Dear Mr. Holtzclaw:
This is in reference to your letter of March 19 , 1973
addressed to our Deputy City Clerk re the above captioned
matter.
In answer to your questions, we have been advised by the
appraiser that the value per square foot of the land in
the subject area has been computed at $3 .00 . T)ue to the
particular situation, includinz size and location, the
valuation of $2 .00 has been allocated to the subject alley.
However, the appraiser also recommended that any portion
subject to the easement be reduced by 40% of said value
which was done, thus resulting in a total appraised value ,
computed at 50%,of $2572 .60 .
We do not have any information as to how title to the
alley was originally acquired by the City , whether in fee
y
title or otherwise.
If you need any additional information, please advise.

Since transmitting my letter to you dated March 15 , 1973 ,
I have had occasion to explore this matter a little bit further
with our clients. Our clients have ascertained that apparently
the appraisal is based upon a figure of $2 . 00 per square foot,
however, this conclusion is premised upon an acquisition of fee
simple title. It is my understanding of street vacation that the
Ciyt is not conveying fee simple title but something substantial]
less. Also, I note that the vacated alley is conveyed subject tc
an easement over a portion of the property to be acquired by our
clients. With these thoughts in mind, we respectfully request tt
the City take another look and give further consideration to the
amount of compensation expected to be paid by our clients in con-
sideration of the vacation.

evaluation process is the Market Data Approach . In this instance
sales data of vacated alleys with a high degree of comparability to
the subject is very limited . No credence is given this approach as
an indication of value in this appraisal .
The Fee Simple Value of commerical land , in the area of the subject
is judged to be $3 . 00 per sq . ft . This ,,alue is reflected in a stud
of past sales of land sites capable in all aspects to support a
normal commercial enterprise . The subject land , as a single entity
is not capable of supporting a normal commercial facility and there ore
its use is relegated to a subordinate use relating to the adjoining
properties .
Based upon my Real Estate experience and reflected in the above analogy ,

VACATING A PORTION OF ALLEY LOCATED SOUTH OF
SOUTH 2ND STREET AND WEST OF LOGAN AVENUE , AS MORE
PARTICULARLY DESCRIBED HEREINEELOW.
WHEREAS a proper petition for vacating a portion. of
alley located south of South 2nd Street and West of Logan Avenue ,
as hereinafter more particularly described, was duly filed with th
City Clerk on or about November 24 , 1972 , and said Petition having
been signed by owners representing 100% of the total footage upon
the portion of said alley to be vacated; and
WHEREAS the City Council by Resolution No . 1836 approve.
on January 8 , 1973 , and after due investigation did fix and determi
the 5th day of February, 1973 , at the hour of 8 : 00 P .M. in the City
Council chambers of the City of Renton to be the time and place for
public hearing thereon, which hearing date was continued to Februar
13 , 1973 ; and the City Clerk having given due notice of such hearin

pose having become overgrown with underbrush and bushes to
the extent that it is impassable due to non-use. The owner:.
of the abutting property to the area sought to be vacated
desire to improve their respective property in a fashion to
accommodate a new business venture in Renton but to do so
requires that the various properties he brought together to
have common boundaries without intervening, unused alley-wa:.
Such use requires fencing for security purposes which cannot
be done across a dedicated, though unimproved alley. The
vacation of the unused alley as requested will place that
property back on the tax roll.
3. The intended use of the land sought to be va-
cated is that the substantial portion thereof will be grades
surfaced and fenced to provide a secure storage and sales
facility for automobiles and a small portion thereof will b..
utilized by adjoining owners for customer parking.
4. The undersigned petitioners are the owners of
all the real estate abutting on the above described area anc
said ownerships are as follows:

We are handing you herewith original of a proposed Ordinance vacating a portion
of alley in back of Standard Tire Service . Would you please have the Engineer-
ing Department verify the legal description to be sure it is absolutely
correct and also insert the amount to be paid by the property owners. The
Engineering Department should also include the easement to be retained for
utilities and describe same. Please return one conformed copy to our office.
We presume that you will have in your file all of the pertinent documents and
studies made by the various departments of the City, including the Engineering
Department, in support of its recommendation to vacate that portion of the alley.
This undoubtedly would also include any determination about any traffic hazard
and safe-W factors involved relating to traffic on S . Second St. We under- -
stand that some determination had also been made that the alley had never been

