ORDINANCE NO. 2850
AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON,
VACATING CERTAIN PORTIONS OF BURNETT A DI SOUTH
AND S. 8th STRUT, AS MORE PARTICULARLY DESCRIBED
HEREINBELOW
WHEREAS a proper petition for vacating certain portions of Burnett Ave-
nue South and South 8th Street, as hereinafter more particularly described, was
duly filed with the City Clerk on or about June 20, 1972, and said Petition having
IN been signed by the owners of more than two-thirds of the property abutting upon suer

WHEREAS the City Council by Resolution No. 1803 approved on July 10, 1972,
and after due investigation did fix and determine the 21st day of August, 1972, at
the hour of 8:00 P.M. in the City Council Chambers of the City of Renton to be the
time and place for public hearing thereon; and the City Clerk having given due
notice of such hearing in the manner provided by law and all persons having been
heard appearing in favor of or opposition thereto; and
WHEREAS the Planning Commission and the Public Works Department having
duly considered said petition and said vacation and having found same to be in the
public interest and for the public benefit and no injury or damage to any person
or properties will result from such vacation; and
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF RENTON DO ORDAIN AS
FOLLOWS:
SECTION I: The following described properties, to-wit:
That portion of Burnett Ave. S. lying between Blocks 1 and 2
of Walsworth's First Addition, as recorded in records of King
County in Volume 6 of Plats, page 23, EXCEPT that portion of
7th Street Extension to Grady Way and also EXCEPT the right
of way of Grady Way.
That portion of 8th St. (S. 8th Street) abutting Lots 12 and
13, Block 2, and Lot 12, Block 1, of said Walsworth First
Addition, EXCEPT that portion of the Burnett Avenue South
Extension (SR 515); all situate in Renton, King County,
Washington.

SECTION II: This Ordinance shall be effective upon its passage, approval
and five days after its publication, unless otherwise provided for hereinabove. A
certified copy of this Ordinance shall be filed with the Office of Records and
Elections, King County, and as otherwise provided by law.

Ordinance #2849 Legislation Committee Chairman Stredicke presented water rate ordi-

final readings 5/6/74 and referred to the Public Works Director
for one week to consider the effect of 25% reduction. Letter from
Public Works Director Gonnason substantiated original recommendation
for 35% increase in revenue which will be offset by increased Labor
costs , increased materials cost, electrical power rates and copper
pipe prices , approximating the 25% decrease. The letter included
two alternate commodity rates which would reduce either across the
board or a heavier reduction for small residential customers; also
noting the need to adopt ordinance tonight in order to facilitate
effective date of June 1 , as our coding structure for each account
makes it impractical to change sewer without water. Following read-
indsof the ordinance, .MOVED BY SCHELLERT, SECONDED BY CLYMER, CONCUR
IN LETTER AND ADOPT ORDINANCE AS PRESENTED. MOVED BY PERRY, SECONDED

Gentlemen:
The Board of Public Works has reviewed the June 19 letter from
Puget Sound Power $ Light Company requesting vacation of portions
of Burnett Avenue South and South 8th Street .
Based on the finalized design of the Grady Way intersection, whicr
delayed earlier action on this request , the Board recommends
vacation of the property described in Puget Sound Power $ Light
Company' s petition, as that portion of right-of-way will not be
required for street or utility purposes .

Citizens Transit Councilman Clymer , Member of the Metropolitan
Committee Notice Council ' s Citizens Transit Committee announced

The Transportation Committee concurs in the recommendation
of the Engineering Department in granting the vacation as
requested for Puget Sound Power & Light Company for a
portion of Burnett Avenue South. This recommendation
includes the provision that any utility easement needed
by the City in the general area be accomplished prior
to vacation and that any additional right of way needed
by the City in this area also be considered prior to
granting the vacation.

following described portions of Burnett and 8th Streets vacated:
That portion of Burnett Street lying between Blocks 1 and 2 of
Walsworth's First Addition, as recorded in records of King County
in Volume 6 of Plats, page 23, EXCEPT that portion of 7th Street
Extension to Grady Way, and also EXCEPT the right of way of Grady
Way.
That portion of 8th Street abutting Lots 12 and 13, Block 2, and
Lot 12, Block 1, of said Walsworth First Addition, EXCEPT that
portion of the Burnett Street Extension (SR 515) ; all situated in
Renton, King County, Washington.
Puget Sound Power $ Light Company is the owner of all the property abutting
the portions of these streets described in this vacation.
These streets have never been improved and do not conform to present day
street design. Puget granted the right of way to the State for the Burnett
Street Extension so the intersection at Grady Way could be made at right
angles. Enclosed is a portion of King County Assessor's Map showing the
portions of the streets we are seeking to vacate.
At the request of the City Council we withdrew our application on August
6, 1970, pending review and determination by the City and State of the
future alignment of Burnett Street and its extension to the north of Grady
Way. It is our understanding that the alignment has been resolved. It is
also our understanding that the application fee which we paid June 3, 1970,
would be applicable to this re-application.

