referenced request for a Class A Non-Conforming Use for property located at 3979 Lake
Washington Boulevard North meets the criteria specified in Renton City Code section 4-31-23;
therefore, the request was approved.

Associate, By this letter we request your approval of an existing non-conforming land-use at
approximately 3979 Lake Washington Boulevard North. This request is made as a Class
Kent Pearse,Al "A" Nonconforming Use consistent with the Renton Municipal Code chapter 4-31-23

Last month we made application for building permits for the restoration of an existing
cottage. Upon initial review, staff identified that the existing structure does not conform
to current Land Use setbacks. At that time we were informed that Council anticipated
situations such as ours when it adopted the Interim Land Use code and concurrently
. adopted the Class "A" Nonconforming Use Status process to alleviate such unintended
hardships. Thus we make this request to Council.
Located immediately south of the May Creek outlet, adjacent the southern edge of the
Barbee Mill, the existing structure was built as a residential cottage prior to the Mill being
constructed. In 1945, after the mill was established, the cottage was used as residential
quarters for the nightwatchman and caretaker. It continued to serve as these quarters until
1988 at which time it was converted to storage uses with only intermittent residential use.

Three years ago the owner identified a need to re-establish a nightwatchman/caretaker unit
on site. Shortly thereafter our office was contacted to prepare documents and permit
applications necessary to renovate the existing structure and re-establish the existing
bulkhead along the shoreline which had also fallen into disrepair. Only upon completion
of the site survey, were the actual setbacks identified. For your background, the following
table compares the actual setbacks with required setbacks.
