
wished to develop a street ,but that if conditions existing precluded
chance of improvement at the given location then it could be vacated .
He noted that if no street existed they could not be deprived cf it .
Upon inquiry regarding resulting situation if Mr . Turner does not wish to
purchase his share of the interest , the City Attorney pointed out that the
property owners already own a vested interest and all the city is selling
is its interest as easement holder . It has no fee title . If abutting
owners do not want to purchase they may assign the interest to someone
else who may be interested in purchasing that 30 feet . If the fee is
not paid there is no vacation consumated . In following discussion it was
noted that Mr . Turner has vested right along with easement right which he
may wish to work out with other abutting owners . it was noted that proper
easement documents will need to be filed prior to culmination of the vacation
according to usual procedure . Motion to refer the matter to the Law & Ordinance
Committee carried. _,-

The regular meeting of the Renton City Council was called to order by D. W. Custer,
Mayor, at 8:00 p.m. in the Council Chambers, Renton Municipal Building.
The Pledge of Allegiance to the Flag was recited by the assembly.
ROLL CALL OF COUNCIL MEMBERS: Perry, Morris, Schellert, Delaurenti, Trimm, Garrett,
Edwards, Maxin, Bruce, Shane and Grant. Absent: Barei. Moved by Perry, seconded
by Bruce, the absent Councilman, who was reported ill, be excused. Carried.

Moved by Perry, seconded by Edwards, that the Minutes of the previous meeting of
January 6, 1969 be approved as mailed out and distributed. Carried.
PUBLIC HEARING: Vacation of certain streets and alleys, per Resolution No. 1590 and
Exhibit thereto, in general area of Earlington Flats
This being the date set, the hearing was declared open. Communications were read
from N. E. Todhunter, Puget Sound Power and Light Company Escrow Supervisor, asking
that 40 ft. wide utility easement be retained to allow clearance for 115 KV line;
from Jack Wilson, City Engineer, recommending the vacation requests be approved
subject to retention of utility easement over the South 40 ft. of South 150th Place
for Puget Power and the City of Renton's public utility purposes. Letter from Planning
Director Ericksen reported Commission review of the proposal and recommended same be
granted as requested to allow better utilization of the land and bring economic benefit
to the City. Letter from Jan P. Klippert, Chairman, Board of Public Works, reported
no objection to the vacations proposed provided adequate easements are obtained.
Audience comment was invited and Mr. Norman Winn, Attorney At Law, representing Mr. E.
R. Turner, owner of Lots 29 through 41 in Block 41 of the subject area, expressed
objection to the proposed vacations,noting in the event of such vacations that undue
access problems for this land owner.will result. Problems of terrain and inadequacy
of right of way which he would be forced to utilize were outlined and pictures of
the area were circulated among the Councilmen for further clarification. Mr. Turner
added his disapproval at loss of access, and no proposals for solution, noting problem
posed because of the hole and toboggan slide topography of access area to be left.
Mr. John E. Phillips of Hullin, Ehrlichman, Roberts & Hodge, Attorneys at Law, 1702
Norton Building, Seattle, representing petitioners for the vacation, noted that the
petition represents 93% of abutting owners, only 2/3 being required for a valid
petition. He noted that the area was platted in 1908 and the streets have never
been opened and developed, the reason being that the entire area lies in a hole,
below flood level and in order to be developed would require fill to raise it above
the flood stage. Present Land uses of Light Industry, and Manufacturing indicated
on the recently adopted Comprehensive Plan and the rezone from SR-1 to B-1 of part
of the area were deemed to be progressive thinking, the area not logically suitable
for residential use . Proposed development by Totem Pontiac and Dealer, Mr. Dick
Evans was disclosed and it was noted that if Mr. Turners' land level were raised he
would have access and that arrangements would be made to grant him an easement if
this would resolve the problem. Film slides of the street layout and vacation
request were shown and boundaries of the freeway to the north, a highway to the
south, river on one side and older homes and undeveloped land and the proposed
commercial development was felt to be a good one for the area. Proposed relocation
of utilities and easement was outlined.
Council action was invited and after questions regarding number of petitioners,
details needed to be resolved with regard to relocation of utility easements and lines,
and access problems and possible; solution thereto, it was moved by Morris, seconded by
Edwards, that the hearing be closed. After further inquiry including that regarding
Code requirements and issuance of building permits with easement access, the motion
carried. Moved by Shane, seconded by Bruce, that further discussion on the matter be
tabled for one week, Attorneys to work with the Engineering Department to resolve
the matters of access and utility easements and relocations. Carried.