Dear City Council:
Regarding the council minutes concerning the request for the
vacation of the alley South 2nd Street and Logan Avenue South, we were not
informed of any request for a vacation, and we did not know of any previous
meeting concerning this alley vacation request. Yesterday, February 7th, 1973,
was the first knowledge we had of City hall meetings regarding this alley
vacation request, and we understand that these meetings have been progressing
since November 27, 1972. We thought all property owners in the block were to be
told or notified in writing, by mail, of any meetings concerning their adjacent
land. For the best and highest use of our land, we are planning an executive
office building on this site and we request that this L shaped 16 foot alley in
question remain, as is, until we are ready to build. Enclosed is a photo-stated
copy of previous minutes of City hall meetings when we discussed this matter
previously. At the time, Gentlemen, of these previous meetings, however, we did
not have a blueprint of our proposed building, as we do now. We refer you to
meet with our Architect, Mr. Omer L. Mithun and our Engineer, Mr. Richard Birgh.
Our Attorneys, Senator Robert R. R. Greive and Charles J. Law, wish to confer
with you if there is any problem concerning this matter.

PUBLIC HEARINGS: Vacation - Portion of 12th Place between Blocks 40 and 46, Tract C,
Corrected Plat of Renton Highlands No. 2. (M. Lotto et al)
This being the date set, the hearing was declared open. Communication from City
Engineer Wilson was read reporting no objection to the vacation, this being an un-
opened right-of-way and not a part of the City's Comprehensive Street Plan. Since
all utilities are existing in the area there is no need to retain a utility easement.
Letter from Planning Director Ericksen reported Commission recommendation from meeting
of April 12th that the vacation be approved as requested. Audience comment was invited
and Mr. Mike Lotto stated that when the Plat was accepted sore years ago an error was
evident in that the street was supposed to run one direction and went another and this
vacation would correct the situation and the vacation should hr-e' been asked for 3 or
4 years ago and property deeded to the City for proper right of way as it has now been.
Moved by Poli, seconded by Gianini, that the hearing be closed. Carried. The hearing
was declared closed and further council action invited. Moved by Morris, seconded by
Poll, to concur in the recommendation of the Planning Commi .:_ion granting the vacation.
The motion carried.
PUBLIC HEARING: Vacation of portion of alley South 2nd Street and Logan Avenue South
Claudine and George Ames Property
This being the date set, the hearing was declared open. Communications were read from
Robert and Eetty Putman requesting that the alley not be vacated in the interest of
utilizing same for a commercial building which development it was felt would enhance
the City by modernizing and architecturally improving the area across from the High
School. Letters from ::_s. L. J. Putman and Mary Ann Putman and Colin W. Radford
urged that the Council deny the vacation request to allow the commercial development,
the alley provic'=ng access and egress value to the Putman properties.
A letter from City Engineer Wilson reported that the vacation as requested would
leave the City with a dead end alley approximately 230' in length which would not be
in the City's best interest, although it is doubtful that the alley can be used as
platted due to its narrow width and 90% turn. As an alternative the. petitioner has
offered to deed a new right-of-way out to South 2nd Street along the West side of
Lot 5 as a replacement for existing right-of-way so as to consolidate their ownership.
This uuculd be preferable to dead ending the alley however unless a portion of Lot 4
could be obtained to develop a turning radius at the 90% bend it would be of doubtful
value to the City.
A letter from Gordon Y. Ericksen, Planning Director, reported Planning Commission
reeom a..aticn that the vacation be granted only if a proper turn-around is provided
at tie Ee,stcrly end of the remaining 16 ft. alley. Moved by Poli, seconded by Gianini

would preclude further acceptance of alternate proposals as recommended by the City
Engineer and Planning Commission. Attorney Shellan suggested that the hearing be
continued or held in abeyance . Garrett spoke against closing the hearing suggesting
that the petitioner be advised of the need for the turning radius and not only an
additional 16 ft. dedication to relocate the right-of-way which petitioner has offered
between lots 4 and 5, the boundary line between the properties. Dahlquist felt the

hearing should be closed and action taken on the petition before the Council which is

additional alley right of way and The City Engineer replied that petitioner is aware

West side of Lot 5 and later provide turn arround. Mr. Coleman, representative for
the property owners, is in San Francisco and unable to be present this evening. Attorney
Shellan advised that should the Council wish to relocate the alley notice of public
hearing would again need to be given on the relocation or other portion to be vacated
as an alternative. Garrett added that the petitioner could come in with a new proposal
at the continued hearing and the Council would have to act in accordance with the law
but the petitioner may or may not be interested in such revision and this is what the
Council . would want to know. The pending motion carried.