Audience comment was invited . Mr . Kent Meek ,
representing Puget Sound Power and Light Co . ,
inquired regarding balance of the request since
the report concerns only Burnett Avenue . The
area requested to be vacated was outlined by
City Engineer Wilson on a map it being noted
the request was for portion of Burnett , 8th St .
and Dora , the latter having been vacated hereto-
for however . In view of proposed Benson Highway
relocation and tie in with Grady Way and some dis-
cussion on tie in with 2nd and 3rd, the City p _-

PUBLIC HEARING : Vacation of Burnett and 8th Street (Cont . )
City Engineer Wilson advised the Mayor has written
the State urging action and it is hoped the project
may be completed next year . He added that the State
Highway Department in 1962 developed the new Talbot
access and Puget gave right of way to the City for
vacation of Shattuck, Burnett , between Grady Way ,
portion of 7th 8th and Dora Streets . There was a
subsequent Ordinance but nothing in the records
indicates that Burnett and 8th were vacated which
may have been overlooked or intentional .
Stredicke suggested two separate vacations but Mr .
Meek noted this would not help ,their need being
for an immediate answer so the company can proceed
with continuation of power supply to communities
served and the tower being committed at present
to a location on Burnett Avenue . Shane urged action
as would be in the best interest of the City .
MOVED BY PERRY, SECONDED BY MAXIN, TO CONTINUE
THE HEARING TO AUGUST 24 . Upon inquiry as to
element of time Mr . Meek advised they would live
with the delay if extension would bring forth
a decision . Council President Schellert noted
the committee will review and have report at the
hearing. Grant noted this had been referred to
the Transportation Committee also and more time
was desired by the Board of Public Works accprd-
ing to its letter , and his committee awaiting
the Board report . Perry urged the petitioner to
meet with the Board of Public Works hope being
expressed that the State would advise of the route
for the access . MOTION TO CONTINUE THE HEARING
CARRIED.
PUBLIC HEARING Proposed Emergency Ordinance providing funds for
Emergency Ordinance hiring students for summer work . Ordinance No . 2575

purpose and it was noted this was in addition to
funds already budgeted , federal funds also being
applied for on matching basis . The matter of
the present city operating cost was noted by

IN UNANIMOUS AYE VOTE, CARRYING THE MOTION TO ADOPT
Ordinance No . 2576 Legislation Committee Chairman Perry noted that
Vacation of portion requested restrictive covenants have been submitted
of Whitman Ct . N.E . and the vacation tied in by reference to plans as
submitted at public hearings of 6/22 and 7/6 , and
Ordinance has been revised to provide for $1 ,000 . 00
payment by Petitioners-owners which is now ready
for first reading . Councilman Stredicke outlined
procedures to date and final covenants agreed to
AND MOVED FOR ACCEPTANCE OF THE COVENANTS. Grant
inquired regarding ownership by Kalin and Mr.