On behalf of the petitioners seeking a street vacation from
the City of Renton, Resolution No. 1590 , the following is
submitted.
The City of Renton has hired an appraiser to appraise the
value of the streets and alleys to be vacated. The appraiser
has submitted to the City of Renton his appraisal on the value
of the streets and alleys to be vacated. The appraiser failed
to consider the encumbrance of a 30 foot easement along South
150th Place for power lines owned by Puget Sound Power & Light.
(See attached Exhibit A) . This makes the property valueless
for construction. Therefore, when petitioners pay the City
of Renton up to one-half of the appraised value of South 150th
Place in order to get title, they are actually only getting a
piece of property with little or no fair market value since
it is subject to the power line easement.
In order to obtain the street vacation from the City of Renton,
petitioners have been required to grant to the City of Renton
and to Puget Sound Power & Light, a 30 foot easement adjacent
to P.S . Highway No. 1-Renton for the entire length of the
petitioner ' s property. (See attached Exhibit A) .
Petitioners, therefore, respectfully request the City of
Renton adjust the amount the petitioners must pay for the
street vacation. Petitioners request that the City of Renton
reduce the amount of square footage petitioners must pay for
by the amount of the square footage in the 30 foot easement
to be granted to the City of Renton, or in the alternative,
reduce the value of the appraised price for the property along
South 150th Place which is now subject to the 30 foot power
line easement.

On behalf of the Petitioners seeking a street vacation from

The petitioners are willing, upon vacation of streets and
alleys, to grant to the City an easement for utility
purposes over the following described property:
The South 30 feet of all of blocks 38 and 40 in
C. D. Hillman ' s Earlington Gardens, Division No. 1,
Renton, Washington.
The petitioners will pay the reasonable costs to move
the Puget Sound Power and Light Company line now running
along 150th Place South between 80th Avenue South and
84th Avenue South, to a location within the above
described easement, so long as the power line is placed
10 feet from P.S. Highway No. 1, Renton.
the petitioners agree to grant to the City of Renton a
20 foot easement for water and sewer facilities prior to
being granted a building permit. Petitioners will work
out with the City Engineer the most reasonable place for
said easement .

dards of the City of Renton for issuance of a building permit.
Therefore, if the street is vacated, Mr. Turner will be denied the
only permitted use of his property. This is condemnation without
compensation.
In addition, it is our understanding that the petitioners do
not, in fact, hold title to 2/3 of the property adjacent to the
streets to be vacated. Apparently the petitioners have options to
purchase contingent on street vacation. If this is the case, the
petition would be invalid as not complying with statutory requirements.
We again wish to reiterate that 80th Avenue South does not con-
stitute access to Mr. Turner' s property since the terrain is not
feasible for a road at that point.
Your able City Attorney will advise you that a street vacation
must have some element of public use and is void if made solely for
private benefit of adjoining owners. Abutting owners adversely
affected by vacation must be compensated for their damages.

Dear Mr. Wilson:
On behalf of the Petitioners seeking a street vacation from
the City of Renton, Resolution No. 1590, the following is
submitted:
The petitioners are willing, upon vacation of streets and
alleys, to grant to the City an easement for utility
purposes over the following described property:
The South 30 feet of all of blocks 38 and 40 in
C. D. Hillman ' s Earlington Gardens, Division No. 1,
Renton, Washington.
The petitioners will pay the reasonable costs to move
the Puget Sound Power and Light Company line now running
along 150th Place South between 80th Avenue South and
84th Avenue South, to a location within the above
described easement, so long as the power line is placed
10 feet from P.S. Highway No. 1, Renton.
The petitioners agree to grant to the City of Renton a
20 foot easement for water and sewer facilities prior to
being granted a building permit . Petitioners will work
out with the City Engineer the most reasonable place for
said easement.