This being the date set the hearing was declared continued, however, since petitioners
representative had been delayed, it was moved by Schellert, seconded by Hulse, to
table the matter until later in the meeting. Carried.
COMMUNICATIONS:
Petition for annexation of property in Northerly section of Kennydale Island area was
read. The document contained required statement of willingness to assume pro-rata
shares of the City's pre-existing bonded indebtedness. (Vicinity of S.E. 84th and Lake
Wn. Blvd.) Moved by Hulse, seconded by Schellert, to refer the petition to the City
Engineer to check validity of signatures. Carried.
Letter from Dobson, Houser & Dobson, Attorneys, by John W. Dobson, written on behalf of
St. Andrews Lodge No. 35, F. & A.M., appealed Planning Commission decision to deny a
rezone of property between "M" and 'II" Streets on 10th Avenue North, from SR-1 to P-1.
Pedersen doted that the requested zoning was not in accord with the Land Use Map and
inquired regarding proper action to be taken. Planning Director Ericksen reported
that the area is presently zoned SR-1, single family residential and this is also
projected for the future use of the area. City Attorney Shellan advised that the
applicants have the right to appeal but the Council cannot legally proceed if the
proposed zoning does not agree with the Comprehensive Plan. Planning Director
Ericksen stated that the applicants are aware of this fact but wished to submit the
appeal with hope that it would result in a study to determine feasibility of their
plan to build a facility with Medical-Dental offices on the main floor and Lodge
quarters upstairs, which would be allowed under P-1. In discussion it was pointed
out that recent appeals had been denied for multiple zoning in the subject area and
that the Planning Commission had decided to reject the proposal since it was pretty
well defined that it was not acceptable as submitted. Discussion ensued regarding
alternate actions which might be taken which included a change in the zoning ordinance
to allow permit for private Lodges, otherwise, an amendment to the Comprehensive Plan,
the former, however not allowing the clinic facilities which financial support is
needed. Moved by Hulse, seconded by Poli, that the date of May 15, 1967 be set for
hearing on the matter, applicants to be notified that since the request is not in
accord with the Comprehensive Plan it likely will not be granted. Hulse pointed out
that the Comprehensive Plan is to protect the people and the City and the issue is not
how to evade the plan but whether the people are willing and the facility is a proper
one for the area. Dahlquist felt it would be an improvement to the present condition
of the property and that progress should not be deterred. The Planning Director stated
position of the Planning Staff as far a changes are concerned, their advice to applicants
being that they can submit a letter to the Planning Commission requesting study or they
may make official application and request that the Commission held this for study and
possible change in the Comprehensive Plan, and this is what the present applicants were
told, however they wished to make application in order to have this as official action
on their part. After further discussion on applicants intent for a study, possible
rezone actions and speculation of conclusions and facts a public hearing would bring
forth, the pending motion for hearing and notification to applicants carried.