Board recommends that no action be taken on this particular vacation

Resolution 1694 Resolution was read adopting the modification
6 year street plans and division of a new Comprehensive Six Year
Street Program including the designations of
certain arterial projects . Moved by Barei , an
seconded by Schellert , to adopt the Resolution
as read. Carried .
Resolution 1695 Resolution was read setting the 20th of July ,
Vacation of portion 1970 as date for public hearing on the proposec
of Burnett Ave . and vacation of portion of certain streets as per
8th Street to PSPL request of Puget Sound Power and Light Co .
Company Moved by Stredicke , seconded by Schellert , to
adopt the Resolution as read. Carried.
Ordinance 2573 Committee of the Whole President Schellert
Salary ordinance reported recommendation that city council
for new council salaries be set at $300 . 00 per month and it
under O.M .C. was moved by McKay , seconded by Schellert , to
concur . Grant noted the Mayor 's salary had
been fixed also but City Attorney Shellan ad-
vised that the Mayor, City Clerk and Treasurer
salaries are fixed by City Ordinance from time
to time . Councilman Stredicke commented on the
clever speculation and conclusions in setting
salaries expressing his opinion that councilmen
are serving on a part time basis as a civic
service and the positions should not be looked
at strictly for money purposes , many members of
boards and commission serving without pay and
putting in almost as much time . He added that
during the month of May he put in 40 hours in
meetings and spent 30 hours on city business
in addition and proposed motion,accordingl.y ,
recommendation to be changed to $1 ,000. 00, which
motion the Mayor declared to be out of order.
Barei added his hope that council would not in-
crease salaries to $300. 00 as it would encourage
seeking of office for salazy and not for benefit
to the City , this being a lot of money and when
service is given because they want to serve the
city the quality is just as good as it would be
if paid more , expense to individual mainly being
away from his family and cost of driving;service
of Councilman Delaurenti over the years an example
his service equally valuable now with a salary as
(26) years ago when he did not receive that amount .
Reconsideration was urged, and the pending motion
to concur was subsequently voted upon and carried.
The proposed ordinance was placed on its first
reading. Moved by Barei , seconded by Delaurenti ,
to place the document on second and final reading.
The motion carried, Stredicke opposing and Shane
absent from the Council Chambers during reading
and vote . After final reading roll call vote was
taken as follows : AYES, 10 : Schellert , Clymer ,
Delaurenti , Perry , McKay , Edwards , Maxin , Bruce
Grant and Barei . VO . 1 : Stredicke . Shane was
absent during the vote . Motion Carried.

SECTION II : The City Clerk is hereby authorized and directed
give notice of said time and hearing as provided by law, and any and al_
persons interested therein or objecting to said vacation may then appeal
and be heard thereon , or they may file their written objections thereto
with the City Clerk prior to or at the time of the hearing on said vacai Dn.
The City Council shall determine , at or prior to any such public hearin€
as to whether an appraisal shall be secured to determine the fair market
value of the property sought to be vacated as provided for in Ordinance
ho. 2349 and the City may likewise retain an easement for public utility
and related purposes.

Gentlemen:
Puget Sound Power & Light Company hereby makes application to have
the following described portions of Burnett and 8th Streets vacated:
That portion of Burnett Street lying between Blocks 1 and 2
of Walsworth' s First Addition, as recorded in records of
King County in Volume 6 of Plats, page 23 , Except that portion
of 7th Street Extension to Grady Way, and also Except the
right of way of Grady Way; that portion of 8th Street
abutting Lots 12 and 13, Block 2 , and Lot 12, Block 1 , of
said Walsworth' s First Addition, Except that portion of the
Burnett Street Extension (SR 515) .
Puget Sound Power & Light Company is the owner of all the property
abutting the portions of these streets described in this vacation.
These streets have never been improved and do not conform to present
day street design. Puget granted the right of way to the State for
the Burnett Street extension so the intersection at Grady Way
could be made at right angles. Enclosed is a portion of State High-
way map showing the portions of the streets we are seeking to vacate
together with a copy of our letter to Mr. Wilson, dated May 16 , 1962
in connection with this transaction.
We were under the impression in our negotiations with the State and
the City of Renton that these streets were vacated as a part of the
package of realignment of the streets for access to the South Rentor
Interchange. Through an oversight these streets were not vacated;
therefore, we are now making this application.

Engineer of the State highway Department, to ,you. The contents
of Mr. M Key's letter confirms in general an understanding reached
between you, Mr. Kimb:.11 and :•.r. Carter at a meeting .which was
held in Mr. Carter's office on April 13, 1962.
In order that the City of Renton may be in a position to satisfy
the State with respect to :acquiring right-of-way for the proposed
• intercben e. which would be substituted for the original plan of
utilizing Shattuck Street, Puget Sound Power t[ Light Company
will deed to the City of Renton the right-of-way required between
Burnett Street and Shattuck :street. In return, the City of
Renton will deed back to 'uget the right-of-way of 95th Avenue
:.euti (Shattuck Street) , which was conveyed to the City of
Renton on September 24, 1955; also that portion of Burnett Street
between Grady Way And 8th Street; and also Dora Street and 8th
Streets in the Plat of '.+•alsworth's 1st Addition to Renton.

If this proposal is acceptable to you, would you kindly prepare
• the property description for right-of-way needed between
Burnett Street and Shnttuck Street in order that we nay prepare
the necessary documents to effect the transfer of title.
Concurrently, action should be initiated by the City Council
to effect the transfer of title of the aforementioned property.