Re: Proposed Street & Alley Vacations - South 150th
Place and 83rd Avenue South
Gentlemen:
The Engineering Department has examined the proposed request
for vacation of South 150th Place, 63rd Avenue South, and the alleys
adjoining between 80th and 84th Avenue South. These streets and
alleys,presently unimproved, are not planned for future development.
Only one utility presently exists in the public,: right-of-way, a
Puget Sound Power & Light Company transmission line in South 150th
Place. Puget Power has requested that the City retain a 40 foot
wide utility easement in their favor. The City should also retain
an easement for utility purposes in South 150th Place for future
public utility purposes.
The Engineering Department therefore recommends the vacations
requested be approved subject to the retention of a tility ease-
ment over the South 40 feet of South 150th Place, for Puget Sound
Power and Light Company and the City of Renton.

Renton on or about November 21 , 1968, petitioning for the vacation of certain streets
and alleys as hereinafter more particularly described and said Petition having been
signed by more than two-thirds of the property owners abutting upon said streets and
alleys sought to be vacated, and the same being described on the attached exhibit,
labeled "A", and incorporated herein as though fully set forth:
NOW THEREFORE, BE IT RESOLVED BY THE MAYOR AND THE CITY COUNCIL OF THE
CITY OF RENTON, WASHINGTON, AS FOLLOWS:
SECTION I: That the /3,ay of January, 1969, at the hour of 8:00 P.M.
at the City Council Chambers in the City Hall , Renton, Washington, be and is hereby
fixed as the time and place when the aforesaid Petition for vacating the aforedescribed
streets and alleys shall be heard and determined.
SECTION II: The City Clerk is hereby authorized and directed to give
notice of said time and hearing as provided by law, and any and all persons interested

RESOLUTIONS FOR ADOPTION:
Resolutions were presented and adopted as follows:
Resolution= l584,declaring former city hall buildings and appurtenances,located in Cedar
River Park, surplus and authorizing razing and disposition through the Properlty 'Com,
mittee upon such terms and conditions as are most favorable to the City. Motion by Barei,
seconded by Garrett carried, adopting the Resolution.
Resolution No. 1585 upon motion by Morris, seconded by Edwards, authorizing appropriation
of excess revenues in the Urban Arterial Fund to acct. 1250/606 in sum of $74,811.02.
Resolution No. 1586 adopted upon motion by Schellert, second by Grant, authorizing transfer
of $2,260.00 from Acct. No. 3600, Cumulative Reserve Fund No. 2373, unto Current Fund,
Traffic Engineering, Acct. 1172/Capital Outlay 602. (`Ib fund street department costs in
connection with underground wiring improvement on No. 3rd-4th Streets.)
Mayor Custer at this time introduced Mayor Stan Minkler of Tukwila and Tukwila City
Councilman Dick Bowen. Mayor Minkler expressed pleasure at being in attendance,
recalling prior and current discussions with regard to the boundaries between the two
cities, noting present good relationships and affirming continuation of the same in the
future.
CORRESPONDENCE AND CURRENT BUSINESS:
Letter from Mr. Gary Dime, President, Monterey Terrace Community Club, submitted attached
petition for creation of an L.T.D. for conversion of power, telephone and cable T.V. to
underground facilities and installation of ornamental street lighting system in the
Monterey Terrace plat area. Moved by Shane, seconded by Grant, to refer the petition
to the Light and Power Committee and Traffic Engineer to report back. Moved by Morris,
seconded by Barei, to refer the matter also to the City Engineer for a report as to
validity of the signatures and petition. The amendment carried and subsequently the
original motion as amended.
Letter from Joseph F. Lightfoot, Chief Clerk, King County Boundary Review Board, reported
receipt of notice of intention from King County Water District #107 to annex territory to
the district (Sutherland Temporary File #11-4, Co. Rev. Bd.) . Moved by Schellert, and
seconded by Garrett, to refer the letter to the Board of Public Works for recommendation.
Carried.
Notice from the Boundary Review Board reported public hearing to be held in Rm. 402, King
County Courthouse, Seattle on December 19, 1968 after 1:30 p.m. to consider annexation to
Renton of an area which has been modified by the Boundary Review Board to include certain
additional area. Boundary Review Board File #114. City of Renton File 68-06, Sanders et
al, vicinity S.E. 132nd and 106th S.E . Moved by Schellert, seconded by Maxin, to refer
the matter to the Board of Public Works for recommendation. The motion carried.
etition of Hullin, Ehrlichman, Roberts & Hodge, Attorneys at Law, filed Petition for
the vacation of various streets and alleys and portions thereof in the City of Renton
in the Earlington Hill area as described therein and signed by D. M. Pettibone, Pres.,
Edgewater Enterprises, Inc. , Harold K. Thevik, Secretary, Edgewater Enterprises, Inc. ,
Mike W. Lotto, M. B. Investment Co., William J. O'Neil, M. B. Investment Co., Charles
M. Mattaini, Pres., Homeland Associates, Inc. and Walt Konrad, Sec.-Treas., Homeland
Associates, Inc. The $100.00 processing fee was filed with the petition. Moved by
Barei, seconded by Edwards, to refer the petition to the City Engineer and Street and
Alley Committee to report back. Carried.
Claims, filed against the City by Phillip Edwin Stonebridge in connection with injuries
sustained from fall into ditch at So. 7th Street and Burnett Ave . So., and from David
Joseph Hovind in connection with auto accident at intersection of Meadow Avenue and
North 2nd Street, were read. Moved by Barei, seconded by Shane, to refer the Claims to
the City Attorney and the Insurance Carrier. Carried.
Petition from Hugh Goldsmith & Associates amended area to be annexed to the City of
Renton and City Engineer's report advised that the property in the vicinity of 132nd
Avenue S .E. and S.E . 103rd Street was located immediately North of the new Glencoe
Housing Subdivision and contains app. 42.5 acres with an assessed valuation of $26,990.00.
The signatures on the petition represent 76.77% of assessed valuation of the property.
Moved by Barei, seconded by Edwards, to refer the petition to the Mayor and Boundary
Review Board for: further processing in accordance with the law. Carried.

