Mr. Wnek:
Enclosed with this email you will find documentation from the City on when it mailed you
with the Notice of Violation that you have appealed, CODE21- 000313 . In the email
correspondence below the City has requested that your appeals be dismissed on the basis that
you were too late in filing your appeal. Renton Municipal Code Section 1-3-2E2b, which is
quoted below, requires that you "shall submit a written request for a hearing within
fifteen (15) days of the date of the Finding of Violation." The City contends you did
not file your appeal within 15 days of the Notice of Violation as required by
Section 1-3-2E2b. Before I make any ruling on the City's request to dismiss your
appeal, you are entitled to an opportunity to respond to the City's request to explain
why your appeals should not be dismissed. If you do not agree with the City's
position, please provide a written response to the Renton City Clerk's Office by
September 10, 2021 -- your letter must be postmarked by that date. The City must
mail you a response and email its response to the parties of this email by 5:00
pm, September 17, 2019 -- the City's response must also be postmarked by that
date.
At this point in the appeal process the only issue under consideration is the timeliness
of your appeal. I will not be considering the merits of your appeal. If I deny the City's
request to dismiss your appeal, the City Clerk will schedule an appeal hearing where
you will have a full opportunity to address the merits of your appeal.
Renton Municipal Code Section 1-3-2E2b. Timing of a Hearing: If a
Violator and/or persons having any claim against the title or contractual interest in the
property where the violation exists wishes to challenge a Finding of Violation, or to
challenge or mitigate the costs and/or fines, that Violator and/or persons having any
claim against the title or contractual interest in the property where the violation exists
shall submit a written request for a hearing within fifteen (15) days of the date of the
Finding of Violation. The Administrator shall set the date of the hearing within fifteen
(15) days of the received request for a hearing. The decision shall be
entered and mailed or posted no later than fifteen (15) days after the City receives the
written request for a hearing. There shall be no fee to appeal a Finding of Violation.

We received this Code Appeal yesterday and please see Kevin’s email below saying it is
untimely. I have attached Wnek’s appeal. I also called him to get an email address and he
said he does not have one and prefers us to mail anything to him.

This appeal request is untimely. RMC 1-3-2.E requires that an appeal request be received
within 15 calendar days of the finding’s issuance. This finding of violation was issued on
August 3, 2021 and the appeal request was received 21 days later on August 24, 2021.