Since Mr. Ernie Coleman, representing vacation petitioner arrived, it was moved by
Pedersen, seconded by Poli, that the matter of the public hearing on the proposed
vacation of alley per petition of George and Claudine Ames, be taken from the table.
Carried. The hearing was declared continued and since the Clerk reported that no
additional communications had been received, audience comment was invited. Mr. Ernie
Colc:nan advised that Standard Service Tire Company was the party interested in the
vacatich since it anticipated expansion of facilities which would require the additional
property which lies between their site and the one they plan to acquire. They cannot
utilize the lot if it remains separated however and it was noted that this alley is
used very little and the property contains a dilapidated run down facility and the im-
provement as proposed would be an asset to the City. If the City insists that there
be an alley in the proximity -ou ;h to 2nd it was proposed that the alley be allowed
to run on the Westerly side of Lot 5 which would provide the same as now exists, their
feeling being however that it has never served any purpose presently being covered over
with brush and rose bushes and practically impassable. It was noted that the alley is
to no avail without a turn around which might be a hammerhead type which could be pro-
vided within a 40 f:. radius or the circular type which would require 60 ft. diameter.
It was suggested this matterrbould be resolved and the alley moved at the time the
building proposal was submitted to the Building Department. Mr. Coleman . added that
if , when working with the City Engineer it was felt the City absolutely had to have
such an alley, arrangements would be made for the relocation, a hammerhead being more
desirable than backing out, if such provision is to be required. The property cannot
be utilized as it presently exists.
Mr. Colin Radford, Realtor, speaking on behalf of the Ames Family and Estate, who
originally cppoced the vacation, advised that relocation of the alley to the Easterly
boundary of their property wi11"remove their objection and they will go a.ong with the
vacation. Upon legality inquiry regarding relocation of an alley, City Attorney Shellan
advised that an alley can legally be vacated if there is a show that no one is denied
access and the City policy requiring 100% ownership to sign is met. In this case there
would be a vacation and rededication by a deed from the owner of lot 5, dedicating the
westerly 16 fc. of lot 5, A public hearing would need to be held because this is re-
locating of an alley and when the quit claim deed is executed the City. would be free
to vacate and relocate the alley. Moved by Pedersen, seconded by Gianini, that the
hearing be closed. Carried. The hearing was declared closed. Moved by Garrett, 'that r
i. willing to dedicate the 16 ft. alley on the west side of Lot
5, the Council, upon receipt of dedication document would vacate the portion requested
and relocate the alley, following proper public hearing. Hulse seconded the motion which

Gentlemen:
ln'e have reviewed the matter of the alley vacation in the vicinity of S. 2nd
and Logan. The following is our report and findings:
1 . The petition was reviewed by this department and certification was
made that it represented 100% of the abutting property owners . It
is a fact that the petition represented 100% of the abutting owners
on that portion of the alley to be vacated, however, a portion of
the alley was to remain open.
1. In a letter addressed to the Mayor, the Engineering Department
indicated that it had no objections to the requested and petitioned
vacation.
3. We are in receipt of a copy of a letter addressed to the City Council
dated February 8, 1973 from Mrs. L. J . Putman and Mary Ann Putman
objecting to the proposed vacation. We are also in receipt of a
letter dated February 9, 1973 from Westcoast Electric Company, a
copy of which is enclosed, signed by Mr. Charles E. Kessler, General
Manager, opposing the vacation.
1. Jack Lynch, Bert McHenry and Warren Gonnason met at the site and
discussed the matter with Mr. Putman representing the property
owners on the north side of the remaining portion of the alley
not to be vacated. Mr. Putman indicated their objections to the
vacation, in view of the fact that they would be left with a dead-
end alley which would require backing out, and therefore objected
strongly to the vacation of the petitioned portion of the alley.
At this time, Mr. Putman indicated that he would be willing to
a relocation of the alley to a point adjacent to his easterly
property line as long as a continuous through movement would be
provided by the relocation.
There are sewers and electrical utilities located in the portion of the
alley that is not proposed for vacation.
From the standpoint of the Department of Public Works, we would have no
objection to the proposed vacation from the City street and utility
operational point of view. However, there would be some safety benefit
in keeping the alley as a through alley and_ avoiding a back-out situation
onto the street.

from a property owner point of view, however, it would appear that Mr.
Putman has a valid objection which is worthy of Council consideration.
We would be willing to meet with Mr. Putman and the petitioners in an
effort to compromise or resolve the situation if the Council so desires .
We will have an exhibit map and make a presentation to the City Council
at its ' meeting Tuesday, February 13, 1973.

Gentlemen :
The vacation petition submitted by Standard Service Tire Company was reviewed
by this department and a report submitted to the Mayor and City Council
December 14, 1972. The report verified the signatures on the petition and
indicated the signatures represented 100% of the abutting property owners.
(See attached) This report was mentioned in a memo to Lyman Houk from me
December 8th requesting various information concerning the proposed vacation.
The staff has reviewed the vacation request and determined that an easement
should be required over the west 30 feet of the portion of alley proposed for
vacation to accommodate an existing sanitary sewer in the alley. No other
utilities other than an abandoned water line exist in the alley.
The proposed vacation contains 2,771 square feet of property. Discussions
with an appraiser indicated the value of the property to be substantially
higher than other vacations we' ve considered, and would definitely exceed the
esi:imated appraisal fee of $75.00. A very rough guess of the value of this
alley would be in the neighborhood of $2,400. The Council may charge up to
1/2 of this appraised value, or approximately $1 ,200. If the Council desires
an appraisal , we can quickly order such a report for submittal February 26, 1973.