Minutes — Renton City Council Meeting 1/20/69
RESOLUTIONS ADOPTED BY THE COUNCIL
Resolution No. 1603 was read authorizing the appropriation of $24,000.00, unexpended
balance in the Street Department Fund #1320, Capital Outlay 605 for 1968, unto the
1969 budget. Moved by Trimm, seconded by Edwards to adopt the legislation. Carried.
Councilman Shane inquired regarding anticipated street repair and maintenance program
for the coming year. Budgetary allocations were outlined and attention called to the
specific locations designated within the budget. Mayor Custer advised he could make
available a list of neighborhood streets contemplated to be repaired, noting the
Capital Improvement Priority program contains some such items and rendered explanation
of revisions which may result in the list such as unanticipated mode of funding, in
some instance, or emergency need in others. Councilman Barei requested a list of the
streets being contemplated for repairs.
Resolution No. 1604 was read authorizing transfer of Street Department unexpended funds,
1968 budget account 1320, from Account 306, $1,300.00; 416, $3,500.00; 419, $3,500.00;
and 110, $2,003.00, in total sum of $10,303.00, unto Acct. 315, Equipment Rental.
Moved by Schellert, seconded by Edwards, to adopt the legislation as read. Carried.
Resolution No. 1605 was read, authorizing execution and delivery of a contract with
Puget Sound Power and Light Company for furnishing municipal water pumping power for
the Cedar River Park Pump #8 for a period of ten years. Moved by Trimm, seconded by
Maxin, to adopt the legislation as read. After discussion regarding the need for
such a contract and among other reasons it being noted the city is thereby guaranteed
a specific rate, Committee referral: and report was noted along with concurrence by
the Council and subsequent referral for the Resolution now before the body. Vote on
the pending motion was declared to be in affirmative majority and carried.
CORRESPONDENCE AND CURRENT BUSINESS:
Moved by Perry, seconded by Schellert, the matter of vacating streets and alleys,
South 150th Place, 83rd Avenue South and the alleys adjoining, between 80th and 84th
Avenues South, be taken from the table and placed before the council for discussion
at this time. Carried.
Letter from N. E. Todhunter, Puget Sound Power & Light Company advised that new
alignment of 115 KV electric pole line as proposed by vacation petitioners is
satisfactory providing adequate right of way easements are granted and costs in
connection therewith are paid.
Letter from Attorney Norman Winn, on behalf of Mr. R. E. Turner, owner of Lots 29
through 41, Block 41, advised that satisfactory access has not been offered and 80th
Avenue South would not constitute access since the terrain is not feasible for a road
at that point. Present zoning was noted as R-1, the use for which would not be per—
mitted in event of proposed vacation. Validity of the petition was questioned in
regard to statutory requirements as to ownerships and attention was called to
the fact that abutting owners adversely affected by vacations must be compensated
for damages and that vacations are void if made solely for private benefit of
adjoining owners without some element of public use.
Letter from City Engineer Wilson reported examination of the request for relocation
of utility line and easements and reported that a 30 ft. wide easement would be
adequate for purposes of present or future utilities and it was suggested that the
easement be located adjacent to the freeway rather than in South 150th Place,
assuming petitioners arrange to have the existing power line easement moved to the
freeway.
'- Letter from Hullin, Ehrlichman, Roberts & Hodge, by John E. Phillips, Attorneys for
Petitioners, reported willingness to grant an easement for utility purposes over the
south 30 ft. of all of blocks 38 and 40 in C. D. Hillmans Earlington Gardens, Div.
#1, and to pay reasonable costs to move the power lines now running along 150th Place
South between 80th Avenue South and 84th Avenue South to location with the easement
described so long as power line is placed 10 ft. from PSH. #1. Petitioners agree to
grant the City a .l0 ft. easement for water and sewer facilities prior to getting a
building permit and will work out with the City Engineer the most reasonable place
for such easement.

