RMC 4-9-240D.1.h allows for the construction of the lesser of five (5) model homes or twenty percent (20%) of the total number of lots with a Tier 1 Temporary Use Permit. Subdivision of the parcel would result in 45 residential lots used for the eventual development of attached townhomes (Exhibit 1). The applicant is proposing to construct four (4) model townhomes on future lots 17-20 (Exhibit 2) prior to final plat recording. Access to the lots would be gained from Maple Valley Highway and Road A. The applicant has completed an abatement agreement for the Temporary Use (Exhibit 3). The Temporary Use Permit is hereby approved and subject to the following conditions: *CONDITIONS OF APPROVAL: 1.All model townhomes shall be connected to water, sewer, and storm before building permits are final. DocuSign Envelope ID: C8C9ADE1-F389-4BB1-A840-FAA2AABA7799 City of Renton Department of Community & Economic Development Temporary Use Permit Elliott Farms Model Townhomes Temporary Use Permit LUA21-000266, TP Permit Date: July 29, 2021 Page 2 of 2 D_TUP_Elliott_Farms_Model_Homes_210728_v1 2.Only a combined four (4) townhome units shall be issued a building permit for the Elliott Farms subdivision prior to the recording of the plat. 3.The proposed lot lines for the model townhomes for Elliott Farms (Lots 17, 18, 19, and 20) shall be staked and strung to ensure proper assessment of setbacks prior to construction of the model townhomes. 4.The applicant shall provide approved access and fire hydrants prior to construction of the model townhomes. Identification of such access and hydrants shall be provided with the building permit application for review and approval by the Planning Division Project Manager and the Fire Plans Reviewer. The approval body may modify his decision if material evidence not readily discoverable prior to the original decision is found or if he finds there was misrepresentation or fact. After review of the Reconsideration request, if the approval body finds sufficient evidence to amend the original decision, there will be no further extension of the appeal period. Any person wishing to take further action must file a formal appeal within the 14-day appeal time frame. APPEALS: Appeals of permit issuance must be filed in writing on or before 5:00 p.m. on August 12, 2021. Due to the ongoing state of emergency enacted by Governor’s Proclamation 20-05, the City Clerk’s Office is working remotely. For that reason, appeals must be submitted electronically to the City Clerk at cityclerk@rentonwa.gov or delivered to City Hall 1st floor Lobby Hub only on Tuesdays and/or Wednesdays. The appeal fee, normally due at the time an appeal is submitted, will be collected at a future date if your appeal is submitted electronically. Appeals to the Hearing Examiner are governed by RMC 4-8-110 and additional information regarding the appeal process may be obtained from the City Clerk’s Office, cityclerk@rentonwa.gov. EXPIRATION: A Temporary Use Permit is valid for up to one (1) year from the effective date of the permit, unless the Community & Economic Development Administrator or designee establishes a shorter time frame or an applicant can request that a permit be valid beyond the one year expiration, for up to five years at the time of application or prior to permit expiration. EXTENSIONS: Extension requests do not require additional fees and shall be requested in writing prior to permit expiration to the Department of Community & Economic Development Administrator.