We were under the impression the alley vacation relative tc Standard
Service Tire had been taken up at the Board of Public Works meeting
of January 3. However, we find that meeting was cancelled and
subsequent meetings referred to the Wes Loberg request to lease
City right-of-way for installation of security fence.
Attached are my memos dated December 8 and December 15 relative to
the alley vacation covering the 100% of owner signatures.
In our estimation, the probable cost of appraisal would likely exceed
that of benefit to the City and no appraisal was ordered by the
Engineering Department.
We recommend vacation of the alley and Mr. Lyman Houk will present,
at the February 7 meeting, any further discussion of the items.

Protest in Kennydale Industrial Sanitary Sewer Project LID 276 bid award, originally
LID 276 Lindbrook Construction, Inc. the low bidder. Letter from Engineering Depart-
ment responding to the letter from Lindbrook Construction, Inc. was read
explaining bids received were in excess of estimate and available funds,and
in order to comply with requirements imposed by Washington State Economic
Assistance Authority it was necessary to delete the two lift stations from
project. Upon contact by Engineering Department, Lindbrook Construction
Inc. asked increase in unit bid price to compensate for loss of lift stations.
As contract must be awarded to lowest bidder on unit prices submitted,
Engineering Department recommended award of contract to O'Leary Construction
Inc. as the low responsible bidder of the reduced contract as bid. Letter
from Maycr Garrett to Lindbrook Construction, Inc. was also read reporting
Council authorization for award to O'Leary Construction Inc. was given on

12/9/72 Bid revised amount of $92,013.50, that contractor meeting all requireme.nts of
Opening the affirmative action statement. Grant requested reading of McHenry's
letter to the Public Works Committee,dated 12/29/72, explaining reduced
scope of project to take advantage of time requirements on existing Washington
State Economic Assistance and HUD funding, prior to availability of LID
funds as public hearing for formation of LID scheduled 2/26/73. Grant
explained low bidder on project had not filed affirmative action and was

removal, was submitted for execution by letter from Acting Engineering

APPOINTMENTS Permanent appointment of Firemen Charles Coffin, Larry Eager and Steven
Fire Dept. Schneider to the Renton Fire Department was announced in letter from
Mayor Garrett, these men having completed six months probationary period
effective December 16, 1972 and recommended for permanent appointment by
Chief Walls. MOVED BY DELAURENTI, SECONDED BY SCHELLERT, AND CARRIED
TO CONCUR IN MAYOR'S APPOINTMENTS.
OLD BUSINESS Councilman Stredicke requested report from Planning Department on landscap-
ing at church school on Union Ave. N.E. He also asked Administration to
Councilman report on niurber of phones in City Hall and the possibility of removing
Stredicke those not used regularly. Stredicke objected to reading newspaper reports
Requests on City survey when report not made to Council. He asked if several confer -
ence rooms could be enlarged to accommodate larger groups and for better
snow removal system for City streets with coordination between State,
County and City on intersecting areas of ownership.
Finance & Report of Finance and Personnel Committee recommended concurrence in
Personnel the Mayor's appointment of Gary E. Smith to Position #14 of Board of

President Nominations being declared open for Council President pro tem for 1973,
Pro tem Elected Grant nominated Charles Delaurenti and Schellert nominated Richard Stredicke.
MOTION BY BRUCE, SECOND BY SCHELLERT,CARRIED,THAT WRITTEN BALLOT BE USED.
Clerk counted ballots which showed STREDICKE 2 votes and DELAURENTI 6 votes,