is agreeable to the City Engineer. Discussion ensued wherein both Mr. Turner and

CORRESPONDENCE AND CURRENT BUSINESS
Vacation of Streets and Alleys in Earlington Flats
City Engineer Wilson , upon inquiry regarding access , reported that this
is a matter of whether one ownership is considered ; that some of the lots
could have only an alley access but the total frontage is abutting a 30
foot street assuming the vacation were granted .
It was pointed out during discussion that without proper fill there would
still be an access problem.
Upon inquiry regarding access problem, Mr . E . R. Turner submitted a
diagram of the property and a plan proposed for creation of a right-of-
way at 82nd Avenue South , advising that he has a sale for ten lots of
his property providing access is available . He felt the valuation of his
land would be decreased in event of the vacation , and pointed out
proposed access which he telt desirable .
Attention was called to the fact that the area was platted many years
ago and had never developed and that present development should not be
prohibited , the land having to be filled above flood plain level to be
utilized in any event .
Mr . John Phillips , Attorney for the petitioners , upon inquiry regarding
whether access problem had been resolved advised he had been unable to
contact Mr . Turner ' s Attorney but it was not felt a 60 ft . easement was
required . He pointed out that relocating the easement and power lines
had been resolved with respective parties , noting th9 area was not feasible
for residential development , that access along 150th ,which has never been
thert: ,�could never be opened being below flood level , and called attention
to Engineering and Planning Department recommendations for the vacation .
He felt Mr . Turner has adequate access onto Grady way. He noted the area
was platted in 1908 and that it has remained undeveloped over 50 years .
Opinion was expressed that platted land with access should not be deprived
of same and it was pointed out that access has never been developed ; that
the entire area is pastureland .
Mr . Turner recalled his Attorney ' s letter noting that no satisfactory
agreement has been reached , pointing out that the whole valley is now
beginning to develop.
Film slides were shown by Attorney Phillips showing newly proposed location
of power lines and easement. After further discussion and proposed motion
to delete portion of South 150th Place from the vacation , which received no
second , motion made by Grant , seconded by Perry, called for the previous
question . The motion carried , Schellert opposing .
The original motion to vacate was voted upon and declared to be in the

appraisal and sale of the city ' s easement interest therein , at one-half
of the appraised value , to the abutting property owners .
Attorney Shellan , upon inquiry , advised that if the council desired it
could vacate all ,or a portion of the right of way if abutting owner
wished to develop a street ,but that if conditions existing precluded
chance of improvement at the given location then it could be vacated .
He noted that if no street existed they could not be deprived cf it .
Upon inquiry regarding resulting situation if Mr . Turner does not wish to
}.archase his share of the interest , the City Attorney pointed out that the
property owners already own a vested interest and all the city is selling
is its interest as easement holder . It has no fee title . If abutting
owners do not want to purchase they may assign the interest to someone
else who may be interested in purchasing that 30 feet . If the fee is
not paid there is no vacation consumated . In following discussion it was
noted that Mr . Turner has vested right along with easement right which he
may wish to work out with other abutting owners . It was ' noted that proper
easement documents will need to be filed prior to culmination of the vacation
according to usual procedure . Motion to refer the matter to the Law & Ordinanc.

* PUBLIC HEARING: Vacation of certain streets and alleys, per Resolution No. 1590 and
Exhibit thereto, in general area of Earlington Flats
This being the date set, the hearing was declared open. Communications were read
from N. E. Todhunter, Puget Sound Power and Light Company Escrow Supervisor, asking
that 40 ft. wide utility easement be retained to allow clearance for 115 NV line;
from Jack Wilson, City Engineer, recommending the vacation requests be approved
subject to retention of utility easement over the South 40 ft. of South 150th Place
for Puget Power and the City of Renton's public utility purposes. Letter from Planning
Director Ericksen reported Commission review of the proposal and recommended same be
granted as requested to allow better utilization of the land and bring economic benefit
to the City. Letter from Jan P. Klippert, Chairman, Board of Public Works, reported
no objection to the vacations proposed provided adequate easements are obtained.
Audience comment was invited and Mr. Norman Winn, Attorney At Law, representing Mr. E.
R. Turner, owner of Lots 29 through 41 in Block 41 of the subject area, expressed
objection to the proposed vacations,noting in the event of such vacations that undue
access problems for this land owner will result. Problems of terrain and inadequacy
of right of way which he would be forced to utilize were outlined and pictures of
the area were circulated among the Councilmen for further clarification. Mr. Turner
added his disapproval at loss of access, and po proposals for solution, noting: problem
posed because of the hole and toboggan slide topography of access area to be left.
Mr. John E. Phillips of Hullin, Ehrlichman, Roberts & Hodge, Attorneys at Law, 1702
Norton Building, Seattle, representing petitioners for the vacation, noted that the
petition represents 93% of abutting owners, only 2/3 being required for a valid
petition. He noted that the area was platted in 1908 and the streets have never
been opened and developed, the reason being that the entire area lies in a hole,
below flood level and in order to be developed would require fill to raise it above
the flood stage. Present Land uses of Light Industry, and Manufacturing indicated
on the recently adopted Comprehensive Plan and the rezone from SR-1 to B-1 of part
of the area were deemed to be progressive thinking, the area not logically suitable
for residential use. Proposed development by Totem Pontiac and Dealer, Mr. Dick
Evans was disclosed and it was noted that if Mr. Turners? land level were raised he
would have access and that arrangements would be made to grant him an easement if
this would resolve the problem. Film slides of the street layout and vacation
request were shown and boundaries of the freeway to the north, a highway to the
south, river on one side and older homes and undeveloped land and the proposed
commercial development was felt to be a good one for the area. Proposed relocation
of utilities and easement was outlined.
Council action was invited and after questions regarding number of petitioners,
details needed to be resolved with regard to relocation of utility easements and lines,
and access problems and possible, solution thereto, it was moved by Morris, seconded by
Edwards, that the hearing be closed. After further inquiry including that regarding
Code requirements and issuance of building permits with easement access, the motion
carried. Moved by Shane, seconded by Bruce, that further discussion on the matter be
tabled for one week, Attorneys to work with the Engineering Department to resolve
the matters of access and utility easements and relocations. Carried.

utilization of the land, resulting in economic benefits

Stredicke stated he was opposed to departing from the normal pro-
cedures in this case; that he would prefer to review the property
on the field trip and make his decision at the public hearing meet-
ing of January 22nd.
Comments from the audience were invited.
Mr. L. Edward Pratt of Chester Lindsey, Architect, representing
the applicant, spoke on behalf of the site approval application.
Mr. Pratt. stated the applicant would like to begin grading and
filling the property but did not want to expend any money unless
he could be assured of site approval .
Discussion followed among Commission members regarding the fulfill-
ment of application requirements with reference to posting, pub-
lishing, etc . The Planning Director stated that the Commission' s
action in such cases is final, and there are no posting and publi-
cation requirements for site plan approval applications . Legally,
the Commission could, at its discretion, act on the application
this evening.