MINUTE APPROVAL It was moved by Schellert, seconded by Delaurenti, and carried by the

of meeting of November 20, 1972 be approved as prepared and mailed.
CORRESPONDENCE & City Clerk Mead read Petition for Vacation of Alley by Ames, Central
CURRENT BUSINESS Properties Inc. and Standard Service Tire Company in area between
Morris Ave. S. and Logan Ave. S. , north of pipe line right-of-way.
Petition for It was moved by Schellert, seconded by Perry, that the subject
Vacation of Alley petition be referred to Acting Engineering Director to verify signatory
ownership for validity of the petition. Councilman Grant asked Build-
ing Department to review. Motion carried.
Proposal for Benches Letters from Downtown Steering Committee and the Board of Public
On Streets Works reported review of Despain proposal to provide benches with
advertising on public right-of-way. The Board of Public Works concur-
red in the recommendation of Dowtown Steering Committee to reject
the Despain proposal at this time, change in legislation for sign code
and obstructions on public right-of-way being required. Councilman
Grant reported City survey showed lack of seating in downtown area
with Downtown Steering Committee Minutes showing benches planned for
South 3rd St. It was moved by Stredicke, seconded by Delaurenti, and
carried that these two communications be referred to the Community
Services Committee.
AUDIENCE COMMENT Mr. Joe Sporcic asked further consideration of proposal for private
firm to provide benches rather than City purchasing.
APPOINTMENTS Mayor's Appointment of Mr. Randel D. Price to the Renton Fire Department,
probationary position of firefighter, effective December 1, 1972, was
Randel D. Price read. It was moved by Delaurenti, seconded by Perry, and carried that
Fire Department Council concur in the appointment by the Mayor filling vacancy in
the Fire Department.
Gary E. Smith Mayor's Appointment of Mr. Gary E. Smith to the Renton Board of Adjust-
Board of Adjustment ment Position No. 4, was read. It was moved by Stredicke, seconded by
Expires 9/6/74 Delaurenti, and carried that the appointment be referred to the
Finance and Personnel Committee for recommendation.
OLD BUSINESS Finance Committee Chairman Schellert submitted committee report concur-
ring in recommendation of Purchasing Agent declaring certain items
Unneeded Items surplus, to be disposed of in the best interests of the City. It was
Declared Surplus moved by Stredicke, seconded by delaurenti, and approved by Council
members present to concur in committee report and refer the matter to
the Legislation Committee. Carried.
Storage of Trailers Community Services Committee report was read by the Clerk recommending
to be reviewed that the ordinance on storage of trailers, boats, campers and similar
vehicles be referred to the Planning Commission for review. It was
moved by Schellert, seconded by Grant, and carried that the Council
concur in the Community Services Committee report.

Community Services The Community Services report also recommended that on-street parking
Committee Report of trucks, vans and mobile homes be referred to the Transportation
Committee for review and study. It was moved by Delaurenti, seconded
by Schellert, and carried that the Council concur in the Community
Services Committee report.
Legislation Report Legislation Committee report recommended resolution be read and
adopted. City Clerk Mead read resolution declaring various items
Resolution 1827 surplus and authorizing Purchasing Agent to advertise and dispose of
items by sealed bid on a cash basis, "as is" with right to reject any
and all bids. It was moved by Delaurenti, seconded by Schellert,
and carried that the Council adopt the Resolution as read.
NEW BUSINESS Upon inquiry of Councilman Stredicke, City Attorney Shellan explained
12/1/72 Public Friday, December 1, 1972 Public Hearing for 1973 Budget approval. set
Hearing '73 Budget by State law.
Inquiry! re Councilman Grant inquired from Building Department representative
Envirdnmental Ron Nelson status of permits for Segale property fill and Pacific
Impact Car new spur line, Nelson reporting investigation before land fill
permit issued.
Adjournment It was moved by Schellert, seconded by Delaurenti, and approved by
8:55 P.M. Council members present meeting be adjourned. Meeting was adjourned
at 8:55 p.m.