The Law and Ordinance Committee presented a proposed Resolution of the City of Renton
authorizing the transfer of $300.00 from excess revenues in the Current Fund unto Non-
Departmental Account 1141, 314, Expert Services in the Current Fund, as read by the
Clerk. Moved by Edwards, seconded by Schellert, to adopt Resolution No. 1588 as read.
The motion carried.
Moved by Shane, seconded by Grant, to refer the matter of eliminating the Utility Tax
to the Law and Ordinance Committee for recommendation. The motion was voted upon and
dissenting voice vote brought request for roll call vote which was taken as follows:
Aye: Garrett, Bruce, Maxin, Edwards, Perry and Morris. No: Barei, Shane, Grant,
Delaurenti and Schellert. Carried, 6 to 5.
Moved by Shane, seconded by Grant, to amend the council rules and regulations ordinance
to require committees to report back on matters within 60 days of referral. The vote
was declared to be in the negative majority and roll call was requested which resulted
as follows: Aye: Perry, Bruce, Grant, Shane and Barei. No: Garrett, Morris, Schellert,
Delaurenti, Edwards and Maxin. The motion lost, 6 to 5.
CORRESPONDENCE AND CURRENT BUSINESS:
Letter from Jack Wilson, City Engineer, reported that the petition for the vacation of

South 150th Place, between 80th and 84th Avenues South; 83rd Avenue South, between Grady
Way South and FAI 405, and alleys adjoining said streets, contained signatures which
represent 93.69% of the abutting front footage. (Hullin, Ehrlichman, Roberts & Hodge,
Attorneys for Petitioners who filed for the vacation on 11/25/68) Moved by Schellert,
seconded by Garrett, to refer the matter to the Law and Ordinance Committee for resolution
setting date for hearing. Carried. Moved by Schellert, seconded by Shane, to refer this
matter to the Board of Public Works and the Planning Commission for recommendation at the
hearing. Carried.
Letter from Washington Wholesalers, Inc. 770 South Michigan Street, Seattle, Thomas F.
Myers, Executive Vice-President, appealed variance denial by the Board of Adjustment
concerning request for reduction in parking stalls from the code requirement. It was
felt that perhaps the company presentation was inadequate and did not justify that a
hardship existed. Further information and details of proposed development attached
was filed for council consideration. Moved by Morris and seconded by Barei, that the
hearing on this matter be set for December 9, 1968. Carried.
Letter from the State Joint Committee on Highways gave notice of Subcommittee on Exten-
sions meeting on Tuesday, December 17, 1968 at 3:45 p.m. at Tyee Jr. High School Cafeteria,
Eastgate, 13630 Allen Road, on the proposed Auburn-Bothell freeway. Moved by Schellert,
seconded by Perry, to refer the meeting notice to the Street and Alley Committee. Carried.
Letter from City Engineer Wilson submitted and recommended for payment the final estimate
on work performed by Red Samm Mining Co. on raising of Lake Wn. Blvd. in the vicinity of
Lake Wn. Beach Park, C.AG. 1350-68, in sum of $11,197.31. Acceptance by the Council as
of December 2, and commencement of the 30 day lien period was recommended with release
thereafter if no liens or claims are filed against the project and upon proof of payment
of all tax liabilities, $1,244.15 being the retained percentage withheld. Moved by
Morris, seconded by Edwards, to concur. Carried.
AUDIENCE COMMENT:
Mr. Norman Ross, on behalf of the Kennydale Lions Club thanked the Council and City
Departments for cooperation and courtesies in regard to the Club's Haunted House fund
raising project held at Halloween time in October. The Club as a result of the success-
ful event will be issuing a check for $1,000.00 to the Handicapped Children's program.
Letter from City Engineer Wilson reported that the King County Boundary Review Board had
recommended enlargement of the Sanders et al property annexation area to include that
portion of King County lying East of 132nd Avenue S.E. Amended petition was attached
and signatures thereon represent 77% of the assessed valuation of the additional area
and when combined with original signatories total 86.65% of the assessed valuation of
the combined area. The Board of Public Works letter was also attached recommending
addition of the property and modification of the petition and acceptance accordingly.
Moved by Garrett, seconded by Perry, to approve the Boundary Review Board recommendation
and to accept the modified petition for inclusion of additional territory to the Sanders
et al annexation, BRB File 7-5, Renton file A68-06. (132nd Ave. S.E. and S.E. 106th St.)
The motion carried.