AN ORDINANCE OF THE CITY OF RENTON, WASHINGTON
VACATING A PORTION OF ALLEY LOCATED SOUTH OF
SOUTH 2ND STREET AND WEST OF LQGAN AVENUE, AS MORE
PARTICULARLY DESCRIBED HEREINBELOW.
13 WHEREAS a proper petition for vacating a portion of

been signed by owners representing 1000 of the total footage upon
the portion of said alley to be vacated; and
WHEREAS the City Council by Resolution No . 1836 approved
on January 8 , 1973 , and after due investigation did fix and determine
the 5th day of February , 1973 , at the hour of 8 : 00 P .M. in the City
Council chambers of the City of Renton to be the time and place for
public hearing thereon, which hearing date was continued to February
13 , 1973 ; and the City Clerk having given due notice of such hearing
in the manner provided by law and all persons having been heard
appearing in favor of or opposition thereto; and
WHEREAS the Department of Engineering and other Departments
of the City havingduly considered said petition for said vacation ,
and having found same to be in the public interest and for the public
benefit and no injury or damage to any person or properties will

SECTION I : The following described portion of alley

of the alley sought to be vacated is that portion lying
between the East half of Lot 4 , and all of Lot 5 ,
Block 1 , Smither' s 6th Addition , to the Town of Renton

Town of Renton and that portion of the alley lying
between Lot 5 , Block 1 , Smither' s 6th Addition to the
Town of Renton and Lots 6 , 7 and 8 , Block 1 , Motor line
Addition to the Town of Renton. The width of the portion
of the alley sought to be vacated is 16 .45 feet. The
distancefrom West to East of the portion sought to be
vacated is 78 .45 feet then a distance of 90 feet to the
North.
SUBJECT , HOWEVER, to an easement for utility purposes
retained by the City of Renton , which easement is described
as follows :
The westerly 30 feet of that portion of the above
described alley to be vacated.
BE AND THE SAME ISHEREBY VACATED, subject to payment unto the City
by the Petitioner-Owners of the sum of $2 , 572. 60 , which said
sum constitutes not more than one-half of the appraised value of the
portion of alley so vacated , all pursuant to RCW 35 . 70 . 030 .
SECTION II: This Ordinance shall be effective upon
its passage , approval and five days after its publication, unless

PETITION FOR VACATION OF ALLEY
November , 1972
TO: THE CITY COUNCIL OF RENTON, WASHINGTON
COME NOW the undersigned petitioners , and, pur-
suant to RCW Chapter 35 . 79 respectfully show:
1. The undersigned petitioner request that
the following described portion of an alley in the City
of Renton be vacated pursuant to RCW Chapter 35. 79 :
Said alley runs generally East and West
between Lots 1, 2 , 3 , 4 , and 5 on the
North and Lot 6 on the South, Block 1,
Smither' s 6th Addition to the Town of
Renton, and said alley runs generally
North and South from the alley above
described to Second Avenue between Lot
5, Block 1, Smither' s 6th Addition to
the Town of Renton on the West and Lots
6 , 7 and 8 , Block 1, Motor Line Addition
to the Town of Renton on the East. The
portion of the alley sought to be vaca-
ted is that portion lying between the
East half of Lot 4 , and all of Lot 5 ,
Block 1, Smither ' s 6th Addition, to the
Town of Renton and Lot 6 in Block 1 of
Smither' s 6th Addition to the Town of
Renton and that portion of the alley
lying between Lot 5 , Block 1, Smither ' s
6th Addition to the Town of Renton and
Lots 6 , 7 and 8, Block 1, Motor Line
Addition to the Town of Renton. A dia-
gram of the portions sought to be vaca-
ted is attached hereto. The width of
the portion of the alley sought to be
vacated is 16. 45 feet. The distance
from West to East of the portion sought
to be vacated is 78 . 45 feet then a dis-
tance of 90 feet to the North.
2. The reason for the requested vacation is that
the area sought to be vacated is unused for its intended pur-

pose having become overgrown with underbrush and bushes to
the extent that it is impassable due to non-use. The owners
of the abutting property to the area sought to he vacated
desire to improve their respective property in a fashion to
accommodate a new business venture in Renton but to do so
requires that the various properties be brought together to
have common boundaries without intervening, unused alley-way.
Such use requires fencing for security purposes which cannot
be done across a dedicated, though unimproved alley. The
vacation of the unused alley as requested will place that
property back on the tax roll.
3. The intended use of the land sought to be va-
cated is that the substantial portion thereof will be graded,
surfaced and fenced to provide a secure storage and sales
facility for automobiles and a small portion thereof will be
utilized by adjoining owners for customer parking.
4. The undersigned petitioners are the owners of
all the real estate abutting on the above described area and
said ownerships are as follows :
A. East one-half of Lot 4 , all of
Lot 5, Block 1, Smither' s 6th Addi-
tion to the Town of Renton.
